FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To remove existing structure and to install and maintain a 60-linear foot 19-foot wide precast concrete frame culvert in Conoy Creek (TSF, MF) for the purpose of improving roadway safety. The project is located in Elizabethtown Borough, Lancaster County. (40° 09` 08.9", -76° 36` 24.2")

E21-462: Rider Musser Development, LLC, 5 Kacey Court, Suite 203, Mechanicsburg, Pennsylvania, 17055 in Upper Allen Township, Adams County, U.S. Army Corps of Engineers Baltimore District.

 To install and maintain:

 1) A 78 foot long, 72 inch diameter, High Density Polyethylene Pipe, depressed 6 inches, with concrete endwalls and riprap scour protection,

 2) 110 lineal feet of 2 inch diameter Polyvinyl Chloride Electrical Conduit,

 3) 110 lineal feet of 2 inch diameter Polyvinyl Chloride Cable Conduit,

 4) 110 lineal feet of 2 inch diameter Polyvinyl Chloride Telephone Conduit, 110 lineal feet of 2 inch diameter Polyvinyl Chloride Electrical Conduit,

 5) 110 lineal feet of 6 inch diameter ductile iron water pipe,

 All the impacts listed are in the floodway or under an unnamed tributary to the Yellow Breeches Creek (CWF, MF) (Latitude: 40.1674, Longitude: -76.9924). No wetland impacts are proposed.

E22-638: Dauphin County Commissioners, 2 South Second Street, 4th Floor, Harrisburg, PA 17101 in Susquehanna Township and Harrisburg City, Dauphin County, U.S. Army Corps of Engineers Baltimore District.

 Capital Area Greenbelt—Fort Hunter Connector. Installation and improvement of a 1.8-mile shared use path in the floodplain of the Susquehanna River (WWF, MF) along Front Street and Linglestown Road in Harrisburg, PA (Latitude: 40°19`45.9", Longitude: -76°54`31.8") for the purpose of a recreational trail. No wetlands will be impacted by this project.

E67-935: ARWCO Corp., 1030 Wilson Avenue, Hanover, PA 17331, Glatco Lodge Road Quarry, Heidelberg Township, York County, U.S. Army Corps of Engineers Baltimore District.

 To fill and maintain a 0.4 acre, abandoned open water quarry pit with clean fill. The project is located west of Glatco Lodge Road, north of its intersection with Moulstown Road (Hanover, PA Quadrangle, Latitude: 39°50`17", Longitude: -76°56`51") in Heidelberg Township, York County. The purpose of the project is to reclaim the mine area and convert the site to productive agricultural land. A completed mitigation site associated with the project is on Orefield Road.

E30-256, Southwestern Pennsylvania Water Authority, 1442 Jefferson Road, P.O. Box 187, Jefferson, PA 15344, Center Township, Greene County, Pittsburgh ACOE District.

 The applicant proposes to:

 Construct, operate, and maintain a utility line crossing of an Unnamed Tributary of McCourtney Run (Existing use is EV; Designated use is HQ-WWF), impacting 20 linear feet of stream, and 2,000 square feet of floodway, for the purpose of constructing an approximately 12,100 linear foot, 12-inch diameter water line. This project will also include three (3) additional utility line stream crossings, to be constructed in accordance with the terms and conditions of General Permit No. 5 (GP-5), regarding utility line stream crossings. The project is located approximately 1.2 mile southwest of the intersection of Route 21 and Route 18 (Holbrook, PA USGS topographic quadrangle; North: 21.0 inches; West: 6.3 inches; Latitude: 39° 51` 58"; Longitude: -80° 17` 40"; Sub-basin 19B; Pittsburgh District Corps) in Center Township, Greene County.

E65-993, Victory Automotive Group, LLC, 64 Greensburg Street, Delmont, PA 15626-1416, Salem Township, Westmoreland County, Pittsburgh ACOE District.

 The applicant proposes to:

 1. Construct and maintain an extension to an existing network of stream enclosures that currently totals over 735 linear feet. (The existing stream enclosure network is comprised of a 230-foot long, 8-foot wide, 7-foot high box culvert; a 150-foot long, 8-foot wide, 7-foot high arch culvert; a 300-foot long, 60" RCP; and a 55-foot long 72" RCP). The proposed structure will connect to the existing box culvert and is proposed to be a 151-foot long, 8-foot wide, 7-foot high precast concrete box culvert. This enclosure will permanently impact 193 linear feet of Unnamed Tributary (UNT) to Beaver Run (HQ-CWF) (aka Stream 1).

 2. Relocate 45 linear feet of Stream 1 in association with the alignment of the proposed stream enclosure.

 3. Relocate an existing, under-ground sanitary sewer line out of the stream channel and onto the adjacent riparian area which will temporarily impact 51 linear feet of Stream 1, 0.05 acre of PEM wetland (aka Wetland 1), and temporarily impact 16 linear feet of UNT to Beaver Run (HQ-CWF) (aka Stream 2).

 For the purpose of developing a Chrysler Millennium vehicle sales and service facility including paved vehicle displays and paved parking areas. The proposed project is located along William Penn Highway (Route 22) between Argenta Way and Cloverleaf Drive (USGS Slickville Quadrangle, Latitude: 40° 23` 56.9"; Longitude: -79° 34` 54.9") in Salem Township, Westmoreland County, PA.

Northwest Region: Oil and Gas Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

E42-377, National Fuel Gas Supply Corporation, 1100 State Street, Erie, PA 16501. YM28 and FM120 Modernization Project, in Wetmore, Hamlin and Sergeant Townships, McKean County, ACOE Pittsburgh District. The proposed project starts at 41.686186, -78.752681 Kane, PA Quadrangle N: 41°, 41`, 10.271"; W: -78°,45`, 9.65" and ends at Wellendorf Storage Line (D6) Wildwood Fire Tower, PA Quadrangle N: 41°, 37`, 14.25"; W: -78°, 28`, 54.55".

 The project consists of the installation and maintenance of approximately 14.4 miles long, 12 inch pipeline and appurtenant structures and the installation via insertion of a 6-inch diameter pipeline into an existing 12 inch line for approximately 5.8 miles. The proposed project impacts in McKean County include a total of 2,542 linear feet of temporary impacts to County Line Run and UNTs (HQ-WT), Doe Run and UNTs (HQ-WT), East Branch Clarion River (HQ-WT), Glad Run and UNTs (HQ-WT), Gum Boot Run (HQ-WT), Lanigan Brook and UNTs (EV-WT), Sevenmile Run and UNTs (HQ-WT), Sicily Run (CWF-WT), UNT to Buck Run (HQ-WT), UNT to Martin Run (HQ-WT), UNT to Windfall Run (CWF-WT), Warner Brook (HQ-WT), Wellendorf Branch (EV-WT), and West Branch Clarion River and UNTs. The project also has 4.38 acres of temporary impacts to Palustrine Emergent (PEM), Palustrine Forested (PFO) and Palustrine Unconsolidated Bottom (PUB) wetlands and 0.19 acre of permanent impacts to Palustrine Forested wetland. To compensate for the proposed permanent project impacts in McKean County, the applicant is proposing the creation of 0.19 acre Palustrine Forested wetland. The proposed project impacts in this permit application are associated with a proposed transmission pipeline project extending approximately 0.3 mile in Pennsylvania in Jones Township, Elk County, PA. The project also extends into Cameron County PA however there are not impacts to aquatic resources.

 The project includes applications for Erosion and Sediment Control with the McKean and Elk County Conservation Districts and Chapter 105 General Permit (GP112417605) with the Department.

ENVIRONMENTAL ASSESSMENTS

D63-003EA. Daniel Bitz, Director of Permitting, Consol Energy, 1000 Consol Energy Drive, Canonsburg, PA 15317, North Franklin Township, Washington County, USACOE Pittsburgh District.

 Project proposes to rehabilitate the existing Washington No. 4 Dam including construction of a labyrinth weir spillway to pass the spillway design flood and placement of material on the crest to level the top of dam. The project will impact approximately 0.26 acre of wetland (PEM). The applicant proposes to purchase wetland banking credits from the Enlow Fork Bank to compensate for unavoidable wetland impacts. The dam is located across Point Lookout Branch Chartiers Creek (WWF) (Washington West, PA Quadrangle; Latitude: 40.1373, Longitude: -80.2671).

D14-133EA. Daniel A. Devlin, Director, Bureau of Forestry, Department of Conservation and Natural Resources, 400 Market Street, P.O. Box 8767, Harrisburg, PA 17105-8767, Potter Township, Centre County, USACOE Baltimore District.

 Project proposes to remove the Penn Nursery No. 2 Dam for the purpose of eliminating a threat to public safety and restoring approximately 350 feet of stream channel to a free-flowing condition. The proposed restoration project includes construction of an armored stream channel, using native bed material, and placement of sub-surface log structures to create riffle habitat in the stream channel through the former reservoir. Wetlands will also be created within the former impoundment. The project is located across a tributary to Potter Run (CWF) (Spring Mills, PA Quadrangle, Latitude: 40.7792; Longitude: -77.6137).

WATER QUALITY CERTIFICATIONS REQUESTS

Northwest Region: Watershed Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

WQ06-001, National Fuel Gas Supply Corporation (Applicant), 1100 State St., Erie, PA. YM28 and FM120 Modernization Project (Project), in Wetmore, Hamlin and Sergeant Townships, McKean County, Jones Township, Elk County, and Shippen Township, Cameron County, ACOE Pittsburgh District. The proposed project starts at 41.686186, -78.752681 Kane, PA Quadrangle N: 41°, 41`, 10.271"; W: -78°, 45`, 9.65" and ends at Wellendorf Storage Line (D6) Wildwood Fire Tower, PA Quadrangle N: 41°, 37`, 14.25"; W: -78°, 28`, 54.55".

 On February 10, 2017, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP17-74-000). The FERC Environmental Assessment for the Project, has not been issued as of the publication date, when available it may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP17-74-000).

 On June 19, 2017, Applicant requested a State water quality certification from the Department, as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania through compliance with State water quality standards and associated State law requirements, which are consistent with the requirements of the Clean Water Act.

 The McKean County portion of the project, as proposed, includes approximately 14.4 miles long, 12-inch pipeline (Line KL) for the purpose of transporting natural gas from Line K in Wetmore Township to an interconnect at Line FM120. The Project, as proposed, will require approximately 224 acres of earth disturbance, and impacts to of 2,542 linear feet of impacts to County Line Run and UNTs (HQ-WT), Doe Run and UNTs (HQ-WT), East Branch Clarion River (HQ-WT), Glad Run and UNTs (HQ-WT), Gum Boot Run (HQ-WT), Lanigan Brook and UNTs (EV-WT), Sevenmile Run and UNTs (HQ-WT), Sicily Run (CWF-WT), UNT to Buck Run (HQ-WT), UNT to Martin Run (HQ-WT), UNT to Windfall Run (CWF-WT), Warner Brook (HQ-WT), Wellendorf Branch (EV-WT), and West Branch Clarion River and UNTs, 5.45 acres of floodway, 4.38 acres of temporary impacts to Palustrine Emergent (PEM), Palustrine Forested (PFO) and Palustrine Unconsolidated Bottom (PUB) wetlands and 0.19 acre of permanent impacts to Palustrine Forested wetland.

 The Elk County portion of the project, as proposed includes approximately 0.30 mile of six-inch diameter 1500 FlexSteel pipe into an existing 12-inch pipeline. It also includes a producer station abandonment. The project as proposed will require a total of approximately 224 acres of earth disturbance, no impacts to streams are proposed as part of the project, approximately 0.512 acre of Palustrine Emergent Wetland (PEM) will be temporarily impacted, no permanent impacts are proposed.

 The Cameron County portion of the project, as proposed includes a producer station abandonment, drip removal and a cut and cap location on an existing pipeline. As proposed there are no aquatic impacts associated with this portion of the project.

 The Department anticipates issuing a State water quality certification to Applicant for the Project that will require compliance with the following State water quality permitting programs, criteria and conditions established pursuant to State law to ensure the Project does not violate applicable State water quality standards set forth in 25 Pa. Code Chapter 93:

 1. Discharge Permit—Applicant shall obtain and comply with a Department National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), and all applicable implementing regulations (25 Pa. Code Chapter 92a).

 2. Erosion and Sediment Control Permit—Applicant shall obtain and comply with the Department's Chapter 102 Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P.S. §§ 680.1—680.17), and all applicable implementing regulations (25 Pa. Code Chapter 102).

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Department Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 673.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601.), and all applicable implementing regulations (25 Pa. Code Chapter 105).

 4. Water Quality Monitoring—The Department retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Applicant.

 5. Operation—Applicant shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this State Water Quality Certification and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 6. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of the Department to determine compliance with this State Water Quality Certification, including all required State water quality permits and State water quality standards. A copy of this certification shall be available for inspection by the Department during such inspections of the Project.

 7. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project which is affected by this State Water Quality Certification, Applicant shall serve a copy of this certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the Department Regional Office of such intent. Notice to the Department shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of certification responsibility, coverage, and liability between them.

 8. Correspondence—All correspondence with and submittals to the Department concerning this State Water Quality Certification shall be addressed to the Department of Environmental Protection, Northwest Regional Office, Lori Boughton, 230 Chestnut Street, Meadville, PA 16335.

 9. Reservation of Rights—The Department may suspend or revoke this State Water Quality Certification if it determines that Applicant has not complied with the terms and conditions of this certification. The Department may require additional measures to achieve compliance with applicable law, subject to Applicant's applicable procedural and substantive rights.

 10. Other Laws—Nothing in this State Water Quality Certification shall be construed to preclude the institution of any legal action or relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal or State law or regulation.

 11. Severability—The provisions of this State Water Quality Certification are severable and should any provision of this certification be declared invalid or unenforceable, the remainder of the certification shall not be affected thereby.

 Prior to issuance of the final State water quality certification, the Department will consider all relevant and timely comments, suggestions or objections submitted to the Department within 30 days of this notice. Comments should be directed to Lori Boughton, Regional Program Manager at the above address or through the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD). Comments must be submitted in writing and contain the name, address and telephone number of the person commenting and a concise statement of comments, objections or suggestions on this proposal. No comments submitted by facsimile will be accepted.

EROSION AND SEDIMENT CONTROL PERMITS

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance activities associated with either road maintenance or timber harvesting operations.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department regional office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department regional office during the 30-day public comment period.

 Following the 30-day comment period, the appropriate regional office water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board (Board).

 The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the appropriate regional office.

 This Pennsylvania Bulletin includes notices for a request for State Water Quality Certification (WQ06-001) required by Section 401 of the Clean Water Act and a Chapter 105 Joint Permit (E42-377) application under Pennsylvania's Dam Safety and Encroachments Act which are under review by the Department.

 The Project, as proposed involves installation of approximately 14.4 miles of new 20-inch diameter, coated steel pipeline (to be designated Line KL upon being placed in service in Wetmore, Sergeant, and Hamlin Township McKean County. Installation via insertion of six-inch diameter 1500 Flexsteel pipe into the existing 12-inch FM120 pipeline for approximately 5.8 miles in Sergeant Township McKean County, and Jones Township Elk County. Approximately 7.7 miles of existing pipeline YM28 is proposed to be abandoned in place in Sergeant and Hamlin Townships, McKean County. Approximately 12.5 miles of the FM120 pipeline south of the pipe insertion will be removed from service and held for future use (HFU) in Sergeant Township McKean County, Jones Township Elk County and Shippen Township Cameron County. The project also includes construction of a new interconnect in Sergeant Township, McKean County, and miscellaneous valve and piping modifications along the pipeline routes.

 The proposed project will require approximately 224 acres of earth disturbance and crossing of 33 streams (including floodways of streams not crossed by the pipeline) totaling 2,542 linear feet of impacts to the following surface waters: County Line Run and UNTs (HQ-WT), Doe Run and UNTs (HQ-WT), East Branch Clarion River (HQ-WT), Glad Run and UNTs (HQ-WT), Gum Boot Run (HQ-WT), Lanigan Brook and UNTs (EV-WT), Sevenmile Run and UNTs (HQ-WT), Sicily Run (CWF-WT), UNT to Buck Run (HQ-WT), UNT to Martin Run (HQ-WT), UNT to Windfall Run (CWF-WT), Warner Brook (HQ-WT), Wellendorf Branch (EV-WT), and West Branch Clarion River and UNTs, 5.45 acres of impact to floodways, and 4.892 acres of (4.702 acres of temporary and 0.19 acre of permanent) wetland impacts.

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. STATE CONSERVATION COMMISSION

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decision law.

 For individuals who wish to challenge actions, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for pro bono representation. Call the Secretary of the Board at (717) 787-3483 for more information.
