FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  6. Temporarily impact 0.035 acre of PEM Wetland 3 and 0.103 acre of PSS Wetland 4 during construction.

 7. Temporarily impact 39 linear feet of unnamed tributary to Brinker Run (UNT-1) to construct a temporary stream crossing.

 This project will impact approximately 52 linear feet of Brinker Run, 27 linear feet of UNT to Brinker Run and 0.007 acre of PSS Wetland 4. Temporary impacts will be restored; permanent stream impacts will be mitigated through the construction of 178 linear feet of relocated stream; the de minimus impact to wetland does not require mitigation. The project purpose is to replace the existing structurally deficient structure over Brinker Run. The project is located at State Route 2012, approximately 2.7 miles from the intersection between Albrights Lake Road and Armburst Brinkertown Road in Mammoth, PA 15664 (Mount Pleasant and Mammoth USGS Topographic Quadrangle, Latitude 40°13`10.84"; Longitude -79°30`34"; Sub-basin: 19D; Pittsburgh Corps District) in Mount Pleasant Township, Westmoreland County.

E0409-001. Pennsylvania Department of Environmental Protection, Bureau of Abandoned Mine Reclamation, Cambria Office, 286 Industrial Park Road, Ebensburg, PA 15931. Abandoned Mine Land Reclamation Project, in Franklin Township, Beaver County, Pittsburgh ACOE District.

 The applicant, Zelienople Airport Authority (ZAA), will backfill a 3,470 feet long by 70 feet high Abandoned Dangerous Bituminous Coal Highwall. Located at the base of the dangerous highwall is a 3.91-acre discharging impoundment that measures 2,300 feet long, varies in depth by 3 to 20 feet and varies in width by 30 to 120 feet which will also be filled by the ZAA. The discharging impoundment will be relocated as an approximately 2,730 feet long discharging channel functioning as unnamed tributary of the Connoquenessing Creek, Warm Water Fishes (WWF). There are no wetlands that are associated with the existing 3.91-acre discharging impoundment. (Zelienople Quadrangle 40°48`10"N, 80°09`31"W).

 Applicant is requesting Clean Water Act Section 401 State Water Quality Certification for a wetland enhancement project proposed under the US Department of Agriculture—Natural Resource Conservation Service Wetland Reserve Program. The overall purpose of this project is to restore and enhance wetlands degraded and manipulated by previous agricultural activities and to increase the amount, habitat diversity, and function/value of wetlands in the easement area. This project proposes installation of 1 ditch plug, and 2 potholes which are anticipated to enhance 0.52 acre of existing wetland and create 0.09 acre of new wetland. Construction of the ditch plug and potholes will result in permanent impact to 0.02 acre of wetland. This project has received Federal authorization under a USACE Nationwide Permit 27.

 Approval of a Reasonably Available Control Technology (RACT II) plan for Hazleton Generating LLC located in Hazle Twp., Luzerne County.

 In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection has made a preliminary determination to approve a RACT II plan and an amendment to the State Implementation Plan (SIP) for the Hazleton Generating LLC located in Hazle Twp., Luzerne County.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit 48-00021 for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal.

 The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:

Proposed State Water Quality Certification Required by Section 401 of the Clean Water Act
for the Dominion Energy Transmission, Inc.
Supply Header Project

WQ05-014, Dominion Energy Transmission, Inc. (DETI), 5000 Dominion Boulevard, Glen Allen, VA 23060, Murrysville Borough, Salem Township and Franklin Township, Westmoreland County and Greene County, Pittsburgh ACOE District.

 In Westmoreland County, the proposed pipeline starts northwest of Delmont (Slickville, PA Quadrangle; N: 40° 25` 22.66"; W: -79° 35` 32.22") and extends northwest to DETI's existing JB Tonkin Compressor Station, where modification will be completed to add additional compression (Murrysville, PA Quadrangle; N: 40° 27` 46.96"; W: -79° 38` 25.88"). In Greene County, modifications to DETI's existing Crayne Compressor Station in Franklin and Mather Townships will be completed to add additional compression (Mather, PA Quadrangle; N: 39° 55` 11.9"; W: -80° 7` 21.4").

 On September 18, 2015, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP15-555-000). The FERC final Environmental Impacts Statement for the Project, which was issued on July 21, 2017, may be viewed on FERC's website at www.ferc.gov (search eLibrary; Advanced Search; Access Number 20170721-3017).

 On April 4, 2017, Applicant requested a State water quality certification from the Department, as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania through compliance with State water quality standards and associated State law requirements, which are consistent with the requirements of the Clean Water Act.

 The Project, as proposed, includes approximately 3.9 miles of 30-inch diameter natural gas pipeline loop (TL-636) adjacent to the Applicant's existing LN-25 pipeline (E65-800) in Westmoreland County. The project also includes modifications to the existing JB Tonkin Compressor Station in Westmoreland County and modifications to the existing Crayne Compressor Station in Greene County. The Project, as proposed, will require approximately 81.1 acres of earth disturbance, impacts to 220 linear feet of unnamed tributaries to Turtle Creek (TSF), Kemerer Hollow (HQ-CWF) and its unnamed tributaries, Steels Run (HQ-CWF) and its unnamed tributaries, and Haymakers Run (HQ-CWF) and its unnamed tributaries, 0.31 acre of floodway, and 0.28 acre of permanent PEM and PFO wetland impacts.

 The Department is proposing to issue a State water quality certification to Applicant for the Project that will require compliance with the following State water quality permitting programs, criteria and conditions established pursuant to State law to ensure the Project does not violate applicable State water quality standards set forth in 25 Pa. Code Chapter 93:

 1. Discharge Permit—Applicant shall obtain and comply with a Department National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), and all applicable implementing regulations (25 Pa. Code Chapter 92a).

 2. Erosion and Sediment Control Permit—Applicant shall obtain and comply with the Department's Chapter 102 Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P.S. §§ 680.1—680.17), and all applicable implementing regulations (25 Pa. Code Chapter 102).

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Department Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 673.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601.), and all applicable implementing regulations (25 Pa. Code Chapter 105).

 4. Water Quality Monitoring—The Department retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Applicant.

 5. Operation—Applicant shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this State Water Quality Certification and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 6. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of the Department to determine compliance with this State Water Quality Certification, including all required State water quality permits and State water quality standards. A copy of this certification shall be available for inspection by the Department during such inspections of the Project.

 7. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project which is affected by this State Water Quality Certification, Applicant shall serve a copy of this certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the Department Regional Office of such intent. Notice to the Department shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of certification responsibility, coverage, and liability between them.

 8.  Correspondence—All correspondence with and submittals to the Department concerning this State Water Quality Certification shall be addressed to the Department of Environmental Protection, Southwest Regional Office, Dana Drake, P.E., Waterways and Wetlands Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222.

 9. Reservation of Rights—The Department may suspend or revoke this State Water Quality Certification if it determines that Applicant has not complied with the terms and conditions of this certification. The Department may require additional measures to achieve compliance with applicable law, subject to Applicant's applicable procedural and substantive rights.

 10. Other Laws—Nothing in this State Water Quality Certification shall be construed to preclude the institution of any legal action or relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal or State law or regulation.

 11. Severability—The provisions of this State Water Quality Certification are severable and should any provision of this certification be declared invalid or unenforceable, the remainder of the certification shall not be affected thereby.

 Prior to issuance of the final State water quality certification, the Department will consider all relevant and timely comments, suggestions or objections submitted to the Department within 30 days of this notice. Notice of Projects under the Environmental
Good Samaritan Act

 The Environmental Good Samaritan Act (27 Pa.C.S. §§ 8001—8114) provides certain protections and immunities from civil liability for landowners and persons who voluntarily undertake reclamation and abatement projects to address land and water adversely affected by mining or oil or gas extraction or exploration for natural resources and left in an unreclaimed condition or left discharging water pollution. In order for landowners and persons to qualify for immunity, the projects must be approved by the Department.
