FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 PA DOT Engineering District 3-0 proposes to rehabilitate a single span concrete arch on SR 0006 over an Unnamed Tributary to Charleston Creek. The existing structure has a span of 7.4 Ft., a skew of 60 degrees, an underclearance of 8.7 Ft., roadway width of 116 Ft., and a hydraulic opening of 40 Ft². The proposed structure will be slip lined with a steel plate liner on partial height concrete jackets, with stream bed paving and baffles. The streambed paving and concrete baffles will be constructed in accordance with the BD-632M. The proposed structure will have a span of 5.9 Ft., a skew of 60 degrees, an underclearance of 8.3 Ft., roadway width of 132.5 Ft. and a hydraulic opening of 38 Ft². The proposed structure will be extended 13 Ft. upstream to accommodate the roadway side slope, which will result in approximately 37 Ft. of channel realignment. The project will permanently impact 0.01 acres of jurisdictional wetlands. The unnamed tributary to Charleston Creek is classified as a Warm Water Fishery by Title 25, Chapter 93 Water Quality Standards.

 The applicant proposes to:

 Construct and maintain a concrete pedestrian/bicycle ramp, a kayak ramp, and temporary construction causeway along the right bank of the Monongahela River (WWF & N) for the purpose of linking Point State Park and the downtown Pittsburgh area to the Three Rivers Heritage Trail and the Great Allegheny Passage. The project is located at the Smithfield Street Bridge, approximately 4,000.0 feet upstream from the confluence of the Monongahela, Allegheny and Ohio Rivers (Pittsburgh West, PA Quadrangle N: 11.2 inches; West: 0.2 inch; Latitude: 40° 26` 12"; Longitude: 80° 00` 05") in the City of Pittsburgh, Allegheny County and will impact approximately 435.0 linear feet of stream channel.

 E02-1763, Moon Transportation Authority, 100 Beaver Grade Road, Moon Township, PA 15108, Moon Township, Allegheny County, Pittsburgh ACOE District.

 The applicant proposes to:

 1. Relocate approximately 39` of a UNT to McClarens Run (a.k.a. Spring Channel) (TSF) through a 16` long channel into a storm sewer system, consisting of 203` of 18" pipe; and

 2. Construct and maintain a 31` section of 36" pipe and 106` (in two sections) of 42" pipe, which will be used to relocate 319` of another UNT of McClarens Run (a.k.a. PER03) (TSF);

 For the purpose of improving the Thorn Run Road Interchange, to address traffic congestion and to improve traffic safety. The project is located approximately 650 feet south of the intersection of Coraopolis Heights Road and Thorn Run Road Extension (Oakdale, PA USGS Topographic Quadrangle; Latitude: 40° 29` 34"; Longitude: -80° 12` 36"; USACE: Pittsburgh District; Sub-basin 20G), in Moon Township, Allegheny County. This interchange improvement project will cumulatively impact approximately 176 LF of existing watercourses.

 To mitigate for these impacts, 595` of stream bank along Montour Run (TSF) will be stabilized and enhanced. A temporary road crossing will be installed within Montour Run, to construct the stream bank stabilization/enhancement. The mitigation project is located approximately 2,350 feet southwest of the intersection of Hassam Road and Montour Trail, on Forest Grove Sportsmen's Association property (Oakdale, PA USGS Topographic Quadrangle; Latitude: 40° 29` 48.44"; Longitude: -80° 12` 28.06"; USACE: Pittsburgh District; Sub-basin 20G), in Moon Township, Allegheny County.

 The Applicant requests a 10-year extension to Permit No. E25-404B which authorizes the Erie-Western Pennsylvania Port Authority to perform maintenance dredging within 19 defined management units along portions of Presque Isle Bay and Lake Erie in Erie County. The current permit expires on December 31, 2017.

The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

STATE CONSERVATION COMMISSION

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decision law.

 For individuals who wish to challenge actions, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for pro bono representation. Call the Secretary of the Board at (717) 787-3483 for more information.
