Availability of National Pollutant Discharge Elimination System General Permit for Point Source Discharges from the Application of Pesticides (PAG-15)

[Saturday, October 28, 2017]Under the authority of The Clean Streams Law (35 P.S. §§ 691.1—691.1001), the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1388) and sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P. S. §§ 510-5, 510-17 and 510-20), the Department of Environmental Protection (Department), by this notice, informs the public of the availability of the National Pollution Discharge Elimination System (NPDES) PAG-15 General Permit for Point Source Discharges from the Application of Pesticides (PAG-15). The PAG-15 General Permit is applicable to certain entities that make a decision to control mosquitoes and flying insect pests, weeds and algae, animal pests, and forest canopy pests in and near water's edge, exceeding annual treatment area thresholds.
The reissued General Permit PAG-15 will become effective at 12 a.m. on Sunday, October 29, 2017.
Notice of the availability of a draft PAG-15 General Permit was published at 47 Pa.B. 4041 (July 22, 2017). A 30-day comment period was provided as part of the draft permit publication. No public comments were received.
The PAG-15 General Permit is intended to provide NPDES permit coverage to persons applying pesticides that result in discharges to surface waters of the Commonwealth that are not considered High Quality or Exceptional Value.
No substantive changes were made to the final PAG-15 General Permit in comparison to the draft PAG-15 General Permit published at 47 Pa.B. 4041.
The Notice of Intent (NOI) fee for coverage under the General Permit is $500 per year the permittee operates under the General Permit. The NOI fee will be paid in installments due at the time the annual report is due, with the initial fee of $500 submitted with the NOI for permit coverage and an installment of $500 to be submitted with the annual report, if the permittee does not wish to terminate permit coverage.
The General Permit package can be accessed through the Department's eLibrary web site at www.elibrary.dep.state.pa.us (select ''Permit and Authorization Packages,'' then ''Clean Water,'' then ''PAG-15 General Permit'').
In accordance with 25 Pa. Code § 92a.84(c)(2) (relating to public notice of general permits), the Department will publish notice of each approval of PAG-15 coverage in the Pennsylvania Bulletin.
