Availability of Draft National Pollutant Discharge Elimination Systems General Permit for Stormwater Discharges Associated with Construction Activities (PAG-02)

 The Department of Environmental Protection (Department) is proposing to reissue the National Pollutant Discharge Elimination System (NPDES) General Permit for Stormwater Discharges Associated with Construction Activities (PAG-02). This NPDES general permit is issued under the authority of the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1388) and The Clean Streams Law (35 P.S. §§ 691.1—691.1001). The current PAG-02 permit is scheduled to expire at midnight on December 7, 2017. The Department is not proposing any changes to PAG-02 at this time.

 The Department invites public comments on the proposed reissuance of PAG-02. Interested persons are invited to submit written comments through Monday, December 4, 2017. Comments, including comments submitted by e-mail, must include the originator's name and address. Commentators are encouraged to submit comments using the Department's online eComment system at www.ahs.dep.pa.gov/eComment. Written comments should be submitted by e-mail to ecomment@pa.gov or by mail to the Department of Environmental Protection, Policy Office, 400 Market Street, P.O. Box 2063, Harrisburg, PA 17105-2063.

 The proposed PAG-02 is available on the eComment site previously noted or at www.elibrary.dep.state.pa.us (select ''Permit and Authorization Packages,'' then ''Clean Water,'' then ''PAG-02 (Draft)'').

 Persons with a disability may contact the Department by using the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD users) or (800) 654-5988 (voice users). Following the specified comment period, the Department will review all submitted comments, prepare a comment and response document and the final documents package for this General Permit. Availability of the final permit documents will be announced in the Pennsylvania Bulletin.

 Written comments submitted during the 30-day comment period will be retained by the Department and considered in finalizing the General Permit. The Department will provide an opportunity for any interested person or group of persons, any affected State, any affected interstate agency, the United States Environmental Protection Agency or any interested agency to request or petition for a public hearing with respect to the proposed General Permit. The request or petition for public hearing, which must be filed within the 30-day period allowed for filing of written comments, must indicate the interest of the party filing the request and the reasons why a hearing is warranted. A hearing will be held if there is significant public interest.
