FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Curwensville Municipal Authority is seeking Department approval to remove three abandon concrete encased sanitary sewer crossings of Anderson Creek that prohibit navigability and aquatic species passage. Anderson Creek is designated a Cold Water Fishery (CWF) and Migratory Fishery (MF) by Department Chapter 93 Rules and Regulations. Complete and successful removal of the three below listed abandon structures shall include, but not be limited to, (1) demolition and removal of the concrete encasements, (2) removal of the inoperable sanitary sewers (3) restoration of scoured downstream bed elevations with appropriately sized native rock choked with excavated streambed materials to transition with unaffected downstream bed elevations, and (4) stabilize disturbed streambanks with R-8 rock. As proposed, removal of the abandon concrete encased sanitary sewers pose cumulative temporary impacts of 390-feet with no wetland impacts being incurred.

Project description and location: This project involves the discharge of supernatant from the Fort Mifflin Confined Disposal Facility (FMCDF) to the Schuylkill River. The FMCDF is located in Philadelphia County, and is owned by the United States Army Corps of Engineers (USACE). The project involves maintenance dredging of certain port facilities owned by Philadelphia Regional Port Authority (PRPA) and the placement of dredged material into the FMCDF. The dredging and placement, including the operation of the CDF in such a manner as to retain the dredged material and prevent it returning to the River in the discharge, will be conducted by a contractor to be retained by PRPA.
Prior to issuance of the final state water quality certification, DEP will consider all relevant and timely comments, suggestions or objections submitted to DEP within 14 days of this notice. NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O.
