MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act(33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

In addition, the Department imposes a technology-based aluminum limit of 2.0 mg/l (30 day average) to protect stream uses.
A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The BAT limits for noncoal mining activities as provided in 40 CFR Part 436 and 25 Pa. Code Chapters 77 are as follows:

Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation—Memorandum of Understanding (MOU) Concerning Water Quality Management, NPDES Program Implementation, and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.
Coal NPDES Permits Issued

A revision to the NPDES Permit issued on August 10, 2016 for the Parkwood Mine in Plumcreek Township, Armstrong County. This Amendment is the Department of Environmental Protection's final action to settle Environmental Hearing Board Appeal Docket No. 2016-124-R. The settlement is contained in an April 13, 2017 Consent Order and Agreement entered into by the Department of Environmental Protection and Western Allegheny Energy. LLC which was transferred to Rosebud Mining Company. In settlement, the permittee, Rosebud Mining Company, was required to submit an NPDES Permit Application to have the osmotic pressure effluent limitation at Outfall 002 amended.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

Project proposes to remove the Penn Nursery No. 2 Dam for the purpose of eliminating a threat to public safety and restoring approximately 350 feet of stream channel to a free-flowing condition. Approval of a Reasonably Available Control Technology (RACT II) plan for Jeraco Enterprises, Inc. located in Milton Borough, Northumberland County.
In accordance with 25 Pa. Code §§ 129.96—129.100, the Department of Environmental Protection (Department) has made a preliminary determination to approve a RACT II plan and an amendment to the State Implementation Plan (SIP) for the Milton Plant owned and operated by Jeraco Enterprises, Inc. in Milton Borough, Northumberland County.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.
The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (49-00014) for the facility. The relevant RACT II requirements will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal this includes the provisions of the Department's presumptive Reasonably Available Control Technology (RACT II) requirements in accordance with 25 Pa. Code § 129.97, as they apply to existing sources at this facility.
The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:
Source RACT II Requirements Source 101A—Spray Layup & Cleanup Operations No gelcoat material shall contain styrene in excess of 37%, by weight, and no resin material shall contain styrene in excess of 36%, by weight; the total combined emission of volatile organic compounds shall not exceed 63 tons in any 12 consecutive month period; the total combined emission of styrene shall not exceed 50.2 tons in any 12 consecutive month period; records of material usage and VOC emissions; all gel coats and resins shall be applied using airless spray systems, or equivalent or better, as determined by the Department; all solvents used for spray line cleaning shall be flushed into closed containers, under no circumstances shall cleanup solvent be removed from spray lines by spraying through a spray gun; all containers of solvent and waste solvent shall be kept closed when not in actual use and all solvent-wet rags shall be stored in closed containers when not in actual use; under no circumstances shall waste solvent be disposed of or solvent-wet rags, etc. be treated or pretreated prior to disposal or reuse by subjecting them to air drying or any other means of solvent removal which would cause solvent to be evaporated into the air; the only cleanup solvent to be used for spray line flushing and spray equipment cleanup activities shall be acetone, unless Department approval is granted for the use of an alternative cleanup solvent. Source 102A—Surface Coating & Cleanup Operations All clear coatings (transparent top coats) used in Source 102A shall contain no more than 4.5 pounds of volatile organic compounds per gallon of coating, less water and exempt compounds, as applied; all primer coating materials used in Source 102A shall contain no more than 4.8 pounds of volatile organic compounds per gallon of coating, less water and exempt compounds, as applied; all basecoat coating materials used in Source 102A shall contain no more than 5.0 pounds of volatile organic compounds per gallon of coating, less water and exempt compounds, as applied; the only cleanup solvent to be used for spray line flushing and spray equipment cleanup activities associated with Source 102A shall be acetone, unless Department approval is granted for the use of an alternative cleanup solvent; all surface coatings shall be applied using a high volume, low pressure (HVLP) spray system, or equivalent or better spray system, as determined by the Department; all solvents used for spray line cleaning shall be flushed into closed containers; under no circumstances shall cleanup solvent be removed from spray lines by spraying through a spray gun. All containers of solvent and waste solvent shall be kept closed when not in actual use and all solvent-wet rags shall be stored in closed containers when not in actual use. Under no circumstances shall waste solvent be disposed of or solvent-wet rags, etc. be treated or pre-treated prior to disposal or reuse by subjecting them to air drying or any other means of solvent removal which would cause solvent to be evaporated into the air; store all VOC-containing coatings, thinners or coating-related waste materials and VOC-containing cleaning materials and used shop towels in closed containers; ensure that mixing and storage containers used for VOC-containing coatings, thinners or coating-related waste materials and VOC-containing cleaning materials are kept closed at all times, except when depositing or removing these materials; minimize spills of VOC-containing coatings, thinners or coating-related waste materials and VOC-containing cleaning materials and clean up spills immediately; convey VOC-containing coatings, thinners or coating-related waste materials and VOC-containing cleaning materials from one location to another in closed containers or pipes. Public hearing. A public hearing will be held if requested by February 1, 2018, to accept oral comments on the proposed operating permit revision and the proposed SIP revision. The hearing will be held, if requested, on February 8, 2018, at 10 a.m. at the Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA 17701-6448. Each organization is requested to designate one witness to present testimony on its behalf. A 30-day comment period from December 23, 2017, will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed RACT II Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the proposed RACT II Plan.
