PUBLIC WATER SUPPLY PERMITS

 The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

Plan Description: The approved plan provides for the conversion of the existing Trickling Filter/Solids Contact process to the Membrane Bioreactor process. This alternative repurposes all of the existing tankage, while converting to a more efficient and operationally flexible secondary treatment process with treatment capabilities for potential future total nitrogen limits. The treatment plant will retain its design flow of 4.0 MGD. The Department's review of the sewage facilities plan has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF
OCTOBER 18, 1988

PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT

Moyer Landfill Superfund Site, Lower Providence Township, Montgomery County

 The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P.S. §§ 6020.101—6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601—9675), has entered into a Prospective Purchaser Agreement (Agreement) with Carmela Farms, LLC (Carmela Farms) regarding its purchase of the Moyer Landfill Site (Site).

 The Site is located at 20 Moyer Road, in Lower Providence, Montgomery County. The Site consists of approximately 60 acres of an inactive landfill that has been capped in accordance with the remedy selected by the Department. Currently, the Site presents as a large open space area surrounded by wooded area on steep slopes. The Site consists of soil and groundwater contamination, which was the result of the landfill's acceptance of a variety of solid and liquid hazardous wastes.

 The USEPA deemed the remedial action to be complete, operational and functional on September 17, 2002, and the Department has been performing operation and maintenance (O&M) obligations at the Site since the completion of EPA's remedial actions. These actions consist primarily of mowing the grass on the landfill cap, erosion and sedimentation control construction and repair, operation of the groundwater pumping stations, monitoring of leachate volume and quality, payment of annual sewerage fees to Lower Providence Sewer Authority, and continued air quality monitoring and laboratory assessments.

 In connection with its purchase of the Site, Carmela Farms desires to resolve its potential liability to the Department for reimbursement of certain response costs to be incurred at the Site. The Department has determined that it is in the public interest to resolve its claim against Carmela Farms. Consequently, the Department and Carmela Farms have signed an Agreement, in which Carmela Farms has agreed to conduct a portion of the Department's O&M at the Site.

 This notice is provided under Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that, ''settlement shall become final upon the filing of the Department's response to significant written comments.'' The Agreement is available for public review and comment. The Agreement can be examined from 8 a.m. to 4 p.m. at the Department's Southeast Regional Office, located at 2 East Main Street in Norristown, PA 19401, by contacting either Joshua Crooks at (484) 250-5784 or Robert J. Schena, Esquire at (484) 250-5865. Mr. Crooks and Mr. Schena may also be contacted electronically at jocrooks@pa.gov and roschena@pa.gov, respectively. A public comment period on the Agreement will extend for 60 days from today's date. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

ARCADIS U.S. Inc., 10 Friends Lane, Suite 200, Newtown, PA 18940, on behalf of Koch Remediation & Environmental Services, LLC, 4111 East 37th Street North, Wichita, KS 67720, submitted a Final Report concerning remediation of site soil and groundwater contaminated with PCBs and other Organic Compounds. The report demonstrated attainment of the Statewide Health and Site-Specific Standards and was approved by the Department on January 25, 2017.

Former Westfield Tannery, Westfield Borough, Tioga County. SSM Group, Inc., 1047 N. Park Road, Reading, PA 19610, on behalf of Tioga County Development Corp, 114 Main Street, Wellsboro, PA 16901, has submitted a Final Report concerning remediation of site soil contaminated with Lead. The facility serves as a terminal, receiving product, storing, and shipping product out. The sources at the facility include: Silos 29-38; North, Central and South bulk load-out; the plant roadway, and a 500-gallon gasoline storage tank. The facility is a natural minor. The facility wide particulate, PM-10, and PM-2.5 emissions are less than 5 TPY, respectively. The permit also incorporates the change of ownership from Essroc Cement and changes the responsible official and permit contact. The renewal permit contains emission restrictions, recordkeeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

43-00366: National Fuel Gas Supply Corp.—Mercer Compressor Station (6363 Main Street, Williamsville, NY 14221) on January 24, 2017, the Department issued a Natural Minor Permit to operate a natural gas compressor station in Jefferson Township, Mercer County. The sources at the facility include three natural gas-fired compressor engines, a natural gas-fired emergency generator engine, a waste fluid storage vessel, space heaters, and miscellaneous equipment for piping and liquid storage. The engines are subject to standards in 40 CFR 60 Subpart JJJJ pertaining to Standards of Performance for Stationary Spark Ignition Internal Combustion Engines. The new permit contains emission restrictions, testing, monitoring, recordkeeping, reporting, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act. The potential emissions from the facility are: 27.22 TPY VOC; 37.69 TPY NOx; 41.93 TPY CO; 3.53 TPY Formaldehyde; 8.33 TPY total HAPs; 0.15 TPY SOx; 2.47 TPY PM10 and PM2.5; and 43,080 TPY GHGs (CO2e).

61-00012: OMG Americas, Inc. (P.O. Box 111, Franklin, PA 16323) on January 26, 2017 issued a Synthetic Minor Permit to operate an industrial chemical manufacturing facility. The facility manufactures specialty chemicals, metal carboxylate, and cobalt and nickel salts using batch type processing manufacturing. The facility is located in Sugarcreek Borough, Venango County. The Synthetic Minor Operating Permit limits the emission of Volatile Organic Compound to 49.9 TPY (Tons per year) emissions of any single Hazardous Air Pollutants to 9.9 TPY, and emissions from all Hazardous Air Pollutants to 24.9 TPY. The emitting sources include a Kewanee Boiler rated at 37.7 mmbtu/hr, a Hurst Boiler rated at 37.6 mmbtu/hr, reactors for Carboxylate Manufacturing, reactors for the Light Color Process, reactors for the Cobalt Carboxylate Process, Packaging (filling drum), Pastillator 1, 2 & Hopper, Miscellaneous Natural gas usage, Miscellaneous Small Sources, a Kohler emergency generator, two Clarke Detroit Diesel Fire Pump Engines, three small natural gas emergency generator engines, and Miscellaneous Cold Cleaning Degreasers. The 2014 actual emissions from the facility were: Ammonia: 1.29 TPY (Tons per year), CO: 3.8 TPY, NOx: 1.9 TPY, PM10: 0.3 TPY, SOx: 0.027 TPY, VOC: 19.5 TPY, Cobalt Compound: 0.09 TPY, Glycol Ether: 0.17 TPY and Phenol: 0.05 TPY. The reactors are controlled by scrubbers and condensers. The emissions from the Pastillators and Hopper are controlled by fabric collectors. The two fire pump engines the diesel emergency generator engine and two of the natural gas emergency generator engines are subject to 40 CFR Part 63, Subpart ZZZZ pertaining to NESHAPs for Stationary Reciprocating Internal Combustion Engines. All applicable conditions of Subpart ZZZZ have been included in the source level of the permit.

46-00005: Merck, Sharp & Dohme (770 Sumneytown Pike, West Point, PA 19486-0004) On January 5, 2017 for operation of a pharmaceutical manufacturing facility in Upper Gwynedd Township, Montgomery County. This Significant Permit Modification Application will follow the same procedures that apply to initial permit issuance in accordance with 25 Pa. Code §§ 127.542(b), 127.505 and 127.424. TVOP-04-00306: BASF Corporation (370 Frankfort Road, Monaca, PA 15061). Per Title 25 Pa. Code § 127.449(i), this Notice is for the following de minimis emission increase at the BASF Corporation Monaca Plant located in Potter Township, Beaver County:

 Project to install the following equipment:

 1. Project to install and operate a closed top 150,000 gallon 2-Ethylhexyl Acrylate (2-EHA) raw material storage tank, a closed 7,000 gallon intermediate pressure vessel which will intermittently contain a mixture of water and monomers (VOC and HAPs), and associated piping and equipment to support Acronal production (Source 102).

 2. Any emissions resulting from working and breathing losses from the raw material storage tank and the intermediate vessel shall be vented to the existing thermal oxidizer at the facility.

 3. Net throughput shall not exceed 10 million gallons in any consecutive 12-month period for the raw material storage tank and 1.9 million gallons in any consecutive 12-month period for the intermediate pressure vessel.

 4. The owner/operator shall maintain monthly throughput records for both the raw material storage tank and the intermediate pressure vessel.

 5. Total emissions from this project shall not exceed 0.20 tpy VOC and 0.20 tpy HAPs.

 The list of de minimis increases for this facility includes only this project.
