Federal Consistency under the Coastal Zone Management Act; Construction of a Stormwater Outfall at Presque Isle Bay

[48 Pa.B. 1480]
[Saturday, March 10, 2018]

This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that the Erie-Western Pennsylvania Port Authority (EWPPA) is proposing to construct a new stormwater outfall into the East Canal Basin of Presque Isle Bay in the City of Erie, Erie County.

The new outfall is associated with the construction of a new hotel at the northeast corner of East Front Street and State Street in the City of Erie, as proposed by Scott's Development Company (SDC). The outfall will be constructed by SDC on the northeast corner of the project site and located on lands owned by the EWPPA. The outfall will consist of a 36-inch maximum diameter pipe and endwall structure and will discharge into the East Canal Basin. EWPPA is seeking Federal authorization from the United States Army Corps of Engineers for the placement and construction of the outfall.

This project is subject to Department review for Federal consistency because it is a Federal license and permit activity and will have reasonably foreseeable effects on the Commonwealth's coastal resources or uses.

In accordance with National Oceanic and Atmospheric Administration (NOAA) regulations in 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), EWPPA has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program. Interested parties may request a copy of the Federal Consistency Certification from the Department contact listed as follows.

Questions regarding this review should be directed to Matthew Walderon, Federal Consistency Coordinator, at (717) 772-2196 or RA-Fed_Consistency@pa.gov.

The Department will consider all comments received on or before March 26, 2018, before issuing a final Federal consistency concurrence or objection. Comments, including comments submitted by e-mail, must include the originator's name and address. Comments submitted by facsimile will not be accepted. Commentators are encouraged to submit comments using the Department's eComment system at www.ahs.dep.pa.gov/eComment or by e-mail to ecomment@pa.gov. Written comments may be submitted by mail to the Policy Office, Department of Environmental Protection, 400 Market Street, Harrisburg, PA 17101.
