FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

PA DOT Engineering District 3-0 proposes to replace a single span concrete encased steel I beam bridge with a single cell concrete box culvert. The existing bridge has a span of 16.7 Ft., a skew of 90 degrees, an underclearance of 10.8 Ft. and a low chord of 1,565.98 Ft. and a hydraulic opening of 179.8 Ft2. The proposed box culvert has a span of 19 Ft., a skew of 90 degrees, an underclearance of 7.5 Ft. and a low chord of 1,562.52 Ft. and a hydraulic opening of 142.5 Ft2. Both the existing and proposed structure will convey the 500 year storm without overtopping. The proposed structure will include culvert depression, baffles and native material throughout the structure in accordance with the BD-632M and PA Fish and Boat Commission recommendations. The project will utilize R-8 Rip Rap scour protection at the inlet and outlet. The project will temporarily impact 0.02 acre and permanently impact 0.01 acre of jurisdictional wetlands. The wetland impact is considered Deminimus and does not require mitigation. The project is beyond the 12 Ft threshold of GP-11. Losey Creek is classified as a Warm Water Fishery by Title 25, Chapter 93 Water Quality Standards. This permit also includes 401 Water Quality Certification

For the purpose of replacing the existing structurally deficient structure over Cowanshannock Creek (WWF). The permanent PEM and PSS wetland impacts will be mitigated at the PennDOT District 10-0 Armstrong County Wetland Bank with 0.064 acre of wetland credits. Remove a single-span, steel I-beam structurally deficient bridge over Little Chartiers Creek (HQ-WWF) on SR 1023 in North Strabane Township, Washington County. The existing bridge consists of 5 W36X160 I-beams. The beams have pitting and rust on the lower webs and outer edges of the bottom flanges. The project will consist of the construction and maintenance of an 84-foot long, single span, prestressed concrete spread box beams bridge. The bridge will increase from 18.96 feet to 32.0 feet and will include two 11-foot lanes and 4-foot shoulders. Upgrades will include guiderail updates, drainage improvements, and overlaying of approaches. A temporary stream crossing with four, 48" temporary pipes will be constructed to allow construction access. The project will include the relocation of two unnamed tributaries to Little Chartiers Creek. Unnamed tributary (UNT-1) will have a total of 121 linear feet of permanent impact due to channel relocation and replacement of an existing 30" corrugated metal pipe (CMP) culvert. The existing 30" CMP is 21 feet long and will be replaced with a corrugated plastic 36" pipe that is approximately 22 feet in length. The pipe will be depressed six inches into the streambed. Unnamed tributary (UNT-2) will have a total of 83 linear feet of permanent impact due to the channel relocation. Also, 0.017 acre of wetlands will be permanently disturbed for the construction of the new bridge. Mitigation will not be required for this wetland impact since the impact is considered de minimus.

Mitigation will include restoring the disturbed area back to its original condition and stabilizing the disturbed area. The project includes mitigation for impacts by creating a minimum of 0.40 acre of new wetland on the southern portion of the site and by planting trees and shrubs in the wetland along a tributary to Slippery Rock Creek in the northern portion of the site.

In accordance with 25 Pa. Code §§ 129.96—129.100, the Department of Environmental Protection (Department) has made a preliminary determination to approve a RACT II plan and an amendment to the State Implementation Plan (SIP) for their Expanded Polystyrene (EPS) & Polyurethane foam manufacturing processes at the facility located in Upper Macungie Township, Lehigh County.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.
The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (39-00040) for the facility. The relevant RACT II requirements will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal.
The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:

2. All clean up solvent operations must comply with Best Available Technology to minimize VOC emissions. All cleaning operations must store new and used cleaning solvents in closed containers; and
3. The company shall use only a non-traditional blowing agent (for example, carbon dioxide) in the process. Request for comments on the Total Maximum Daily Load Developed for Halfmoon Creek, Centre County, PA The Department of Environmental Protection (Department) will accept comments as of May 26, 2018, for the proposed Total Maximum Daily Load (TMDL) developed to address aquatic life use impairments in Halfmoon Creek, as noted in 2016 Pennsylvania Integrated Water Quality Monitoring and Assessment Report (Integrated List), initially listed in 1998. Halfmoon Creek is a tributary of Spruce Creek and the greater Little Juniata River basin, Centre County. The watershed lies near Halfmoon and Ferguson Townships, Centre County. Biological impairments were originally noted during bioassessments in the watershed (NCRO, 2007). The source of degradation is related to agricultural activities, which effect the High Quality (HQ) attributes of Halfmoon Creek, most significantly in benthic inundation. The Commonwealth does not currently have water quality criteria for excess siltation, so a sediment TMDL endpoint was identified using a reference watershed approach. Based on a comparison to a similar watershed in land use, yet biologically nonimpaired HQ watershed, the maximum sediment loading should still allow water quality objectives to be met. Adjacent to the east, Beaver Branch, chosen for comparison and is also a tributary of Spruce Creek and the greater Little Juniata River, Centre County.
This proposed TMDL sets allowable sediment loadings within the specifically impaired stream segments of the Halfmoon Creek watershed. The loading was allocated among the land uses of cropland, hay/pasture land, and associated stream banks present in the watershed. The impairments were documented during biological surveys of the aquatic life present in the watershed (1999 and 2004). Excessive siltation and nutrient loading from agriculture has been identified as the cause of these impairments to the Coldwater Fishery (CWF) aquatic life uses in Markee Creek. Because this Commonwealth does not currently have water quality criteria for excess siltation or nutrients, a TMDL endpoint for sediment and total phosphorus (nutrients) was identified using a reference watershed approach. Based on a comparison of a similar, unimpaired CWF, McKinley Run (tributary to Tuscarora Creek), the maximum sediment loading that should still allow water quality objectives to be met in the impaired segments of Markee Creek.

Poplar Run is a Coldwater Fishery (CWF) and a tributary of Indian Creek, the Youghiogheny River, and the greater Monongahela River Basin, Fayette County. The impairments were documented during biological surveys of the aquatic life present in the watershed (1998 and 2002). Excessive siltation has been identified as the cause of benthic habitat impairment. This nonpoint source pollution was described in the 1998 bioassessment as influenced by land developed namely, but this TMDL will address loading from other land uses such as agricultural activities within the watershed.
Because this Commonwealth does not currently have water quality criteria for excessive siltation, a TMDL endpoint for sediment loading was identified using a reference watershed approach. The watershed lies north of the town of Rural Valley, within Cowanshannock and Wayne Townships (USGS quadrangle—Rural Valley), mid-eastern Armstrong County.

Data used in these TMDLs was generated using a watershed analysis model (Mapshed-E-GWLF) designed by the Penn State University. Load allocations were distributed to nonpoint sources, specifically all land use sources other than National Pollutant Discharge Elimination System (NPDES) permitted point source discharges with 10% of the TMDL reserved explicitly as a margin of safety (MOS). A search of the Department's online, GIS database, EMAP, identified no known point source discharges within the Poplar Run. Despite this, an additional allocation of 1% of the TMDL was incorporated into the WLA as a bulk reserve to take in account the dynamic nature of future permit activity. Loads not reduced (LNR) are the portion of the LA associated with nonpoint sources other than agricultural (croplands, hay/pasture), and associated stream banks. It is equal to the sum of modeled loading on forested land use, wetlands, and low development. The adjusted load allocation (ALA) represents the remaining portion of the LA distributed among agricultural land and associated stream banks. The TMDL developed for the impaired SBSF Pine Creek established a reduction in the overall, sediment loading to 59.3% and a 29.4% reduction in the total phosphorus loading (or the equal % reduction, for example, the ALA divided by the summation of the baselines). The data and all supporting documentation used to develop the proposed TMDLs are available from the Department.
