AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.

 Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate Department Regional Office.

 Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

46-0027F: Janssen Research & Development, LLC (1400 McKean Road, Springhouse, PA 19477) for the installation of a replacement burner, as follows, for existing Bryan boiler 1 (Source ID 035) at its existing pharmaceutical research and development facility located in Lower Gwynedd Township, Montgomery County:

 • Manufacturer: Preferred Utilities Mfg. Corp.

 • Model No.: API-350-GOX.

 • Rated heat input: 15 MMBtu/hr.

 • Fuels consumed: Natural gas (primary), No. 2 fuel oil (auxiliary).

 • Emission control techniques: Low-NOx (nitrogen oxides) burner designed for flue gas recirculation (FGR).

 The replacement burner is identical to those installed under Plan Approval No. 46-0027D for Bryan boilers 2—3 (Source IDs 036—037), such that all three Bryan boilers will once again be identical units.

 This notice is a revision to the notice published on April 21, 2018. The NOx and carbon monoxide (CO) emission concentration restrictions in the Plan Approval will be revised to reflect those currently indicated for Bryan boilers 2—3 in Title V Operating Permit No. 46-00027, as follows:

 • NOx: 30 ppmv, dry basis, corrected to 3% oxygen (O2), when consuming natural gas.

 • NOx: 90 ppmv, dry basis, corrected to 3% O2, when consuming No. 2 fuel oil.

 • CO: 300 ppmv, dry basis, corrected to 3% O2, when consuming natural gas or No. 2 fuel oil.

 Compliance with these emission concentration restrictions, which satisfy best available technology (BAT) requirements, has been previously demonstrated via portable analyzer testing in 2016 on Bryan boiler 3.

 The boiler remains subject to the provisions of 40 CFR Part 60, Subpart Dc, for small industrial, commercial, and institutional steam generating units, and Part 63, Subpart JJJJJJ, for industrial, commercial, and institutional boilers area sources, as indicated in the current Title V Operating Permit (TVOP, No. 46-00027) for the facility. No changes to the terms and conditions of the TVOP result from the project.

 The project is not subject to non-attainment New Source Review (NNSR) requirements.

 The Plan Approval will include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

36-03052C: Boose Aluminum Foundry Co., Inc. (PO Box 261, Reamstown, PA 17567) for the installation of a 2,205 lb/hr StrikoWestofen America MHII-N (T) 2000/2001 natural gas fired aluminum stack melting furnace in East Cocalico Township, Lancaster County. The total heat input capacity of the unit is 2.816 MMBtu/hr ((2) melting burners—1.0242 MMBtu/hr, ea/holding burner—0.76815 MMBtu/hr). Once the new melting furnace is installed and operational, two (2) existing natural gas furnaces (22-01-07 & 22-01-08) will be removed. Potential emissions from the new furnace are estimated to be 1.02 tpy CO, 1.21 tpy NOx, 8.69 tpy PM10/PM2.5, 0.01 tpy SOx, and 0.07 tpy VOC. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval will be incorporated into an operating permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.

38-03064A: Rothermel-Finkenbinder Funeral Home & Crematory, Inc. (25 West Pine Street, Palmyra, PA 17078) for the installation of a human crematory at the funeral home located in Palmyra Borough, Lebanon County. The expected increases in facility emissions as a result of the changes proposed are: 2.4 tpy of PM, 1.9 tpy of NOx, 4.1 tpy of CO, 0.8 tpy of SOx and 1.1 tpy of VOCs. The facility is a State Only facility. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval will be incorporated into an Operating Permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.

PA-03-00151B: Rosebud Mining Company (301 Market Street, Kittanning, PA 16201) In accordance with 25 Pa. Code §§ 127.44—127.46, the Pennsylvania Department of Environmental Protection (DEP) is providing notice that it intends to issue an Air Quality Plan Approval (PA-03-00151B) for the construction and operation of a Truck Tire Wash Station, Throughput increase in ROM coal to 3.125 million tpy and clean metallurgical grade coal to 2.5 million tpy at their existing Dutch Run Coal Preparation located in Plumcreek Township, Armstrong County.

 The proposed and existing sources at the existing facility include a rotary breaker, triple roll crusher, radial stacker, vibratory feeder, static thickener, double deck screen, storage piles, various conveyors, truck loadout, front-end loader, a truck tire wash station, and an emergency diesel generator. Roadways shall be controlled by paving and water sprays. Fugitive emissions from the process are controlled by water sprays.

 Upon authorization of this plan approval the facility potential to emit will not exceed 25.0 tons of PM10, 2.0 tons of NOx, 1.0 ton of CO, and 27.0 tons of VOC on an annual basis. The throughput restriction, monitoring, testing, recordkeeping, reporting and work practice conditions of the Plan Approval have been derived from the applicable requirements of 40 CFR Part 60 Subpart Y, 40 CFR Part 63 Subpart ZZZZ, and 25 Pa. Code Chapters 123 and 127.

 The Dutch Run Facility's Plan Approval application, the Department's Air Quality Review Memorandum, and the Proposed Air Quality Plan Approval for this project are available for review by any interested party at the Pennsylvania Department of Environmental Protection, Southwest Regional Office, 400 Waterfront Drive, Pittsburgh, PA 15222.  Any person may submit comments, requests for the Department to hold a public hearing, or protests to the plan approval or a proposed condition thereof, by filing such submissions in writing to the Department at the Southwest Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments.

 All comments, requests for a public hearing, and protests to a proposed action, shall be filed with the Department within 30 days of the date that notice of the proposed action was published under 25 Pa. Code § 127.424 (relating to public notice). Comments, requests for a public hearing, and protests must include the name, address and telephone number of the person filing the protest, identification of the proposed plan approval issuance being opposed (PA-03-00151B) and a concise statement of the objections to the permit issuance and the relevant facts upon which the objections are based.

 A public hearing may be held in accordance with 25 Pa. Code § 127.429, if the Department, in its discretion, decides that such a hearing is warranted based on the information received. If a public hearing is held, all persons who have properly filed a protest under 25 Pa. Code § 127.426 may appear and give testimony. The applicant, the protestant and other participants will be notified of the decision to hold a hearing (and the time, place and purpose of such hearing) by publication in the newspaper or by the Pennsylvania Bulletin, or by telephone, where the Department determines such notification by telephone is sufficient.

10-037H: Sonneborn, LLC (100 Sonneborn Lane, Petrolia, PA 10650), The Department intends to issue plan approval 10-037H to Sonneborn, LLC. This plan approval includes elective restrictions, corrections to the current Title V permit, and conditions relating to RACT II affected sources. No new sources or control equipment is authorized by this plan approval. Emissions will not increase as a result of this project. This is an existing Title V facility (10-00037) located at 100 Sonneborn Lane in Town of Petrolia and Fairfield Township, Butler County.

 This facility is a major stationary source of NOx and VOCs and was in existence before July 20, 2012. As such, in accordance with 25 Pa. Code § 129.96, this facility is subject to the Department's RACT II requirements under 25 Pa. Code §§ 129.97—129.100. The presumptive and exempt sources will be addressed during the modification of the facility operating permit.

 The Plan Approval will contain testing, recordkeeping, emission restriction, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

 The method by which Source 0110 (H-101 Reformer/Waste Heat Boiler) is operated will be modified; however, it will not result in an increase of it's' emission rate restrictions. Source 0110's burners will be tuned and operated with Low Excess Air (LEA). Stack testing of Source 0110 will be required within 180 days of the plan approval's issuance and must be retested a minimum of once each operating permit term. The capacity of Source 0110 will be corrected from 27.35 MMBtu/hr to 30.6 MMBtu/hr and it will be restricted to 2,000 hours of burner operation per year. Source 0110 will receive a burner tune-up at a minimum of once every 24 months when a plant shutdown event permits its' completion. A burner tune-up must occur at a minimum of once every 48 consecutive months. Estimated emissions from Source 0110: NOx: 14.64 lb/hr, 64.14 tpy, CO: 3.66 lb/hr, 16.04 tpy, VOC: 0.29 lb/hr, 1.28 tpy.

 Stack testing of Source 035 (Boiler 8) will be required within 180 days of the plan approval's issuance and must be retested a minimum of once each operating permit term. Source 035 shall only combust oil during periods of emergency operation or primary fuel curtailment. Each occurrence of operation while combusting oil shall be recorded in a log.

 Emissions from Source 115 (7 Alcohol (Methanol) Storage Tanks) shall not exceed 2.0 tpy of VOC.

 The capacity of Source 0117 (H-2 Stripper Process Heater) shall be corrected from 18.4 MMBtu/hr to 19.5 MMBtu/hr. Emissions estimates for Source 0117: 1.86 lb/hr or 8.13 tpy of NOx; 1.56 lb/hr or 6.83 tpy of CO; 0.10 lb/hr or 0.45 tpy of VOC. Source 0117 shall not combust more than 18.57 Mcf/hr or 162.7 MMcf in any 12 consecutive months. The permittee shall maintain monthly records of the hours of operation and the amount of natural gas consumed by this source.

 The capacity of Source 0116 (H-1 Process Feed Heater) shall be corrected from 21.5 MMBtu/hr to 33.27 MMBtu/hr. Estimated emissions from Source 0116: 1.58 lb/hr or 6.94 tpy of NOx; 2.66 lb/hr or 11.66 tpy of CO; 0.17 lb/hr or 0.76 tpy of VOC. Source 0116 shall not combust more than 31.7 Mcf/hr or 277.6 MMcf in any 12 consecutive months. This source shall receive a burner tune-up at a minimum of once every 24 months when a plant shutdown event permits its' completion. A burner tune-up shall occur at a minimum of once every 48 months.

 Source 032, Source 033, and Source 034 will be restricted to NOx emissions of 0.10 lb/MMBtu when combusting natural gas and 0.20 lb/MMBtu when combusting fuel oil. These emission restrictions are presumptive requirements from RACT II.

 Public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. In accordance with 25 Pa. Code § 127.44(e)(1), all the pertinent documents regarding this application (applications, review memos, and draft approvals) are also available for review from 8:00 a.m. to 4:00 p.m. at the Meadville Regional DEP office (Air Quality). Appointments for scheduling a review must be made by calling the DEP (814) 332-6340.

 In accordance with 25 Pa. Code § 127.44(e)(2), a 30-day comment period, from the date of publication, will exist for the submission of comments. Any person(s) wishing to provide DEP with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to Regional Air Quality Program Manager, Pennsylvania Department of Environmental Protection, 230 Chestnut Street, Meadville, PA 16335-3494 and must contain the name, address and telephone number of the person submitting the comments, identification of the proposed plan approval [10-037H: Sonneborn, LLC] and a concise statement regarding the relevancy of the information or objections to the issuance of the permit.

 A public hearing may be held, if the Department of Environmental Protection, in its discretion, decides that such a hearing is warranted based on the comments received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or the Pennsylvania Bulletin or by telephone, where DEP determines such notification is sufficient. AMS IP17-000291: Britton Industries, Inc, (8901 Torresdale Ave, Philadelphia, PA 19136) for installation of a diesel Portable Screener rated at 110 horse power (hp), a diesel Portable Screener rated at 151 hp, a diesel Portable concrete crusher rated at 350 hp, a diesel Portable Jaw (concrete) crusher rated at 275 hp, a Primary and secondary electric Tub Grinder with dust cover/lid each rated at 200 cubic yard/hr, a diesel Horizontal Grinding Mill (Wood crusher) rated at 1,200 hp, and the following electric units each rated at 200 cubic yard/hr: Under Conveyor, Radial Conveyor, Surge Hopper, Dye Drum Conveyor, Dye Drum, Secondary Mill Conveyor, Inline Conveyor, Radial Stacking Conveyor and Water Suppression System/Spray Bars and Temperature Monitor.

 From this project, there will be potential emissions increase of 6.4 tons per year (tpy) of Nitrogen oxides, 4.6 tpy of Carbon monoxides, and 9.8 tpy of particulate matter. The plan approval will contain emission limits, work practice standards, testing, monitoring, recordkeeping, and reporting requirements to ensure operation within all applicable requirements.

 Anyone affected by the proposed plan approval may submit written comments on the proposed plan approval or request a public hearing by mail to Air Management Services, 321 University Avenue, 2nd Floor, Philadelphia, PA 19104, Attn: Debra Williams within thirty (30) days from today. Comments received by facsimile will not be accepted.

OPERATING PERMITS


Intent to Issue Title V Operating Permits under the Air Pollution Control Act and 25 Pa. Code Chapter 127, Subchapter G.

Southeast Region: Air Quality Program, 2 East Main Street, Norristown, PA 19401.

23-00021: Congoleum Corp. (4401 Ridge Rd, Trainer, PA 19061) located in Trainer Borough, Delaware County for a renewal of their Title V operating permit. The most recent issued Title V operating permit was July 19, 2013. The facility's major emission points are boilers, rotogravure printing presses/coaters and a thermal oxidizer, which emit major levels of volatile organic compounds (VOCs) and nitrogen oxides (NOx). All new and updated regulatory changes have been addressed in this renewal. The renewed Title V operating permit will contain sufficient monitoring, recordkeeping, reporting and work practice standards to keep the facility operating within all applicable air quality requirements.

67-05012: Transcontinental Gas Pipe Line Co, LLC (Williams Gas Pipe Line Transco, PO Box 1396, Houston TX 77251) to issue a Title V Operating Permit renewal for Compressor Station 195 located in Peach Bottom Township, York County. The actual 2017 emissions from the facility were 5.74 tons of VOC, 2.04 tons of NOx, 1.93 ton of CO, and 0.16 ton of PM10. Pursuant to 25 Pa. Code §§ 129.96—129.100, this permit renewal includes sources subject to Presumptive RACT. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations. Among other items, the conditions include 40 CFR 63, Subpart DDDDD—National Emission Standards for Hazardous Air Pollutants for Major Sources: Industrial, Commercial and Institutional Boilers and Process Heaters.

Northcentral Region: Air Quality Program, 208 West Third Street, Williamsport, PA 17701.

Dominion Energy Transmission, Inc. (925 White Oakes Blvd, Bridgeport, WV 26330-6919) for significant modification of the Title V operating permit and to incorporate Reasonable Available Control Technology (RACT II) requirements of 25 Pa. Code §§ 129.96—129.100 for their Ellisburg Compressor Station located in Genesee Township, Potter County. The facility is currently operating under Title V Operating Permit 53-00006. The facility's sources include eight (8) natural gas-fired compressor engines, four (4) natural gas-fired line heaters, two (2) natural gas-fired salt bath heaters, one (1) natural gas-fired emergency generator engine, various small natural gas-fired combustion units and several storage tanks.

 The facility has annual emissions of 846.88 tons of carbon monoxide, 587.86 tons of nitrogen oxides, 0.65 ton of sulfur oxides, 8.99 tons of particulate matter including particulate matter less than 10 microns in size, 8.99 tons of particulate matter less than 2.5 microns in size, 159.70 tons of volatile organic compounds, 18.55 tons of hazardous air pollutants, and 127,477 tons of greenhouse gases. This action will incorporate the presumptive Reasonably Available Control Technology (RACT II) requirements specified in 25 Pa. Code §§ 129.96—129.100 in accordance with the significant operating permit modification requirements of 25 Pa. Code § 127.541. All pertinent documents used in the evaluation of the application are available for public review during normal business hours at the Department's Northcentral Regional office, 208 West Third Street, Suite 101, Williamsport, PA 17701. 18-00005: Dominion Transmission, Inc. (925 White Oakes Blvd, Bridgeport, WV 26330) to issue a Title V operating permit renewal for their Finnefrock Compressor Station located in Leidy Township, Clinton County. The facility is currently operating under Title operating permit 18-00005. The facility's sources include four (4) natural gas-fired compressor engines, one (1) natural gas-fired turbine engine, one (1) emergency generator, six (6) natural gas-fired boilers, one (1) parts washer and several storage tanks. The facility has potential emissions of 322.64 TPY of CO; 441.44 TPY of NOx; 24.75 TPY of PM/PM10; 107.42 TPY of VOC; 35.38 TPY of HAPs and 132,617 TPY of GHG. The emission limits and work practice standards along with testing, monitoring, record keeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. These operating permit conditions have been derived from the applicable requirements of 40 CFR Part 60 Subpart JJJJ, 40 CFR Part 60 Subpart KKKK, 40 CFR Part 63 Subpart DDDDD, 40 CFR part 63 Subpart ZZZZ, Title 25 Pa. Code Chapters 121—145. 55-00017 Durabuilt Home, LLC (1910 Old North Trail, Selinsgrove, PA 17870-0407) to issue a renewal of an Air Quality State Only operating permit for their facility located in Monroe Township, Snyder County. The facility is currently operating under State Only (Synthetic Minor) Operating Permit 55-00017. The facility's main source of air contaminants is a modular home manufacturing operation comprised of a framing operation, a plumbing operation, an interior finishing operation and an exterior finishing operation along with several small natural gas and propane fired heating units. The subject facility has the following potential emissions: 2.89 TPY of CO; 3.62 TPY of NOx; 0.18 TPY of SOx; 0.94 TPY of PM/PM10; <25.00 TPY of VOC; 5.14 TPY of VHAPs and 2,287 TPY of CO2e. 11-00524: JWF Industries/Environmental Tank and Container (163 Cramer Pike, Johnstown, PA 15906) Natural Minor Operating Permit is for a facility that paints tanks for the Marcellus Shale industry and is located in West Taylor Township, Cambria County. In accordance with 25 Pa. Code §§ 127.424 and 127.425, the Department of Environmental Protection (DEP) has received an application and is providing notice that it intends to issue an Air Quality Operating Permit for the previously-mentioned facility. Sources of emissions at the site consist of one shot-blast booth and one paint booth. Emission estimates were provided by the applicant based on the facility's projected throughput of material for its painting and surface coating operations. Emissions are projected to be 28.2 TPY VOC, <1 TPY of HAP, and minimal emissions for all other criteria pollutants (<1 TPY of CO, NOx, PM, and SOx). The air quality permit includes operation requirements, monitoring requirements, and recordkeeping requirements for the site.

10-00331: Butler Memorial Hospital (1 Hospital Way, Butler, PA 16001), the Department intends to issue the renewal of the State-Only Operating Permit of a healthcare institution located in the City of Butler, Butler County that operates six (6) gas-fired boilers and six (6) diesel-fueled emergency generators. With PTEs of 45.9, 20.6, 4.24, 1.52, and 1.49 TPY for NOx, CO, VOC, SO2, and PM10, respectively, the healthcare institution is a Natural Minor facility for permitting purposes. Permitted to run on fuel oil during gas supply interruptions, the boilers are subject to 25 Pa. Code § 123.22 (Sulfur Compound Emissions, Combustion Units). Under 40 CFR Part 63, Subpart ZZZZ (NESHAP for Stationary Reciprocating Internal Combustion Engines), two emergency generators are considered new engines and must comply with 40 CFR Part 60, Subpart IIII (Standards of Performance for Stationary Compression Ignition Internal Combustion Engines) while the other four are considered existing engines and are exempt from 40 CFR Part 63, Subpart ZZZZ. In this renewal, only minor changes are made in permit requirements. Reporting requirement under 25 Pa. Code § 123.22(g) is added for the boilers. Provisions of 40 CFR Part 60, Subpart IIII determined not applicable are removed from the permit. Based on EPA guidance, 40 CFR 63.6640(f) is added as an operating hours restriction to ensure that the affected engines can maintain their status as institutional emergency stationary RICE and be exempt from other requirements of the said subpart.

COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.

 Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

The project is located south of Blue Rock Road near the intersection of Ironstone Ridge Road and Blue Rock Road (40.004908, -76.375147). No wetlands will be impacted by this project.

E67-941: Shawn O'Reilly, 1805 Long Level Road, Wrightsville, PA 17368, Shawn O'Reilly Deck, Lower Windsor Township, York County, U.S. Army Corps of Engineers Baltimore District.

 To replace an existing 200-square foot wooden deck with a 1,100-square foot wooden deck at a residential building. Approximately 646 square feet (17` × 38`) of the proposed deck is in the Susquehanna River's (WWF, MF) floodway. The project is located on Long Level Road (Safe Harbor, PA Quadrangle, Latitude: 39.971723 Longitude: -76.492486) in Lower Windsor Township, York County. The project does not affect wetlands.

E67-942: Southern York County School District (Owner: Linda and Luther Jones), 3280 Fissels Church Road, P.O. Box 128, Glen Rock, PA 17327, Luther & Linda Jones Property (Bartko Acres), Shrewsbury Township, York County, U.S. Army Corps of Engineers Baltimore District.

 1) To install two 75-foot 36-inch culverts to carry an unnamed tributary to Centerville Creek (CWF, MF) beneath a private driveway,

 2) To remove a failing culvert upstream of the driveway culvert and convert 200 feet of the channel into a natural open channel,

 3) To remove approximately 650 cubic yards of sediment from the existing pond,

 4) To create a 400-foot bypass channel around the existing pond impacting approximately 1,843 square feet of wetland,

 5) To install a 60-foot by30-inch culvert to carry the unnamed tributary beneath the driveway to the existing pond, and

 6) To install two 30-inch culverts beneath the private driveway impacting approximately 46 square feet of wetland.

 The project is located on Fissels Church Road (Glen Rock, PA Quadrangle, Latitude: 39.767740 Longitude: -76.742509) in Shrewsbury Township, York County. The project impacts approximately 8,720 square feet of wetlands and 453 linear feet of streams.

E06-723: PennDOT Engineering District 5-0, 1002 Hamilton Street, Allentown, PA 18101, in Oley and Ruscombmanor Townships, Berks County, U.S. Army Corps of Engineers Philadelphia District.

 To 1) temporarily place 1,507 square feet of temporary fill within the floodway of Little Mantawny Creek (CWF, MF) (40.398320, -75.808270),

 2) remove the existing 6-foot by 10-foot concrete slab bridge and restore and stabilize the stream resulting in 136 linear feet of direct temporary stream impacts to an Unnamed Tributary to Little Manatawny Creek (CWF, MF) (40.399170, -75.807980),
