LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Former Bechtel's Dairy & Restaurant Property, 520 North Derr Drive, Lewisburg Borough, Union County. Converse Consultants, 2738 West College Avenue, State College, PA 16801, on behalf of WRT Realty Company, 5071 Lycoming Mall Drive, Montoursville, PA 17754, has submitted a Remedial Investigation Report and Final Report concerning site soil and groundwater contaminated with unleaded gasoline. Future use of the site is expected to be non-residential. The report is intended to document remediation of the site to meet the Site-Specific Standard.

Leonard's Express Diesel Fuel Release, Interstate 80 at MM 213E, Turbot Township, Northumberland County. Northridge Group, Inc., P.O. Box 231, Northum-berland, PA 17857, on behalf of Leonard's Express, 6070 Collett Road WE, Farmington, NY 14425, has submitted a Final Report concerning remediation of site soil contaminated with diesel fuel. The report is intended to document remediation of the site to meet the Statewide Health Standard.

Eclipse Painter Well Pad, 424 Broughton Road, Westfield Township, Tioga County. Penn Environmental & Remediation, Inc., on behalf of Eclipse Resources—PA, LP, 2121 Old Gatesburg Road, State College, PA 16803, has submitted a Final Report/Remedial Action Completion Report concerning site soil contaminated with brine fluid and petroleum hydrocarbons. The report is intended to document remediation of the site to meet the Statewide Health Standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Mobile Environmental Analytical Inc., 1365 Ackermanville Road, Bangor, PA 18013, on behalf of EarthEfficient, 862 Greenview Drive, Stroudsburg, PA 18360, submitted a Final Report concerning remediation of site soils from release of diesel fuel. The report documented remediation of the site to meet Statewide Health Standards and was approved by the Department on June 26, 2018.

24-009H: Domtar Paper Company, LLC (100 Center Street, Johnsonburg, PA 15845) on June 27, 2018, effective June 30, 2018, has issued a plan approval extension for the conversion of two (2) existing 297 MMBtu/hr capacity coal-fired boilers (with natural gas and # 2 fuel oil backup) to natural gas-fired boilers (with # 2 fuel oil backup) in Johnsonburg Borough, Elk County. This will expire on December 31, 2018. This is a Title V facility.

 1) To construct and maintain a 159-foot two-span, single pier, pre-stressed concrete bulb-T beam bridge over East Branch Brandywine Creek (Channel 1) resulting in 285 feet (9,375 square feet) of permanent impact. This activity includes the placement of scour protection for pier and abutments.

 2) To remove existing bridge and abutments to facilitate positive stormwater drainage to East Branch Brandywine Creek (Channel 1) resulting in 1,935 square feet of permanent impact. This work also includes the construction of a drainage swale and the permanent placement of rock apron upstream of the removed left abutment.

 3) To construct two (2) temporary causeways to facilitate the removal of the existing pier and construction of the new pier at the new bridge location.

 4) To construct two (2) drainage swales with rock aprons in association with the realignment of left and right roadway approaches upstream of proposed bridge over East Branch Brandywine Creek (Channel 1) (WWF/MF) resulting in 687 square feet of permanent impact.

 5) To relocate an unnamed tributary to East Branch Brandywine Creek (Channel 3) (WWF/MF) and place fill within wetland (Wetland B) (PEM/PSS) in association with the realignment of right roadway approach resulting in 472 linear feet (3,867 square feet) of permanent stream impact and 511 square feet (0.012 acre) of permanent wetland impact.

 6) To permanently place a rock apron at the outfall of an existing 18-inch RCP culvert and grade channel (Channel 3A) to facilitate positive stormwater drainage to relocated unnamed tributary to East Branch Brandywine Creek (Channel 3).

 7) To extend a 42-inch RCP culvert and place fill within an unnamed tributary to East Branch Brandywine Creek (Channel 2) (WWF/MF) and wetland (Wetland C) (PEM/PSS) associated with the realignment of left roadway approach resulting in 71 feet (497 square feet) of permanent stream impact and 8,795 square feet (0.202 acre) of permanent wetland impact.

 8) To permanently place fill, grade, construct a rock-lined channel and install compacted impervious material within the 100-year floodway of the East Branch Brandywine Creek (Channel 1) (WWF/MF) to facilitate the construction of a wetland mitigation site resulting in 441 linear feet (13,509 square feet) of permanent stream impact.

 The project will have a total permanent watercourse impact of 719 linear feet (12,072 square feet) with 403 linear feet (21,104 square feet) of temporary watercourse impact. A total permanent floodway impact of 38,266 square feet (0.878 acre) with 87,578 square feet (2.011 acres) of temporary floodway impact is proposed. A total permanent wetland impact of 9,306 square feet (0.214 acre) with 4,548 square feet (0.104 acre) of temporary wetland impact is proposed.

 The applicant is proposing to create 0.263 acre of wetland and restore 420 linear feet of watercourse. Project limits extend from S.R. 322 intersection with Sugars Bridge Road east to the S.R. 322 intersection with Skelp Level Road in West Bradford and East Bradford Townships, Chester County (USGS PA Unionville Quadrangle—Latitude: 39.968438 N, Longitude: 75.672495 W).

 The permanent impacts to the wetlands are due to the placement of fill of 0.42 acre of the wetland to allow for a circular culvert installation and stone aprons at the inlet and outlet of the culvert.

 The permanent impacts to the stream are due to the enclosure of 82 lineal feet of the channel within a box culvert. Request for Comments on the Total Maximum Daily Load (TMDL) Developed for
Montour Creek, Perry County

 The Department of Environmental Protection (Department) will accept comments as of July 14, 2018, for the proposed Total Maximum Daily Load (TMDL) developed to address aquatic life use impairments in Montour Creek as noted in 2016 Pennsylvania Integrated Water Quality Monitoring and Assessment Report, as initially listed in 1999. Montour Creek is a tributary of Shermans Creek and the greater Susquehanna River basin. The watershed lies near the town of Loysville (and Northwest of Landisville), in Tyrone and Spring Townships, Perry County. Biological impairments were originally noted during bioassessments in the watershed (SCRO, 1999). The source of degradation is related to agricultural activities, including grazing, which effect the Coldwater Fishery (CWF) attributes of Montour Creek. This Commonwealth does not currently have water quality criteria for sediment; therefore, a sediment TMDL endpoint was identified using a reference watershed approach. Based on a comparison to a similar watershed in land use, yet biologically nonimpaired, the maximum sediment loading should still allow water quality objectives to be met. Bixler Run, another CWF, was chosen for comparison and is also a tributary of Shermans Creek, Southwest and Northwest Madison Townships, Perry County.

 This proposed TMDL sets allowable sediment loadings within the specifically impaired stream segments of the Montour Creek watershed. The loading was allocated among the land uses of cropland, hay/pasture land and associated stream banks present in the watershed. Data used in these TMDLs was generated using a watershed analysis model (MAPSHED) designed by the Penn State University. The following table shows the estimated current loadings for the watershed and the proposed overall load reductions that are necessary to reach an attaining CWF.

 Load allocations were distributed to nonpoint sources, specifically all land use sources other than National Pollutant Discharge Elimination System permitted point source discharges with 10% of the TMDL reserved explicitly as a MOS. A search of the Department's online, GIS database, EMAP, identified two, point source discharges within the Montour Creek watershed. 1% of the TMDL was incorporated into the WLA as a bulk reserve to take in account future permit activity. The LNR are the portion of the LA associated with nonpoint sources other than agricultural (croplands, hay/pasture), and associated stream banks. It is equal to the sum of modeled loading on forested land use, wetlands, open space, and development. The ALA represents the remaining portion of the LA distributed among agricultural land and associated stream banks. The TMDL developed for the impaired stream segments within the Montour Creek watershed to establish a reduction in the overall, sediment loading to 25.5%. (or the equal percent reduction, that is, the ALA divided by the summation of the baselines).
