FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

To construct and maintain the following water obstruction and encroachments within the floodway of Jordan Creek (TSF, MF) associated with the Jordan Creek Greenway Trail Project:
1. Fill in various locations within the floodway of Jordan Creek (TSF, MF) for the construction of approximately 9,800 foot segment (Segments 46-51) of the pedestrian trail;
2. Six outfall structures to Jordan Creek (TSF, MF). The stormwater outfalls each consist of an 18-inch HDPE pipe with a concrete headwall and riprap apron.
3. A pedestrian boardwalk crossing through a de minimus amount of PEM wetlands equal to approximately 0.02 acre of wetlands.
The project is located along the north side of Jordan Creek (Allentown West and Cementon, PA Quadrangle Latitude: 40.6278 N; Longitude: -75.5704 W) in South Whitehall Township, Lehigh County.
E54-370. Schuylkill County Conservation District, 1206 Ag Drive, Pottsville, PA 17901, in Tremont Township, Schuylkill County, U.S. Army Corps of Engineers, Baltimore District.
To authorize the following water obstruction and encroachments associated with the Lorberry AMD System Project:
1. To construct and maintain a 120-foot relocated section of Lorberry Creek (CWF, MF) consisting of a 6-foot bottom. The proposed stream channel dimensions consist of a 6-foot bottom, 2-foot depth, 3:1 side slopes and lined with R-5 riprap.
2. The abandonment of approximately 270 feet of Lorberry Creek (CWF, MF) as part of a stream relocation due to the construction of an aeriation detention pond.
3. To construct and maintain an aeriation pond that is approximately 43,750 square feet, of which 24,066 square feet will be constructed within the floodway of Lorberry Creek (CWF, MF).
4. To rehabilitate and maintain a 24-foot by 23-foot intake structure to accept the Rowe Tunnel discharge.
5. To construct and maintain a 103-foot long 12-inch SDR-35 pipeline. The proposed pipeline will have 73 feet within the floodway of Lorberry Creek, and a 30-foot crossing of the relocated section of Lorberry Creek.
6. To construct and maintain an 18-foot by 10-foot outfall to Lorberry Creek from the aeriation pond.
7. To construct and maintain a 720-foot long 12-inch SDR-35 pipeline. The proposed pipeline will have 700 feet within the floodway of Lorberry Creek and a 20-foot crossing of Lorberry Creek.
8. To construct and maintain 2,808 square feet of treatment cells within the floodway of Lorberry Creek.
9. To construct and maintain an 18-foot by 10-foot outfall from the treatment cells to Lorberry Creek.
10. Removal of an existing pipeline consisting of 963 square feet of impact to the floodway of Lorberry Creek.
11. To modify and maintain an existing access roadway having a de minimus impact to PEM wetlands equal to approximately 0.01.
The project is located at the intersection of Loves Road and Molleystown Road (Pine Grove, PA Quadrangle Latitude: 40°35`36.989"; Longitude: -76°26`24.11") in Tremont Township, Schuylkill County.

The applicant proposes to remove the existing structure and construct and maintain a three-span composite pre-stressed concrete spread box beam bridge structure with a span of 260 feet, an out-to-out width of 37.9 feet, and an average underclearance of 11.8 feet carrying Sample Bridge Road over Conodoguinet Creek (WWF) in Silver Spring Township, Cumberland County (Latitude: 40.255130, Longitude: -77.018468). The applicant also proposes Erosion and Sediment control measures including cofferdams and causeways. The purpose of the project is to replace a structurally deficient structure and to improve roadway geometry. No wetland impacts are proposed.

EROSION AND SEDIMENT CONTROL PERMITS The following parties have applied for Erosion and Sediment Control Permits for earth disturbance activities associated with either road maintenance or timber harvesting operations.
Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.
A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department regional office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department regional office during the 30-day public comment period.
Following the 30-day comment period, the appropriate regional office water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board (Board).
The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the appropriate regional office.

THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
