Stream Redesignation Evaluation of Cranberry Creek; Water Quality Standards Review

[Saturday, September 22, 2018]Under 25 Pa. Code § 93.4d (relating to processing of petitions, evaluations and assessments to change a designated use) the Department of Environmental Protection (Department) gives notice that an evaluation will be conducted on the stream section listed to determine the proper aquatic life use designation in this Commonwealth's Water Quality Standards.
Stream Name County Tributary To Cranberry Creek Monroe Paradise Creek The Department received comment that the notice to assess for Paradise Creek, the receiving stream of Cranberry Creek, at 44 Pa.B. 6149 (September 27, 2014), did not specifically identify Cranberry Creek. The Department intends to clarify and provide additional opportunity for submission of data relating to Cranberry Creek.
The Cranberry Creek assessment is being conducted in response to a rulemaking petition submitted to the Environmental Quality Board (Board) by the Brodhead Watershed Association. On April 16, 2013, the Board accepted the rulemaking petition for study under 25 Pa. Code Chapter 23 (relating to Environmental Quality Board policy for processing petitions—statement of policy). The Cranberry Creek basin is currently designated High Quality—Cold Water Fishes, Migratory Fishes (HQ-CWF, MF), as identified in 25 Pa. Code § 93.9c (relating to Drainage List C). The petitioner is requesting the basin be redesignated to Exceptional Value, Migratory Fishes (EV, MF).
Persons who have technical data concerning the water quality, instream habitat or biological condition of these stream sections are encouraged to make it available to the Department for consideration in the assessments. These assessments may lead to a recommendation to the Board for redesignation.
