FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To remove existing structure and to (1) install and maintain a 18 foot × 9.5 foot box culvert with 1-foot uniform depression with scour protection in East Branch Hammer Creek, (CWF, MF) with R-8 riprap scour protection, (2) install 2 outfalls with diameters of 36 inches and 24 inches and, (3) relocated a swale for the purpose of improving roadway safety along SR 2009 in Heidelberg Township, Lebanon County (40.2963; -76.2939).

 To remove approximately 0.13 of an acre of palustrine emergent wetland (PEM) to expand the existing parking area by 2.6 acres. The project is located south of Industrial Drive in Fairview Township, York County (Steelton, PA Quadrangle, Latitude: 40.1662; Longitude: -76.839581). Mitigation is required at a 1:1 ratio. No streams or floodways will be disturbed by this project.

 To remove the dilapidated bridge and to construct and maintain a Conspan bridge across Stony Creek (WWF-MF) having an approximate waterway opening of 90 feet by 6.0 high and measuring approximately 28-feet in length associated with the Township's Bridge Replacement Project. The lower chord of the bridge is above the 100-year floodway elevation.

 The site is located at S. Swarthmore Avenue over Stony Creek (Bridgeport, PA USGS Quadrangle, Latitude: 39.873789; Longitude: -75.317719).

E23-542. Merion Golf Club, 450 Ardmore Avenue, Ardmore, PA 19003, Haverford Township, Delaware County, ACOE Philadelphia District.

 To install, rehabilitate and maintain new and existing water obstructions and encroachments at the Merion Golf Club. The proposed work consists of the installation of new irrigation lines crossing UNT Cobbs Creek at hole Nos. 2, 4, 5, 8, 11; to replace the existing bridge at hole No. 4; to replace the existing pump house at hole No. 9 and to rehabilitate the existing stream retaining wall at holes 11 and 13.

 The site is located at 450 Ardmore Avenue, near the intersection of Ardmore and Hollands Avenues (Lansdowne/ Norristown PA USGS map; Lat: 39.9980; Long -75.3116).

 To perform the following activities associated with the proposed streambank restoration in and along Indian Creek at the Jeffersonville Golf Course. Work will include 1100 Linear feet of streambank stabilization, floodplain enhancement, bioretention feature installation, and the placement of J hooks, cross vanes, and channel realignment to replicate natural meandering flow patterns to accommodate additional storm water volume.

 The site is located at 2400 W. Main Street near the intersection Trooper Road and Main Street (Collegeville, PA USGS map; Latitude: 40.1359; Longitude: -75.389247).

 To perform the below listed water obstruction and encroachment activities associated with the Catawissa Nature Preserve. Includes the restoration of Catawissa Creek at the Catawissa Nature Preserve. The proposed project will have 455 linear feet of permanent waterway impact.

 The site is approximately at the intersection 215 West Maple Ave and across from 203 West Watson Ave, along the Catawissa Creek along a trail that goes from W Maple Ave to W Watson Ave. The head of the stream is from the stormwater pile off of W. Maple Ave. (Langhorne Latitude 40° 40` 38"; Longitude 74° 55` 26").

 To construct and maintain a stream and floodplain restoration project in a 2,766-foot reach of Mehoopany Creek (CWF) with work consisting of installation boulder bank revetments, installation of boulder bank grade reinforcements, and the installation of five (5) truncated rock vanes. Furthermore, the restoration of the floodplain is proposed resulting in grading along the floodway of Mehoopany Creek that also extends into three Unnamed Tributaries to Mehoopany Creek. The project is near an area locally known as Rogers Hollow and begins approximately 4,000 feet downstream of SR 87 Bridge over Mehoopany Creek (Jenningsville and Meshoppen, PA Quadrangle, Latitude: 41°32,17`5"; Longitude: -76°06` 38.4").

 The project begins near the intersection of SR 61 and Route 183 (Pottsville, PA Quadrangle Lat: 40° 38` 15.1"; Long: -76° 10` 56.3") and ends approximately 0.23 miles south near the intersection of the West Branch Schuylkill River and railroad crossing (Pottsville, PA Quadrangle Lat: 40° 38` 3.3"; Long: -76° 10` 53.9").

 The project proposes a cumulative permanent impact of 0.838 acre of PEM wetlands, 700 linear feet of watercourse, and 0.96 acre of floodway. Proposed temporary cumulative impacts, for which minimization and restoration shall be implemented, are 0.075 acre of wetlands, 172 linear feet of watercourse, and 0.60 acre of floodway. The applicant has offered compensatory mitigation for permanent impacts to Regulated Waters of this Commonwealth incurred with project construction. The design objectives of the compensatory mitigation are water quality improvement and wetland creation through the construction, operation and maintenance of a new abandoned mine drainage abatement system. The passive system will capture and treat acid mine drainage from a tributary of Camp Hope Run (UNT CHR-04), and the effluent from the system will be used to create 2.2 acres of new wetlands along Camp Hope Run. The Camp Hope Run Landfill and ancillary water pollution control facilities are located along the western right-of-way of SR 0153 approximately 2.1 miles north of the SR 2012/0153 intersection. *Listed impacts for SB-2 and SB-4 (POW wetlands) are waived of compensatory mitigation requirements under 25 Pa. Code § 105.12(a)(6).

 The applicant is proposing to:

 1. Remove an existing 227` long, 10` wide dock along the left bank of Allegheny River (WWF);

 2. Construct and maintain a replacement, 313` long, 10` wide dock along the left bank of Allegheny River;

 For the purpose of ensuring that the dock does not flood during higher river flows and greater pool elevation changes. This project is located approximately 1,300 feet north of the intersection of 30th Street Bridge and Waterfront Drive (Pittsburgh East, PA USGS Topographic Quadrangle; Latitude: 40° 28` 2"; Longitude: -79° 58` 36"; USACE: Pittsburgh District; Sub-basin 18A), in City of Pittsburgh, Allegheny County.

E02-1780, Beamsley Land Management, LLC, 1000 Infinity Drive, Suite 309, Export, PA 15632, City of Monroeville, Allegheny County, ACOE Pittsburgh District.

 The applicant proposes to:

 Construct and maintain a 116` long 60" HDPE stream enclosure culvert conveying an unnamed tributary to Abers Creek (TSF) with a drainage area less than 100 acres. Two additional 24" HDPE stream enclosure culverts will be offset to convey flood flows. Permanent impacts to the floodway associated with the construction of the stream enclosure will total 0.05-acre. These encroachments are associated with the construction of the Infinity Drive residential development on an approximate 30.5-acre site in the City of Monroeville, Allegheny County. The project is located at the intersection of Old Abers Creek Road and Infinity Drive. (Murrysville Quadrangle, Latitude: 40°26`31.6", Longitude: -79°42`54.8"; Sub-Basin: 19A; Pittsburgh Corps District).

E02-1781, Elizabeth Borough Municipal Authority, 1 Locust Street, Elizabeth Borough, Elizabeth, PA 15037, Allegheny County, ACOE Pittsburgh District.

 The applicant is proposing to:

 Construct and maintain a new pump station and associated infrastructure, including the relocation of the existing interceptor, CSO 3, Fall Timber lines, replacement of an existing 8-inch transit forcemain, a new 6-inch effluent reuse line, and a 30-inch wet weather forcemain, for The Elizabeth Borough Municipal Authority. This project will permanently impact 5 linear feet of stream. The project is located near Church Street and River Alley, in the FEMA floodplain of the Monongahela River (WWF) and the floodway of Fallen Timer Run (WWF) (Glassport, PA USGS topographic quadrangle; Latitude: 40°16`37"; Longitude: -79°52`56"; Sub-basin 19C; ACOE: Pittsburgh District), in Elizabeth Borough, Allegheny County.

E03-472, Plenary Walsh Keystone Partners, 2000 Cliff Mine Road, Park West Two, 3rd Floor, Pittsburgh, PA 15275, Rural Valley Borough, Armstrong County, ACOE Pittsburgh District.

 The applicant is proposing to:

 1. Remove an existing 133` long by 31`-9" wide, three span, steel I-beam bridge over Cowanshannock Creek (WWF);

 2. Construct and maintain a replacement, 140` long by 35`-9" prestressed concrete, spread box beam bridge;

 3. Construct and maintain rock slope protection in the floodway on the upstream and downstream side of the aforementioned structure and associated improvements to the guiderails and approach roads;

 4. Relocate 116 linear feet of an existing unnamed tributary to Cowanshannock Creek (WWF), and to construct and maintain new relocated channel;

 5. Relocate 61 linear feet of Cowanshannock Creek (WWF), and to construct and maintain new relocated channel;

 6. Permanently place and maintain fill in 0.044 acre of PEM Wetland (Wetlands 1, 2 & 4);

 7. Permanently place and maintain fill in 0.008 acre of PSS Wetland (Wetlands 3);

 8. Temporarily impact 0.284 acre of PEM Wetlands during construction. (Wetlands 1, 2 & 4);

 9. Temporarily impact 0.010 acre of PSS Wetlands during construction. (Wetland 3);

 For the purpose of replacing the existing structurally deficient structure over Cowanshannock Creek (WWF). The project is located at State Route 2001, Segment P50, 0.1 mile from the intersection between State Route 2001 and State Route 0050, in Rural Valley Borough, Armstrong County (Rural Valley USGS Topographic Quadrangle, Latitude: 40°29`46.78"; Longitude: -79°18` 54.46"; Sub-basin: 20-E; Pittsburgh Corps District).

 The applicant is proposing to:

 1. Construct and maintain an 18` long by 15" wide open-bottom corrugated metal box culvert over Noahs Glade (HQ-CWF).

 2. Construct and maintain rock slope protection in the floodway on the upstream and downstream side of the aforementioned structure and associated improvements to the approach roads.

 For the purpose of constructing a private driveway bridge across Noahs Glade (HQ-CWF). The project is located at Dinner Bell Road, 1 mile from the intersection between US Route 40 and Dinner Bell Road, in Henry Clay Township, Fayette County (Fort Necessity USGS Topographic Quadrangle, Latitude: 39°47`29"; Longitude: -79°30`39"; Sub-basin: 19-E; Pittsburgh Corps District).

E56-385, Plenary Walsh Keystone Partners, 2000 Cliff Mine Road, Park West Two, 3rd Floor, Pittsburgh, PA 15275, Stonycreek Township, Somerset County, ACOE Pittsburgh District.

 The applicant is proposing to:

 1. Remove an existing 15` long by 24`-9" wide, single span, steel I-beam bridge over Lamberts Run (CWF);

 2. Construct and maintain a replacement, 18` long by 54`-2 7/8" prestressed concrete, spread box beam bridge;

 3. Construct and maintain rock slope protection in the floodway on the upstream and downstream side of the aforementioned structure and associated improvements to the guiderails and approach roads;

 4. Relocate 146 linear feet of an existing unnamed tributary to Lamberts Run (CWF) (Stream 2) and to construct and maintain new relocated channel;

 5. Permanently place and maintain fill in 44 square feet of Lamberts Run (CWF), adjacent to an unnamed tributary to Lamberts Run (CWF) (Stream 3);

 6. Permanently place and maintain fill in 0.003 acre of PEM Wetland (Wetlands 1 & 2);

 7. Temporarily impact 0.020 acre of PEM Wetlands during construction. (Wetlands 1 & 2);

 For the purpose of replacing the existing structurally deficient structure over Lamberts Run (CWF). The project is located at State Route 1007, Section 001, 0.3 mile from the intersection between State Route 1007 and Pompey Hill Road, in Stoystown, PA 15563. (Stoystown USGS Topographic Quadrangle, Latitude: 40° 4` 15"; Longitude: -78° 54` 51"; Sub-basin: 18-E; Pittsburgh Corps District).

 Place and maintain fill in three (3) unnamed tributaries to Little Chartiers Creek (HQ-WWF) (168.0 linear feet, 34.0 linear feet and 65.0 linear feet) for the purpose of constructing the Laurel Landing Subdivision, located on the west side of Franklin Road. The project will impact a total of 267.0 linear feet of stream channel. The project is located approximately 1,500.0 feet south of the intersection of Franklin Road and Mars Crider Road (SR 228), (Latitude: 40°-16`-8"; Longitude: -80°-8`-16") in North Strabane Township, Washington County.

E65-991, PennDOT District 12-0, 825 North Gallatin Avenue, Uniontown, PA 15401, Allegheny Township, Westmoreland County, ACOE Pittsburgh District.

 The applicant is proposing to:

 1. Remove the existing 109.8` long 18" RCP enclosure carrying a UNT to the Allegheny River having a drainage area of less than 100 acres; construct and maintain a replacement 147.3` long 18" RCP enclosure for a total extension length of 37.5`. Downstream of this pipe, remove the existing 29.4` long 18" CPP carrying the same UNT; construct and maintain a replacement 29.4` long 18" RCP in the same location. Place and maintain fill in 85.9` of this same UNT; construct and maintain a 64.3` long relocated replacement channel. Mitigation for a loss of 67.1` of this UNT will occur offsite.

 2. Remove the existing 136.4` long 48" RCP enclosure, carrying a second UNT to the Allegheny River, having a drainage area of 124 acres; construct and maintain a replacement 345.9` long 48" RCP enclosure for a total extension length of 209.5`. Place and maintain fill in 567.8` of this same UNT; construct and maintain a 328.4` long relocated replacement channel. Mitigation for a loss of 278.5` of this UNT will occur offsite.

 3. Construct and maintain a 393.2` long extension of an existing 125.4` long 36" RCP enclosure for a total enclosure length of 518.6`; the pipe is conveying a third UNT to the Allegheny River, having a drainage area of less than 100 acres. Mitigation for a loss of 40.5` of this UNT will occur offsite.

 4. Remove the existing 48` long 18" RCP, carrying a fourth UNT to the Allegheny River, having a drainage area of less than 100 acres; construct and maintain a replacement 72` long 18" RCP. Place and maintain fill in 238.3` of this same UNT and construct and maintain a 185.1` long relocated replacement channel. Mitigation for a loss of 53.2` of this UNT will occur offsite.

 5. Place and maintain fill in 956.1` of UNTs to the Allegheny River, having drainage areas of less than 10 acres; mitigation for the loss of these UNTs will occur offsite.

 6. Place and maintain fill in 0.225 acre of PEM and PSS wetlands; mitigation for these wetlands will occur offsite.

 7. Stream and wetland mitigation will occur offsite along Owl Hollow Road in Ligonier Township, Westmoreland County. Stream mitigation includes constructing and maintaining bank grading, bank stabilization, and in-stream habitat structures in 815` of a UNT to Mill Creek, having a drainage area of 1.44 square mile; 541` of this same UNT will be permanently filled and a 500` long relocated replacement channel will be constructed; a loss of 41` of this UNT will be mitigated for at this site. Work at this site also includes placing and maintaining fill in 70` of a second UNT to Mill Creek, having a drainage area of less than 100 acres and constructing and maintaining 58` of 24" CMP and 37` of relocated replacement channel. The loss of 58` of this UNT will be mitigated for at this site. In addition, placement and maintenance of fill in 0.146 acre of exceptional value PEM wetlands will occur associated with the construction of the stream mitigation; this wetland impact will be mitigated for at this site. Wetland mitigation includes the construction and maintenance of 0.152 acre of new exceptional value PEM wetlands and the enhancement of 1.487 acre of existing exceptional value PEM wetlands.

 8. In addition, temporarily impact 1,224.5` of streams and 1.907 acre of wetlands for the purpose of constructing these encroachments.

 The project is located immediately east of the Freeport Bridge, extending to the intersection of SR 356 and White Cloud Road (USGS Freeport, PA Quadrangle, Beginning Latitude: 40° 39` 58.6"; Beginning Longitude: -79° 41` 25.5"; Ending Latitude: 40° 39` 19.6"; Ending Longitude: -79° 40` 3.8"; Sub-basin 18A). Off-site stream and wetland mitigation will take place in Ligonier Township, Westmoreland County, located approximately 0.75 mile north of the intersection of SR 271 and Owl Hollow Road (USGS Wilpen, PA Quadrangle, Latitude: 40° 16` 5.4", Longitude: -79° 10` 35.3"; Sub-basin 18C).

 The project proposes the rehabilitation of the existing Niemeyer Road covered bridge, which is listed on the National Register of Historic Places. The project consists of replacement of all deteriorated or damaged wood members of the truss superstructure; restoration of failed or missing lateral bracing; upgrading the live load capacity to H15 with the addition of steel I-beams; replacement of the roof system; replacement of the stone masonry substructures; addition of scour protection; and approach roadway improvements. The bridge is currently closed to vehicular traffic. The project will preserve the historic appearance of the structure while addressing public safety concerns regarding the condition of the existing bridge. The project will result in 122 linear feet of permanent stream impacts to Le Boeuf Creek, 80 linear feet of temporary stream impacts to Le Boeuf Creek and 1,270 square feet of temporary wetland (PEM) impacts to facilitate staging and construction.

 3) A 12-inch water pipeline and a timber mat bridge impacting 13 linear feet of an unnamed tributary to Slacks Run (HQ-CWF) and 3,155 square feet of adjacent PEM wetland (Bodines, PA Quadrangle 41°26`22"N; 76° 55`32"W);

 The project will result in a total of 38 linear feet of stream impacts, 0.04 acre of additional floodway impacts, and 0.18 acre of wetland impacts all for the purpose of installing water pipeline and temporary access roadway for Marcellus well development.

No wetlands will be impacted by the activity.

EROSION AND SEDIMENT CONTROL PERMITS

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance activities associated with either road maintenance or timber harvesting operations.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department regional office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application.  Apex Energy LLC is proposing to install the Numis Well Pad Project which involves the construction of a well pad and new access road which will provide access to Apex Energy (PA), LLC's (Apex) Numis Well Pad from Sedona Lane. The proposed access road will cross Trib 37360 to Lyons Run. The proposed access road will be 24 feet wide upon completion. The construction right-of-way will be a maximum width of 175 feet wide at the stream crossing location. An 86-foot long, 60-inch diameter CMP culvert will be placed within Trib 37360 to Lyons Run. A 32-foot long riprap apron will be placed at the culvert outlet, and 6-foot wingwalls will be placed at the inlet and outlet.

 The project is a Joint Permit Application due to the proposed structures not qualifying for registration under a GP-07.

The WER is a biological determination of a site-specific aquatic life criterion, determined by conducting toxicity testing on sensitive aquatic species using site or simulated site water and comparing it to testing performed using lab dilution water. The WER procedure recognizes that the physical and chemical characteristics of site water can influence the toxicity of a chemical on aquatic life.

 On December 1, 2016, the Department received WER testing results for Copper from the Sheffield Township Municipal Authority. Following review of the sampling protocol and study results, the EPA determined that the WER was approvable, and can be used to modify the subject NPDES permit Copper limit.

 Alternate site specific criteria for Copper have been developed by multiplying the fish and aquatic life Copper criterion contained in Ch. 93, Table 5, by the following WER. The WER acts as a multiplier in the calculation of the NPDES permit limits for Copper.

STATE CONSERVATION COMMISSION

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decision law.

 For individuals who wish to challenge actions, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for pro bono representation. Call the Secretary of the Board at (717) 787-3483 for more information.
