FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  To amend Permit No. E39-549 to authorize the modification and maintenance of the following water obstruction and encroachments within the floodway/floodplain of Jordan Creek (TSF, MF) associated with the Jordan Creek Greenway Trail Project:

 1. Construction of a 150 linear foot elevated boardwalk impacting a de minimus area of PEM wetland equal to 0.02 acre;

 2. Placement of fill in the floodway/floodplain of Jordan Creek (TSF, MF) for an additional 245 linear foot segment of pedestrian walking trail;

 3. Construction of two additional stormwater outfall structures to Jordan Creek (TSF, MF). The outfalls will consist of an 18-inch HDPE pipe with concrete headwall and riprap apron.

 E39-549 authorized the construction and maintenance of the following water obstructions and encroachments within the floodway of Jordan Creek (TSF, MF) associated with the Jordan Creek Greenway Trail Project:

 1. A 10-foot wide single-span, prefabricated pedestrian bridge with concrete abutments, having a 120-foot span and a 6-foot underclearance, across Jordan Creek (TSF, MF);

 2. Fill in various locations within the floodway of Jordan Creek (TSF, MF) for the construction of a 9,700-linear foot segment of the pedestrian trail;

 3. Four outfall structures to Jordan Creek (TSF, MF). The stormwater outfalls each consist of an 18-inch HDPE pipe with a concrete headwall and riprap apron.

 The project is located along the north side of Jordan Creek (Allentown West and Cementon, PA Quadrangle; Latitude 40° 37` 44.2"; Longitude 75° 34` 12.3").

E39-562. Lower Macungie Township, 3400 Brookside Road, Macungie, PA 18062-1427, Lower Macungie Township, Lehigh County, U.S. Army Corps of Engineers, Philadelphia District.

 To construct and maintain the following water obstructions and encroachments associated with the Spring Ridge Crossings Park Project:

 1) A 6-foot wide, 811-linear foot section of asphalt walking trail within the 100-year floodplain of Little Lehigh Creek (HQ-CWF, MF) resulting in 446 ft3 of fill within the floodplain.

 2) A 6-foot wide, 438-linear foot section of asphalt walking trail within the 100-year floodplain of Little Lehigh Creek (HQ-CWF, MF) resulting in 97 ft3 of cut within the floodplain.

 3) A 6-foot wide, 248-linear foot section of asphalt walking trail within the 100-year floodway of Little Lehigh Creek (HQ-CWF, MF) resulting in 27 ft3 of fill within the floodway.

 4) A 6-foot wide, 108-linear foot section of asphalt walking trail within the 100-year floodway of Little Lehigh Creek (HQ-CWF, MF) resulting in 78 ft3 of fill within the floodplain.

 5) A 6-foot wide, 25-linear foot section of asphalt walking trail within the 100-year floodplain of Little Lehigh Creek (HQ-CWF, MF) resulting in 16 ft3 of fill within the floodplain.

 The project begins directly northeast of the intersection of Brookside Road and Princeton Road and terminates approximately 0.1 mile southwest of the intersection of Wild Cherry Lane and Valley Stream Lane (Allentown West, PA Quadrangle Latitude: 40° 32` 27.75" Longitude: -75° 32` 48.55") in Lower Macungie Township, Lehigh County.

E48-440. Wildlands Conservancy, 3701 Orchid Place, Emmaus, PA 18049. Lower Mount Bethel Township, Northampton County, Army Corps of Engineers Philadelphia District.

 To construct and maintain a stream and floodplain restoration project along 4,600 linear feet of the Oughoughton Creek (CWF) with work consisting of the installation of approximately seventeen (17) single rock vane weirs, three (3) saw-tooth stone deflectors, floodway grading, gravel bar removal, erosion repair, rock toe/riprap bank stabilization, and riparian restoration spanning six (6) designated reaches of watercourse, totaling approximately 2,180 linear feet of permanent stream impacts.

 The project begins approximately 2,400 feet downstream of Miller Road Bridge and terminates approximately 700 feet downstream of Martins Belvidere Highway. (Bangor, PA and Belivdere, NJ USGS Quadrangles; Latitude: 40° 48` 34.1"; Long: -75° 07` 26.3".) Subbasin 1F.

E48-444. County of Northampton, 669 Washington Street, Easton, PA 18042. Plainfield & Bushkill Townships, Northampton County, Army Corps of Engineers Philadelphia District.

 To construct and maintain the following water obstruction and encroachments associated with the Twin Rivers Trail, Gap 9A project consisting of a 10-foot wide trail with a crushed stone surface:

 1. A stream crossing of a tributary to Bushkill Creek (Stream P3-A) (HQ-CWF, MF) consisting of a 24-foot-long, 12-foot by 4-foot concrete box culvert with concrete headwalls, with the invert depressed 6-inches below streambed elevation.

 2. A stream crossing of a tributary to Bushkill Creek (Stream P-5) (HQ-CWF, MF) consisting of dual 20-foot-long, 24-inch diameter HDPE culvert with concrete headwalls, with the invert depressed 6-inches below streambed elevation.

 3. A stream crossing of a tributary to Bushkill Creek (Stream P-6) (HQ-CWF, MF) consisting of a 14-foot-long, 11-foot by 3-foot concrete box culvert with concrete headwalls, with the invert depressed 6-inches below streambed elevation.

 4. A stream crossing of a tributary to Bushkill Creek (Stream P-9) (HQ-CWF, MF) consisting of a 14-foot-long, 6-foot by 3-foot concrete box culvert with concrete headwalls, with the invert depressed 6-inches below streambed elevation.

 5. Two (2) trail crossings impacting a de minimus area of EV wetlands equal to 0.02 acre within the Bushkill Creek Watershed (HQ-CWF, MF).

 The project begins at Henry Road (Wind Gap, PA Quadrangle; Latitude: 40.7777°; Long: -75.2839°) and follows State Route 33 for approximately 1.6 miles to Main Street (Wind Gap, PA Quadrangle; Latitude: 40.7651°; Long: -75.2718°) in Plainfield and Bushkill Townships, Northampton County. Subbasin 1F.

 To remove existing structures and to (1) relocate 446 linear feet of Deer Creek (CWF, MF) and 70 linear feet of UNT Deer Creek (CWF, MF), (2) to construct a 432-linear foot 11-foot × 12-foot box culvert in Deer Creek (CWF, MF), and (3) Construct a bridge over Deer Creek (CWF, MF) for the purpose of improving transportation safety and roadway standards in Hopewell and Shrewsbury Townships, York County (39° 46` 25.2", -76° 39` 59.3"). The project proposes to permanently impact 948 linear feet of stream channel and 0.71 ac. of floodway and temporarily impact 70 linear feet of stream channel. No wetland impacts are proposed. The permit was issued on December 18, 2018.
