THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. PUBLIC WATER SUPPLY (PWS) PERMITS Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.

PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

The proposed flares will be located just north of the existing GROWS Landfill in a complex that will be utilized for Fairless, GROWS North, and GROWS Landfills. AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities.
Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. This facility is a Title V facility. A PAL of 47.895 tons per year of VOC was established under Plan Approval No. 15-0037D. This plan approval renews the PAL of 47.895 tons per year of VOC. Primary sources of VOC are lithographic presses and screen presses. Other sources of VOC include heaters, boilers, and emergency generators. The Plan Approval will contain monitoring and recordkeeping requirements that ensure the facility complies with the applicable requirements for a PAL, as outlined under 25 Pa. Code § 127.218.

07-05004C: Altoona Terminals DE LLC (P.O. Box 2621, Harrisburg, PA 17105-2621) for a petroleum product bulk terminal in Allegheny Township, Blair County. Plan Approval No. 07-05004C will authorize installation of backup Vapor Combustion Unit (VCU). The VCU will control gasoline vapors from an existing Loading Rack North, which is primarily controlled by a vapor recovery unit (VRU). The potential facility volatile organic compound (VOC) emissions of this plan approval will not change, because the backup VCU will have gasoline throughput limit of 275,000,000 gallons per year. The backup VCU will have potential emissions of 4.59 tpy NOx, 11.47 tpy CO, and 20.65 tpy VOC including 1.58 tpy HAPs. The facility has Title V operating permit No. 07-05004B. The facility is major for VOC and the 2018 VOC emissions was 48.99 tons. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12, and will be subject to 40 CFR Part 60, Subpart XX—Standards of Performance for Bulk Gasoline Terminals, and 40 CFR Part 63, Subpart BBBBBB—National Emission Standards for Hazardous Air Pollutants for Gasoline Distribution Bulk Terminals, Bulk Plants, and Pipeline Facilities. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval will be incorporated into an operating permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.
07-05045B: Curry Rail Services, Inc. (1477 Degol Industrial Drive, Hollidaysburg, PA 16648) for the construction and temporary operation of four coating booths and a plasma table at the facility located in Hollidaysburg Borough, Blair County. Potential emissions are expected to be: 49.9 tons per year of VOCs; 30 tons per year of HAPs; 21.39 tons per year of PM; 11.05 tons per year of NOx; 2.83 tons per year of CO; and less than one ton per year of SOx. The facility is a Title V facility. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12; 25 Pa. Code § 129.52—Surface coating processes; 25 Pa. Code § 129.52d—Control of VOC emissions from miscellaneous metal parts surface coating processes, miscellaneous plastic parts surface coating processes and pleasure craft surface coatings; and 40 CFR Part 63, Subpart MMMM—National Emission Standards for Hazardous Air Pollutants for Surface Coating of Miscellaneous Metal Parts and Products. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval may be incorporated into an Operating Permit pursuant to the provisions of 25 Pa. Code Chapter 127.
06-05158A: Allan Myers, L.P. (638 Lancaster Avenue, Malvern, PA 19355) for the construction of an asphalt plant at the Leesport Avenue location in Ontelaunee Township, Berks County. The expected increases in emissions as a result of the proposed asphalt plant are: 13 tpy of NOx, 2 tpy of SOx, 65 tpy of CO, 12 tpy of PM-10 and 16 tpy of VOC. The facility will be a State Only facility. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12, and 40 CFR 60 Subpart I. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval may be incorporated into an Operating Permit pursuant to the provisions of 25 Pa. First Quality Tissue, LLC has purchased 165.0 tons of NOx ERCs. The proposed NOx ERCs were purchased from Element Markets, LLC. The NOx ERCs were created from the shutdown of sources at the LEDVANCE, LLC (f/k/a Osram Sylvania, Inc.) located in Wellsboro Borough, Tioga County, Pennsylvania. The Department intends to issue Plan Approval 18-00030D for the First Quality Tissue facility located in Castanea Township, Clinton County, to incorporate 140.25 tons of NOx ERCs. The plan approval will offset the total net increase in potential to emit (PTE) for NOx and VOCs and make the ERCs Federally enforceable prior to the ERCs expiring. The Department's review of the information submitted by First Quality Tissue, LLC indicates that the proposed ERCs will comply with the requirements of 25 Pa. Code § 127.208, relating to ERC use and transfer requirements. Based on these findings, the Department intends to approve the application and issue a plan approval for the transfer and use of the ERCs. The Department has included the following conditions in the proposed plan approval.
This plan approval is granted solely for the transfer and use of ERCs in accordance with 25 Pa. Code § 127.208(2), and does not authorize the permittee to construct, modify, or reactivate an air contaminant source or allow for the installation of an air cleaning device on an air contaminant source. The permittee is approved to use NOx ERCs in place of VOC ERCs at a 1:1 ratio to satisfy VOC emission offsetting requirements in this plan approval. This plan approval authorizes the transfer and use of 140.25 tons of NOx ERCs from Element Markets, LLC to First Quality Tissue, LLC to meet the offset emissions requirements of 25 Pa. Code Chapter 127.
Element Markets, LLC created the NOx ERCs from the shutdown of sources at the LEDVANCE, LLC (f/k/a Osram Sylvania, Inc.) facility located in Wellsboro Borough, Tioga County. The 140.25 tons of NOx ERCs were generated on September 28, 2016. These ERCs are to be used to satisfy offset emissions requirements of Plan Approval 18-00030C in accordance with 25 Pa. Code §§ 127.206—127.210, for the NOx and VOC emissions increases from the proposed facility. Upon the issuance of this plan approval, the ERCs are no longer subject to expiration under 25 Pa. Code § 27.206(f), except as specified in 25 Pa. Code § 127.206(g). If the NOx ERCs identified in this plan approval are not used and subsequently re-entered into the ERC registry, the applicable 10-year expiration date may not be extended. This approval satisfies the requirements of 25 Pa. Code Chapter 127, Subpart E (relating to new source review) including §§ 127.205(4), 127.208(2), 127.209(c) and 127.210. First Quality Tissue, LLC will retain 24.75 tons of NOx ERCs for future use or transfer. These ERCs will expire on September 28, 2026.

The proposed CVD Reactors will become the 18th and 19th onsite. They will coat purified graphite parts with silicon carbide. Emissions of HCl, a Hazardous Air Pollutant, are estimated to be less than 0.05 ton per year.

Brier Hill Refuse Site contains air contamination sources consisting of conveyers, stockpiles, wet, magnetite, heavy media, separation process with a centrifuge, truck unloading and loading operations. Air pollution prevention equipment at the facility includes enclosures, minimization of drop height, and a watering.
Annual potential emissions are 4.4 tons of PM10 and 2.3 tons of PM2.5. Sources at the Brier Hill Site are subject to 40 CFR Part 60, Subparts A and Y, and 25 Pa. Code Chapters 121—145. The permit includes emission limitations and operational, monitoring, reporting, and recordkeeping requirements for the plant.

32-00436: John A. Lefdahl Funeral Home (898 Old Route 119 North, Indiana, PA 15701) The Department intends to issue a new natural minor State Only Operating Permit for the operation of an animal crematory located in White Township, Indiana County. The facility operates a Mathews International-Cremation Division model IEB-16 natural gas-fired crematory with a maximum cremation rate of 100 lbs/hr and a maximum charge capacity of 300 lbs. Potential emissions from this facility are estimated at 0.23 ton of SO2 per year, 0.28 ton of NOx per year, 0.94 ton of CO per year, 0.66 ton of PM per year, 0.66 ton of PM10 per year, and 0.28 ton of total hydrocarbons per year, and 0.1 ton of HAPs per year. The facility is subject to the applicable requirements of 25 Pa. Code Chapters 121—145. The proposed operating permit includes emission limitations, and operational, monitoring, work practice, reporting, and recordkeeping requirements for the facility.

32-00394: Teawood, Inc. (500 Ben Franklin Road S., Indiana, PA 15701) Natural Minor State-Only Operating Permit is for a pet crematory located in White Township, Indiana County. In accordance with 25 Pa. Code §§ 127.424 and 127.425, the Department of Environmental Protection (DEP) has received an application and is providing notice that it intends to issue an Air Quality Operating Permit for the previously mentioned facility. This air quality permit will convert plan approval 32-00394A into a State-only operating permit. Sources of emissions consist of one Matthews International-Cremation Division (''Matthews'') IE43-PP Jr. animal crematory incinerator with a 75 lb/hr capacity. The unit is equipped with a 0.6 MMBtu/hr primary burner and a 1.2 MMBtu/hr secondary chamber afterburner that meets current best available technology standards. Facility-wide potential emissions are projected to be 0.33 TPY PM, 0.25 TPY NOx, 0.21 TPY CO, 0.02 TPY VOC, 0.15 TPY SOx, 0.07 TPY total HAP, and 0.0004 TPY Pb. The facility is required to conduct surveys of the site or use an opacity monitor at a minimum of once per cremation cycle to ensure compliance with visible and malodor emission requirements and maintain records of those surveys. The air quality permit includes operating requirements, monitoring requirements, and recordkeeping requirements for the site.

30-00087: Emerald Contura, LLC (158 Portal Road, Waynesburg, PA 15370), In accordance with 25 Pa. Code §§ 127.441 and 127.425, the Department is providing notice that they intend to issue a renewed, facility-wide, synthetic minor, State Only Operating Permit for the continued operation of a coal preparation plant, known as the Emerald Mine Coal Preparation Plant, located in Franklin Township, Greene County.
Emerald Mine Coal Preparation Plant contains air contamination sources consisting equipment for mining, conveying, unloading, breaking, screening, chemical froth flotation, sizing, storing, loading coal, and roads. Air pollution prevention equipment at the facility includes enclosures, baghouse, minimization of drop height, and a water truck and sweeper for the plant roads.
Annual potential emissions are 8 tons of PM10, 4 tons of PM2.5, and 32 tons of VOC. Sources at Emerald Mine Coal Preparation Plant are subject to 40 CFR Part 60, Subparts A and Y and 25 Pa. 24-00025: Alpha Precision Group, Sintered Metals (95 Mason Run Road, Ridgway, PA 15853), the Department intends to issue the renewal of the State-Only Operating Permit of a powder metal parts manufacturing facility located in Ridgway Township, Elk County. Permitted air contamination sources at the facility are powder metal sintering furnaces, heat treat furnaces, dip tank for rust inhibitor application, parts washers, emergency generator, and raw material handling. The sintering furnaces has been subject to conditions of GP-8 (General Permit for powder metal sintering furnaces). The emergency generator has been subject to 40 CFR 63 Subpart ZZZZ. In this renewal, no major change on permit requirements is made. The parts washer authorized through a RFD issued in August 2018 is determined to be an insignificant activity because it uses a VOC/HAP-free cleaning solvent.
25-00970: F3Metalworx Inc. (12069 East Main Road, North East, PA 16428-3641). The Department intends to issue a renewal of the Natural Minor Operating Permit to operate a manufacturing and powder coating of wire shelving systems for the retail industry located in North East Township, Erie County. The emitting sources include a Fluidized Bed Sand Stripper, a Burn off oven and, Miscellaneous natural gas usage. The facility is a natural minor. The facility wide potential emissions are: NOx: 15.73 TPY (Tons per year), VOC: 2.69 TPY, CO: 16.02 TPY, PM: 3.04 TPY, and emissions of all other criteria pollutants are less than a ton per year, each.
43-00356: Hermitage Municipal Authority (2133 Broadway Rd, Hermitage, PA 16148). The Department is providing notice that they intend to issue a State Only Natural Minor Operating Permit for operation of the waste-to-energy facility located in the City of Hermitage, Mercer County. The facility's primary emission source consists of the start-up boiler, the combined heat and power (CHP) unit with emissions controlled by a scrubber, catalytic oxidizer, and emergency flare, and the emergency generator. The potential emissions of the primary pollutants from the facility after permit limitations are as follows: 23.75 TPY (tons per year) NOx, 13.68 TPY CO, 0.98 TPY SOx, 0.55 TPY PM-10 and PM-2.5, 1.32 TPY VOC, and 0.87 TPY total HAPs; thus, the facility is a natural minor. The facility was previously operating under Plan Approval 43-356D. The CHP unit is subject to 40 CFR Part 60 Subpart JJJJ, Standards of Performance for Stationary Spark Ignition Internal Combustion Engines. The emergency generator is subject to 40 CFR Part 60 Subpart IIII, Standards of Performance for Stationary Compression Ignition Internal Combustion Engines. The renewal permit will contain emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

The facility's air emission sources include two (2) boilers firing natural gas and No. 2 fuel oil during periods of natural gas curtailment each rated 21.0 MMBtu/hr, one (1) emergency generator firing diesel fuel rated 1,250 kW, two (2) emergency generators firing diesel fuel each rated 350 kW or less, and one (1) fire pump firing diesel fuel rated 155.1 kW.
