33-00033: Owens-Illinois Inc., Owens-Brockway Glass Container Plant 18 (1260 Cherry St., Brockway, PA 15824), on August 1, 2019, the Department issued the renewal of the Title V Operating Permit of a glass container manufacturing facility located in Brockway Borough, Jefferson County. Permitted sources at the facility include a glass melting furnace, a refiner, forehearths, forming machines, lehrs, and other supporting operations. The facility is Title V because of its potential to emit NOx and SOx. The glass melting furnace has been subject to 25 Pa. Code §§ 129.301 to 129.310, § 60 Subpart CC, and § 63 Subpart SSSSSS. In this renewal, applicable RACT II (§§ 129.96—129.100) requirements are incorporated into the renewal permit. A 400-kW emergency generator is added as a permitted source and subject to § 60 Subpart IIII. To ensure exemption from plan approval requirements, the emergency generator is also subject to operating hour restrictions of 500 hours in any 12-month rolling period and 326 hours during ozone season (May through September). The RACT I-based biennial NOx stack testing for the glass melting furnace is removed because the corresponding RACT I-based NOx limit is streamlined out by a more stringent limit (§ 129.304), which requires CEMS for compliance demonstration (§§ 129.308, 129.309). Source test submittals are updated based on Source Testing Section's latest instructions. Sources no longer operated are removed from the operating permit.

25-00883: Millcreek Township (3608 W 26th St, Erie, PA 16506). On August 1, 2019, the Department issued a renewal State Only Natural Minor Operating Permit for operation of the hot mix asphalt (HMA) facility located in Millcreek Township, Erie County. The facility's primary emission sources include the HMA process (including a 34 MCF/hr natural gas-fired burner) controlled by a baghouse and three parts washers. The potential emissions of the primary pollutants from the facility are as follows: 18.71 TPY (tons per year) NOx, 31.62 TPY CO, 6.51 TPY VOC, 1.04 TPY total HAPs, 1.51 TPY filterable PM-10, 0.57 TPY filterable PM-2.5, and 0.59 TPY SOx; thus, the facility is a natural minor. The HMA process is subject to 40 CFR 60 Subpart I, Standards of Performance for Hot Mix Asphalt Facilities, as well as Plan Approval 25-883A that limits throughput for the plant to 120 tons per hour and 294,000 tons per year during any 12 consecutive month period. The renewal permit contains emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.
10-00287: Minteq International Incorporated (395 Grove City Road, Slippery Rock, PA 16057) On August 5, 2019, the Department issued a renewal of the Synthetic Minor Operating Permit to operate manufacturing equipment to produce clay refractory for glass furnace lining and ceramic shapes. The facility is located in Slippery Rock Township, Butler County. The sources at the facility include mixers, dryers, kilns, and the mold shop. Particulate from the mixers is controlled by three fabric filters. The facility has previously taken a restriction on VOC emissions from the facility. The VOC emissions shall not exceed 49 tons per year. The facility is a Synthetic Minor. The potential emissions from the facility as stated in the renewal permit application are NOx: 1.0 Ton per year, PM: 19.0 TPY, PM-10: 19.0 TPY, PM2.5: 19 TPY, SO2: 0.3 TPY, VOC: 41.2 TPY, and, CO: 39.3 TPY. Actual VOC emissions, particulate matter, and CO emissions from the facility over the past five years have been less than 4.0 TPY, 5.0 TPY, and 1.0 TPY for each year, respectively.

CONTROL ACT SECTION 401The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. The Remedial Action Plan was not acceptable to meet the Site-Specific Standard and was disapproved by DEP on August 2, 2019.

Brunner Island Steam Electric Station, East Manchester Township, York County The Department of Environmental Protection, the Lower Susquehanna Riverkeeper Association, Waterkeeper Alliance and Penn Environment (Plaintiffs) along with Talen Energy Corporation and Brunner Island LLC (Defendants) have lodged a proposed Consent Decree to resolve all claims alleged by the Plaintiffs against Defendants in the United States District Court for the Middle District of Pennsylvania, Civil Action Nos. 1:19-cv-01324-CCC and 1:19-cv-01329-JEJ. EROSION AND SEDIMENT CONTROL PERMITS This application was originally published on February 16, 2019 with an incorrect application number, ESG02000160001. The republishing of the application serves solely to correct the application number. The proper application number is ESG02000160002. Comments previously submitted in response to the February 16, 2019 Pennsylvania Bulletin Notice do not have to be resubmitted.
The following parties have applied for Erosion and Sediment Control Permits (ESCP) for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.
Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices (BMPs) which restrict the rate and quantity of sediment discharged.
Persons wishing to comment on the proposed permit are invited to submit a statement to the appropriate Department regional office listed above the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department regional office during the 30-day public comment period.
Following the 30-day comment period, the program manager from the appropriate Department regional office will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.
The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the appropriate Department regional office.

The applicant is proposing the installation and maintenance of an approximately 77.3-mile-long, 36-inch diameter pipeline and appurtenant facilities in various municipalities within Luzerne, Carbon, Monroe, Northampton and Bucks Counties for the purpose of transporting natural gas from Marcellus Shale production areas to an existing pipeline in Mercer County, NJ. The project also includes 0.5 mile of 4-inch diameter Blue Mountain Lateral and 2.1-mile-long, 24-inch diameter Hellertown Lateral. The project consists of four Water Obstruction and Encroachment Permits and one Chapter 102 Erosion and Sediment Control Permit.
ESG02000160002. The Department of Environmental Protection (Department) provides notice of receipt of an application for a Chapter 102, Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities. The application is currently under technical review for PennEast Pipeline Project, including the associated compressor station, metering stations, regulator stations, valve stations, access roads and other ancillary earth disturbance activities.
This authorization is required for earth disturbance activities associated with oil and gas exploration, production, processing or treatment operations or transmission facilities when earth disturbance is five acres or greater. Review of this application is being coordinated among the Department and the associated county conservation districts.
