Chapter 56 Working Group Meeting

 The Pennsylvania Public Utility Commission (Commission) announces the first meeting of the Chapter 56 Working Group (Working Group). The meeting will be held on October 29, 2019, at 9 a.m. in the Keystone Building, Hearing Room 1, 400 North Street, Harrisburg, PA. The schedule of discussion at the meeting will follow in order of the issues as listed:

9 a.m.—10 a.m. Form of Medical Certificate
10:15 a.m.—11:15 a.m. Other Court Orders
11:30 a.m.—12:30 p.m. Privacy Guidelines

 The Working Group is being formed under the Commission's adoption of amendments to 52 Pa. Code Chapter 56 (relating to standards and billing practices for residential public utility service), which were published as a final-form rulemaking at 49 Pa.B. 2815 (June 1, 2019). The final-form rulemaking codified amendments to 66 Pa.C.S. Chapter 14 (relating to responsible utility customer protection), which were signed into law as Act 155 of 2014 by Governor Tom Corbett on October 22, 2014. In the Final Rulemaking Order, the Commission announced it deferred three issues for discussion and deliberation by interested parties. Those issues related to the amendments to 66 Pa.C.S. §§ 1403, 1406 and 1417 (relating to definitions; termination of utility service; and nonapplicability) (see Final Rulemaking Order, Attachment One, pages 21, 56, 139 and 166). It is the purpose of the Working Group to develop recommendations to the Commission on these issues which include:

 1) Form of Medical Certificate (66 Pa.C.S. § 1403): Discussion will include what elements the form of a medical certificate should include; whether it should be optional; whether the medical professional's license number should be required on the certificate; and whether medical certificate formats should be posted on utility web sites.

 2) Other Court Order (66 Pa.C.S. § 1417): Discussion will include what types of orders qualify; how should an order from a court in another state be handled; what constitutes ''domestic violence,'' and what qualifies as ''clear evidence'' of domestic violence; and whether these other orders should have time limitations. Additionally, we will be discussing developing appropriate notice of domestic violence exemption to consumers; training and consumer education materials; and confidentiality expectations for handling information about a customer's status as a victim of domestic violence.

 3) Privacy Guidelines (66 Pa.C.S. § 1406(b)(1)(ii)(C)):Discussion will include the privacy guidelines necessary to maintain the confidentiality and privacy of customer contact information. We will discuss concerns regarding sharing personal contact information with third parties, including what type and form of consent is needed; the duration, expiration and revocation of consent; and the use and sharing of the contact information provided by the customer.

 Interested stakeholders, including parties from the Final Rulemaking Order, are encouraged to participate in the Working Group. Utilities and interested stakeholders should e-mail Laura Griffin at laurgriffi@pa.gov by Friday, October 18, 2019, to inform the Commission of their intent to participate at the Working Group meeting.

 Interested parties may file written comments con- cerning the previously listed issues at Docket No. L-2015-2508421. Comments are due on or before October 4, 2019, and must reference Docket No. L-2015-2508421. Comments filed by means of the United States Postal Service must be addressed to the Pennsylvania Public Utility Commission, Attn: Secretary, P.O. Box 3265, Harrisburg, PA 17105-3265. Comments may also be filed electronically through the Commission's E-File System.
