The following plans and reports were submitted under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).
Provisions of 25 Pa. Code Chapter 245 Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The DEP has taken action on the following plans and reports under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).
Provisions of 25 Pa. Code Chapter 245 Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports.
A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.
The DEP may approve or disapprove plans and reports submitted. This notice provides the DEP's decision and, if relevant, the basis for disapproval.

37-00243: In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection has made a preliminary determination to approve an alternative Reasonably Available Control Technology (RACT II) plan and seeks an approval of an amendment to the State Implementation Plan (SIP) for International Metals Reclamation Company (INMETCO), in Ellwood City Borough, Lawrence County. And in accordance with 25 Pa. Code § 127.521, the Department of Environmental Protection intends to revise a Title V Operating Permit for the facility. The facility is located at 1 Inmetco Drive, Ellwood City, PA 16117-6231. The facility's representative to contact concerning this application is Mr. Richard Lunn, EHS Manager. His phone number is 724-758-2819. Inmetco's facility is primarily used for the recovery and recycling of metals through the secondary smelting of non-ferrous metals from metal bearing wastes. The facility's air emission sources include a Rotary Hearth Furnace (RHF), Submerged Electric Arc Furnace (SEAF), material handling equipment, miscellaneous natural gas fired process and combustion units, an emergency generator, and a parts washer.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997, 2008 and 2015 National Ambient Air Quality Standard (NAAQS) for ozone.
The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (37-00243) for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT II requirements in accordance with 25 Pa. Code § 129.97, as they apply to existing sources at this facility.
The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:
Source RACT II Requirement Source 102—RHF NOx emissions shall not exceed 99.5 lbs/hr and 100 TPY as a 12-month rolling total. VOC emissions shall not exceed 21.58 lbs/hr and 94.5 TPY as a 12-month rolling total. Work practice requirement—To ensure proper operation and combustion, the burners for the RHF are to be cleaned on a rotating basis, with each burner being cleaned approximately every two weeks. The cleaning procedure entitled, ''RHF-001, Burner Cleaning and Relighting,'' dated May 27, 2013, is to be used. Source 103—SEAF NOx emissions shall not exceed 45 lbs/hr and 145.5 TPY as a 12-month rolling total. VOC emissions shall not exceed 16.56 lbs/hr and 72.6 TPY as a 12-month rolling total.

If requested by November 25, 2019, a public hearing will be held at 10 a.m. on December 4, 2019, to accept oral comments on the proposed operating permit revision and the proposed SIP revision. WQ0683219-001, Enbridge/Texas Eastern Transmission, LP (Applicant), 890 Winter Street, Suite 320, Waltham, MA 02451. Bernville TEM 2020/Compressor Units Replacement Project (Project), in North Heidelberg Township, Berks County, ACOE Philadelphia District. The proposed project is located at the existing Bernville Compressor Station site (Latitude: 40.4099°; Longitude: -76.1506°).
On April 18. 2019, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP19-191). The FERC Environmental Assessment for the Project, which was available on September 30, 2019, may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP19-191).
On September 19, 2019, Applicant requested a state water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.
The Project, as proposed, includes the replacement of two existing centrifugal gas turbine units with two new, more efficient gas turbine units. Project activities include the reconstruction and conversion of existing buildings and the construction of additional facilities, including a generator building, an electrical control building, an electric service entrance building with transformer, and an auxiliary building. In addition, the project will result in the installation of a new stormwater management retention basin, widening of the existing access road, and installation of gas, electric, and water utility lines. The Project, as proposed, will require approximately 17.6 acres of earth disturbance. No impacts to streams or wetlands are proposed.
PADEP, by this notice, is proposing to issue a SWQC to Enbridge/Texas Eastern Transmission, LP for the Bernville TEM 2020/Compressor Units Replacement Project. PADEP is proposing to certify that construction, operation and maintenance of the Bernville TEM 2020/Compressor Units Replacement Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP is proposing to further certify that the construction, operation and Bernville TEM 2020/Compressor Units Replacement Project complies with Pennsylvania water quality standards and that the construction, operation and maintenance of the project will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:
1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.
2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.
3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management) and all other applicable regulations.
4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.
5. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.
6. Operation—Applicant shall properly operate and maintain at all times all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.
7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals which ensure the project shall maintain and protect State water quality standards as required by this SWQC. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.
8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.
9. Correspondence—All correspondence with and submittals to PADEP concerning this SWQC shall be addressed to the Department of Environmental Protection, Regional Permit Coordination Office, Domenic Rocco, PE, Program Manager, 400 Market Street, Harrisburg, PA 17101, RA-EPREGIONALPERMIT@pa.gov.
10. Reservation of Rights—PADEP may modify, suspend, or revoke this SWQC if (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that the Applicant has not complied with the terms and conditions of the SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.
11. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.
12. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of this SWQC shall not be affected thereby.
Prior to issuance of the final SWQC, PADEP will consider all relevant and timely comments, suggestions or objections submitted to PADEP within 30 days of this notice. Comments should be directed to Mr. Domenic Rocco, P.E., Program Manager, Regional Permit Coordination Office at the above address or through the Pennsylvania AT&T Relay Service at 800-654-5984 (TDD). Comments must be submitted in writing and contain the name of the person commenting and a concise statement of comments, objections or suggestions on this proposal. EROSION AND SEDIMENT CONTROL The following parties have applied for Erosion and Sediment Control Permits for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.
Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.
A person wishing to comment on a proposed permit is invited to submit a statement to the appropriate Department office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department office during the 30-day public comment period.
Following the 30-day comment period, the program manager from the appropriate Department office will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.
The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the appropriate Department office.

NOTICE OF PUBLIC HEARING The Pennsylvania Department of Environmental Protection (''DEP'') has scheduled a public hearing to receive testimony and comments on the Water Quality Management Permit (''WQM'') No. 2919201 application submitted by CFC Fulton Properties. The proposal is for the construction of Bivouac Sow Farm, a new swine facility which includes three (3) barns with underneath storages for a 3,271.5 Animal Equivalent Unit sow/nursery swine operation located at 15197 Great Cove Road, Big Cove Tannery, PA 17212. Based on new standard animal weights effective October 1, 2019, the Animal Equivalent Units for this proposed operation are now 3,271.5 rather than 2,978.55. This notice has been updated to reflect that change in Animal Equivalent Units. Bivouac Sow Farm is proposed to be located in Ayr Township, Fulton County. The hearing will be held on Wednesday, October 30, 2019 at 6:30 p.m. at the McConnellsburg Fire Hall, 112 E Maple St., McConnellsburg, PA 17233.
Any person intending to testify at the hearing should register by Tuesday, October 15, 2019 by contacting Mr. John Repetz at 717.705.4904 or jrepetzpa.gov. If DEP does not receive any testimony registration requests by 4:00 p.m. on Wednesday, October 23, 2019, the public hearing will be cancelled.
