PUBLIC WATER SUPPLY (PWS) PERMITS Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.
Persons wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30 days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities.
Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Code §§ 127.44 and 127.45 that the Department of Environmental Protection (''Department'') intends to issue Air Quality Plan Approval: PA-04-00751A to Valmont Coatings, Inc. for installation and operation of a hot dip galvanizing process and pre-treatment cleaning operations in an enclosed building to be located at No. 9 South 12th Street, Midland in Midland Borough, Beaver County.
The emissions from all sources are less than 3.0 tpy particulate matter (PM10), 2.0 tpy SOx, 12.0 tpy NOx, 20.0 tpy CO, 8.0 tpy VOC, 1.0 tpy of single HAP, and 2.5 tpy of combined (HAPs). The kettle particulate emissions will be controlled by a dust collector exhausting indoor with 95—99% efficiency.

37-350B: Amerikohl Aggregates, Inc.—Gardner Mine (1401 Woodside Ave., Ellwood City, PA 16114) for the installation of a portable mineral processing plant, and associated diesel-fired generator engine at their facility in Wayne Township, Lawrence County.
Notice is hereby given pursuant to 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Pennsylvania Department of Environmental Protection (DEP) intends to issue Plan Approval 37-350B to Amerikohl Aggregates, Inc. for the installation of a portable mineral processing plant, and associated diesel-fired generator engine at the company's Gardner Mine facility located at 1401 Woodside Avenue, Wayne Township, Lawrence County. The Plan Approval will subsequently be incorporated into a State Only Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450.
Plan Approval No. 37-350B is for the installation of a portable mineral processing plant, consisting of a grizzly feeder, three (3) crushers, two (2) screens and associated conveyors, with emissions of particulate matter to be controlled by water spray dust suppression systems; and a 1,250 kW diesel-fired generator engine, with emissions to be controlled via oxidation catalyst. Based on the information provided by the applicant and DEP's own analysis, emissions from the subject source(s) will not exceed 28.76 tons of nitrogen oxides (NOx), 4.41 tons of carbon monoxide (CO), 2.42 tons of volatile organic compounds (VOC), 2.01 tons of sulfur oxides (SOx), and 4.88 tons of particulate matter per year.
The proposed sources will be subject to the applicable provisions of 40 CFR 60 Subpart OOO (Standards of Performance for Nonmetallic Mineral Processing Plants) and 40 CFR 63 Subpart ZZZZ (National Emissions Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines). The Plan Approval will contain additional testing, monitoring, recordkeeping, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

The facility is subject to the operating permit requirements of Title V of the Federal Clean Air Act, and 25 Pa. Code Chapter 127, Subchapters F and G. Potential emissions (PTE) are not expected to change as a result of replacing an existing scrubber (C06) with the proposed equivalent unit (C06A) since the scrubber is used primarily for odor control for Sources 102A and 102B. The facility PTE is 20.9 tpy for PM10. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on these findings, the Department proposes to issue a plan approval for the proposed modification. If, after the project has been implemented, the Department determines that the source has been modified in compliance with the plan approval conditions and the specifications in the application for plan approval, the requirements established in the plan approval will be incorporated into an Operating Permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.

The facility's potential emissions with a 500 hr/yr limitation on each engine are NOx 88.58 tons, CO 45.35 tons, SOx 27.04 tons, VOC 2.92 tons, PM10 9.26 tons, and HAPs 1.04 ton. The operating permit will include emission limits and work practice standards along with monitoring, recordkeeping, and reporting requirements to ensure the facility complies with the applicable air quality regulations, and includes emissions limitations to ensure synthetic minor status. COAL AND NONCOAL MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).
The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.
Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.
Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.
A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Effluent Limits for Noncoal Mining Activities
The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Pennsylvania Department of Transportation District 6-0 (PennDOT 6-0) is proposing to perform the following water obstruction and encroachment activities within an unnamed tributary to Neshaminy Creek (WWF-MF) as well as the main branch of Neshaminy Creek (WWF-MF) associated with the S.R. 0001 Section RC2 Improvement Project:
1. To construct and maintain a 90-foot-long, 42-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-19, WWF-MF). This activity is associated with the reconstruction of the Rockhill Drive Interchange, including the placement of rock riprap apron and rock barriers resulting 142 linear feet (1,412 square feet, 0.032 acre) of permanent watercourse impact and 7,284 square feet (0.167 acre) of permanent floodway impact.
2. To place fill within a perennial unnamed tributary to Neshaminy Creek (WUS-20, WWF-MF) in association with the reconstruction of the Rockhill Drive Interchange resulting in 84 linear feet (463 square feet, 0.011 acre) of permanent watercourse impact and 9,273 square feet (0.212 acre) of permanent floodway impact. This activity also includes the placement of rock barriers.
3. To construct and maintain a 95-foot-long, 42-inch diameter stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-18, WWF-MF) associated with the reconstruction of the Rockhill Drive Interchange including the placement of rock riprap apron resulting in 132 linear feet (1,336 square feet, 0.031 acre) of permanent watercourse impact and 17,854 square feet (0.410 acre) of permanent floodway impact.
4. The construction of the 95-foot-long, 42-inch diameter RCP stream enclosure extension (WUS-18, WWF-MF) includes the loss of hydrology to a wetland (WET-16, PEM) and will result in 1,601 square feet (0.037 acre) of permanent wetland impact.
5. To construct and maintain a 51-foot-long, double 42-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-15, WWF-MF), reconstruct and maintain an existing headwall, perform grading for drainage improvements, including the placement of rock riprap aprons and rock barriers associated with the reconstruction of the Rockhill Drive Interchange resulting in 149 linear feet (2,923 square feet, 0.067 acre) of permanent watercourse impact, 13,229 square feet (0.304 acre) of permanent floodway impact, 256 linear feet (2,576 square feet, 0.059 acre) of temporary watercourse impact and 12,758 square feet (0.293 acre) of temporary floodway impact.
6. To construct and maintain a 24-inch outfall carrying an intermittent unnamed tributary to Neshaminy Creek (WUS-16, WWF-MF) originating at the pipe outfall from the existing roadway slope associated with the reconstruction of the Rockhill Drive Interchange resulting in 68 linear feet (532 square feet, 0.12 acre) of permanent watercourse impact, 3,288 square feet (0.075 acre) of permanent floodway impact, 10 linear feet (78 square feet, 0.002 acre) of temporary watercourse impact and 4,845 square feet (0.111 acre) of temporary floodway impact. This activity also includes the placement of rock riprap apron and rock barrier.
7. To place fill within a wetland (WET-17, PEM) associated with the reconstruction and road widening of the Rockhill Drive Interchange resulting in 1,504 square feet (0.035 acre) of permanent wetland impact.
8. To construct and maintain a 138-foot-long, 30-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary discharging directly to Neshaminy Creek (WUS-14, WWF-MF) associated with roadway widening of S.R. 0001, existing outfall improvements, a new 12-inch diameter outfall and the placement of riprap rock aprons located adjacent to the northbound approach of the bridge over Neshaminy Creek. This activity will result in 221 linear feet (2,639 square feet, 0.061 acre) of permanent watercourse impact, 249 linear feet (2,522 square feet, 0.058 acre) of temporary watercourse impact with 25,647 square feet (0.589 acre) of permanent floodway impact to Neshaminy Creek (WUS-1) 100-year floodplain and 11,153 square feet (0.256 acre) of temporary floodway impact to Neshaminy Creek (WUS-1) 100-year floodplain.
9. To remove an existing 322.5-foot-long, three 3-span, reinforced concrete arch bridge over the Neshaminy Creek (WUS-1, WWF-MF) and in its place, construct and maintain two (2) 3-span continuous composite prestressed concrete bulb-tee beam bridges as follows:
• 401-foot-long, 3-span S.R. 0001 Section RC2 Southbound Bridge located adjacent to existing bridge location.
• 403-foot-long, 3-span S.R. 0001 Section RC2 Northbound Bridge located at existing bridge location.
This activity will result in 200 linear feet (27,172 square feet, 0.624 acre) of permanent watercourse impact, 117,535 square feet (2.698 acre) of permanent floodway impact and 230 linear feet (43,341 square feet, 0.995 acre) of temporary watercourse impact. In addition, the placement of fill, construction of new bridges and a stormwater facility will result in 10,625 square feet (1.788 acre) of permanent FEMA designated floodway and 100-year floodplain impact. Temporary impact to floodway and watercourse includes the construction and maintenance of three (3) temporary access roads and temporary bridges within the watercourse and floodway/floodplain of the Neshaminy Creek (WUS-1, WWF-MF) for pier removal and construction.
10. To place fill within a perennial unnamed tributary to Neshaminy Creek (WUS-12, WWF-MF) associated with the reconstruction of the Penndel Interchange (both sides of existing S.R. 0001) and the construction of a stormwater facility resulting in 35 linear feet (323 square feet, 0.007 acre) of permanent watercourse impact and 53 linear feet (714 square feet, 0.016 acre) of temporary watercourse impact with 32,716 square feet (0.751 acre) of permanent floodway impact and 3,817 square feet (0.088 acre) of temporary floodway impact to Neshaminy Creek (WUS-1) 100-year floodplain with includes a portion of the floodway of the unnamed tributary.
11. To place fill for grading activities and construct a stormwater facility within two (2) intermittent unnamed tributaries of Neshaminy Creek (WUS-11, WUS-13, WWF-MF) and two (2) wetlands (WET-11A, WET-11B, PFO) associated with the reconstruction of the Penndel Interchange resulting in a total of 134 linear feet (664 square feet, 0.016 acre) of permanent watercourse impact, 25,643 square feet (0.588 acre) of permanent floodway impact and 7,656 square feet (0.176 acre) of permanent wetland impact.
12. To construct and maintain a 36-foot-long, 36-inch diameter culvert extension carrying a perennial unnamed tributary to the Neshaminy Creek (WUS-10, WWF-MF) due to the reconstruction of the Business Route 1 ramp resulting in 59 linear feet (652 square feet, 0.015 acre) of permanent watercourse impact, 5,395 square feet (0.124 acre) of permanent floodway impact, 18 linear feet (183 square feet, 0.004 acre) of temporary watercourse impact and 1,980 square feet (0.045 acre) of temporary floodway impact. This activity also includes the placement of rock riprap apron.
13. To place fill and construct a stormwater facility within two (2) wetlands (WET-18, WET-19, PEM) located at the Business Route 1 ramp resulting in 2,255 square feet (0.052 acre) of permanent wetland impact.
Overall, this project will result in a total of 1,224 linear feet (38,116 square feet, 0.875 acre) of permanent watercourse impact and 13,016 square feet (0.299 acre) of permanent wetland impact with off-site mitigation associated for both S.R. 0001 Section RC1 (DEP Permit No. E09-1012) and Section RC2 located at Bensalem High School. Mitigation efforts include the removal of a partially breached dam, the relocation/restoration of 1,482 linear feet of an unnamed tributary to Neshaminy Creek (WUS-M1, WWF-MF) and a minimum creation/restoration of 1.37 acre of floodplain wetlands. In addition, efforts include mitigation for 0.307 acre of existing wetlands impacted by proposed mitigation construction activities. This project is located between the Rockhill Drive Interchange and Penndel Interchange in Bensalem and Middletown Townships, Bucks County (USGS PA Langhorne Quadrangle—Latitude 40.136456 N, Longitude 74.962950 W).

The applicant is seeking Department consent to excavate and recoat approximately 50 feet of a 24-inch gas pipeline crossing West Branch Whitney Creek and place timber matting to temporarily cross a wetland for access. Department water quality designation for West Branch Whitney Creek is Exceptional Value (EV), Natural Trout Reproduction. There will be one (1) wetland crossing and two (2) stream crossings utilizing timber matting to access the project site. All disturbance will be within the existing pipeline right-of-way and will be restored to its original contours. The total disturbed area for this project is 0.47 acre. The total impact area of the wetland is 936 square feet. Proposed crossing methods will be temporary, maintain existing hydrology to downstream/downslope aquatic resources and will not result in a significant loss of functional value within these resources. Post construction restoration efforts will restore and functions that are lost during the construction of the pipeline.

The applicant is proposing to expand the Houtzdale oil and propane business along SR 53 in Woodward Township. If approved, the project will result in 0.15 acre of permanent wetland impact. The palustrine emergent wetland is not considered exceptional value and no known threatened or endangered species inhabit the resource. Mitigation for the impact will be completed onsite by converting 0.15 acre of upland to wetland. The mitigation area plus the adjacent natural wetland will be protected by a deed restriction.

1. 221 linear feet of R-6 riprap for stream and bank stabilization of an unnamed tributary to Towanda Creek (CWF, MF) (Powell, PA Quadrangle, Latitude: 41° 41` 43", Longitude: -76° 35` 54").
The project will result in 221 linear feet or 6,788 square feet of stream impacts all for the purpose of installing R-6 riprap for stream and bank stabilization in Franklin Township, Bradford County.
