LAND RECYCLING AND
ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 3
The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Dominguez Residence, 2946 Owego Turnpike, Paupack Township, Wayne County. Crawford Environmental Services, 20 Cardinal Drive, Birdsboro, PA 19508, on behalf of Firmstone Oil Company, 411 High Street, Honesdale, PA 18431, submitted a Final Report concerning remediation of soil contamination caused by a release of heating oil from an aboveground storage tank. This general permit was originally issued to P.H. Glatfelter Company on September 19, 2011 for the beneficial use of carbonaceous wastes: (i) petroleum coke, (ii) uncontaminated and untreated wood chips generated during the pulp and/or paper making process, and (iii) other paper and wood industry wastes comprised of primarily wood fibers, and tire-derived fuel as (1) alternative fuels to be combined with waste coal/coal for circulating fluidized bed (CFB) boilers; (2) structural fill; (3) soil substitute or soil additive; (4) at coal mining activity sites; (5) at abandoned surface mining sites; and (6) other beneficial uses. This Determination of Applicability was reissued by the Department on November 6, 2019.

11-00412: Fuel Recovery, Inc. (254 Interpower Drive, Colver, PA 15927). In accordance with 25 Pa. Code § 127.431, the Department of Environmental Protection (DEP) is providing notice that on July 1, 2019, DEP issued a renewed State Only Operating Permit to Fuel Recovery, Inc. for the operation of a coal preparation plant, known as the Sonman Refuse Site, located in Portage Township, Cambria County.
The facility contains air contamination sources consisting of screens, conveyers, stockpiles, truck unloading and loading operations, and a 92-bhp diesel engine. Air pollution prevention equipment at the facility includes enclosures, minimization of drop height, and a water truck for the plant roads.
No emission or equipment changes have been approved by this action. Emission sources at the facility are subject to 40 CFR Part 60, Subparts A and Y, 40 CFR Part 63, Subparts A and ZZZZ, and 25 Pa. Code Chapters 121—145. The permit includes emission limitations, and operational, monitoring, reporting and recordkeeping requirements for the facility. The emission restriction, monitoring, recordkeeping, reporting and work practice conditions of the SOOP have been derived from the applicable requirements of 40 CFR Parts 60 and 70 and 25 Pa. Code, Article III, Chapters 121—145.

10-00325: Butler VA Health Care System (325 New Castle Rd, Butler, PA 16001), on November 7, 2019, the Department issued the renewal of the State-Only Operating Permit of a healthcare institution located in Butler Township, Butler County. Permitted air contamination sources are three gas-fired/oil-fired boilers, seven emergency diesel generators, miscellaneous natural gas-fired boilers and process heaters, a solvent part water, and a gasoline storage tank. The facility is a Natural Minor and an area source for permitting and MACT purposes. The gas-fired/oil-fired boilers are subject to 40 CFR 60 Subpart Dc but exempt from 40 CFR 63 Subpart JJJJJJ. The seven diesel generators are subject to 40 CFR 60 Subpart IIII. Two of the gas-fired/oil-fired boilers and all diesel generators are subject to 15-ppm sulfur content limit for diesel fuel, pursuant to PA 10-325A and 60 Subpart IIII, respectively. In this renewal, applicable changes in 25 Pa. Code § 123.22 as amended in 2013 are incorporated into the operating permit. Operating hour restrictions are added for the gas-fired/oil-fired boilers to assure exemption from 40 CFR 63 Subpart JJJJJJ. With the exception of 60.48c(g), 60 Subpart Dc is streamlined out by § 123.22 and PA 10-325. Source test submittals are revised based on Source Testing Section's latest instructions.

SOOP-63-00147: International Paper Company (10 Wilson Road, Eighty-Four, PA 15330-2846). Per 25 Pa. Code § 127.449(i), this notice is for the following de minimis emission increase at International Paper Company located in North Strabane Township, Washington County: This project is for the continued operation of one Maren paper shredder and one paper hogger in SOOP-63-00147 controlled by an existing cyclone and baghouse system. The emission increase resulting from this project will not exceed 0.60 TPY PM-10 on a 12-month rolling basis for both units. This project will not trigger the requirements of 25 Pa. Code Subchapter G at the facility. The list of de minimis increases for this facility includes only this project.

03-00027: Keystone—Conemaugh Projects, LLC—Keystone Generating Station (313 Keystone Drive, Shelocta, PA 15774) for its facility located in Plumcreek Township, Armstrong County. The De minimis emission increase is for the proposed modification of throughput limits for Source 106. In addition, this source is exempt from plan approval as it complies with 25 Pa. Code § 127.14(a)(8). The Department hereby approves the De minimis emission increase. The following table is a list of the De minimis emission increases as required by 25 Pa. Code § 127.449(i). This list includes the De minimis emission increases since the Operating Permit issuance on April 29, 2015.

The Pennsylvania Department of Transportation (PennDOT) is proposing to remove an existing 40.8-foot long, 6-foot by 3-foot concrete box culvert and in its place, construct and maintain a 113-foot long, 16-foot by 4-foot single cell precast concrete box stream enclosure carrying Minster Creek (TSF-MF). This activity will result in 161 linear feet (6,202 square feet, 0.14 acre) of permanent stream impact, 38 linear feet (608 square feet, 0.03 acre) of temporary stream impact, 235 linear feet (23,500 square feet, 0.54 acre) of permanent floodway impact which includes grading and bank repair downstream of proposed stream enclosure and 52 linear feet (5,200 square feet, 0.120 acre) of temporary floodway impact due to access and erosion and sediment control measures. Wetland impacts include 135 square feet (0.017 acre) of permanent and 448 square feet (0.010 acre) of temporary wetland impacts to two (2) PEM wetlands. There are two additional activities within project boundary which include the construction and maintenance of a new 48-inch diameter outfall with placement of riprap rock apron located downstream of the proposed PennDOT stream enclosure and also the removal of an abandoned driveway pipe culvert upstream of the proposed PennDOT stream enclosure. Impacts to resources are accounted for within the permanent floodway and stream impacts stated above.
The overall project will result in 16,123 square feet (0.370 acre) of floodplain impact and is located approximately 280 feet north of the N. Charlotte Street and Swamp Pike intersection in New Hanover Township, Montgomery County (USGS PA Sassamansville Quadrangle—Latitude 40.300076 N, Longitude 75.584671 W).

2) To remove and relocate an existing stormwater outfall along the western bank of Jordan Creek (TSF, MF) consisting of two (2) 60-inch diameter reinforced concrete pipes, concrete endwall, and a 25-foot long, 50-foot wide R-8 riprap apron.
3) To remove and relocate an existing sanitary sewer line within the floodway of Jordan Creek (TSF, MF) consisting of a 61-LF, 24-inch diameter pipe and two (2) concrete manholes.
4) To remove and relocate an existing stormwater outfall along the eastern bank to Jordan Creek (TSF, MF) consisting of a 54-inch diameter reinforced concrete pipe, concrete endwall, and a 24-foot long, 20-foot wide R-8 riprap apron.
5) To remove and relocate an existing water line crossing of Jordan Creek (TSF, MF) consisting of approximately 106-LF of 8-inch diameter ductile iron pipe fastened to the bridge decking.

The following plans and reports were submitted under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).
Provisions of 25 Pa. Code Chapter 245 Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

Operating Permit 39-00004: Approval of a Reasonably Available Control Technology (RACT II) plan for Mack Trucks, Inc. located in Lower Macungie Township, Lehigh County.
In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection has made a preliminary determination to approve a RACT II plan and an amendment to the State Implementation Plan (SIP) for the mobile equipment manufacturing surface coating operations owned and operated by Mack Trucks, Inc. located in Lower Macungie Township, Lehigh County.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997, 2008, and 2015 National Ambient Air Quality Standard (NAAQS) for ozone.
The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (39-00004) for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal.

The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT approval for the facility, which are intended to satisfy the requirements for the 1997, 2008 and 2015 National Ambient Air Quality Standard (NAAQS) for ozone.
The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (54-00041) for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal.
The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:
Source RACT II Requirement 101—Milling/Screening and 102—Filter Presses Volatile Organic Compounds. The permittee will limit VOC emissions to < 83.3 tons/year combined for both source ID's. The permittee will maintain records as required by TVOP 54-00041 for Source ID 101 and ID 102—Group 2. Persons wishing to file a written protest or provide comments or request a public hearing, which they believe should be considered prior to the issuance of a permit, may submit the information to Mr. Mark Wejkszner, Air Quality Program Manager, Northeast Regional Office, 2 Public Square, Wilkes-Barre, PA 18701-1915. A 30-day comment period from this date of publication in the Pennsylvania Bulletin will exist for the submission of comments, protests and hearing request. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed RACT II Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the proposed RACT II Plan. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or the Pennsylvania Bulletin or by telephone, where DEP determines such notification is sufficient. E09-1036: Pennsylvania Department of Transportation Engineering District 6-0, 7000 Geerdes Blvd., King of Prussia, PA 19406, Bensalem and Middletown Townships, Bucks County, ACOE Philadelphia District.
The Pennsylvania Department of Transportation District 6-0 (PennDOT 6-0) is proposing to perform the following water obstruction and encroachment activities within an unnamed tributary to Neshaminy Creek (WWF-MF) as well as the main branch of Neshaminy Creek (WWF-MF) associated with the S.R. 0001 Section RC2 Improvement Project:
1. To construct and maintain a 90-foot-long, 42-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-19, WWF-MF). This activity is associated with the reconstruction of the Rockhill Drive Interchange, including the placement of rock riprap apron and rock barriers resulting 142 linear feet (1,412 square feet, 0.032 acre) of permanent watercourse impact and 7,284 square feet (0.167 acre) of permanent floodway impact.
2. To place fill within a perennial unnamed tributary to Neshaminy Creek (WUS-20, WWF-MF) in association with the reconstruction of the Rockhill Drive Interchange resulting in 84 linear feet (463 square feet, 0.011 acre) of permanent watercourse impact and 9,273 square feet (0.212 acre) of permanent floodway impact. This activity also includes the placement of rock barriers.
3. To construct and maintain a 95-foot-long, 42-inch diameter stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-18, WWF-MF) associated with the reconstruction of the Rockhill Drive Interchange including the placement of rock riprap apron resulting in 132 linear feet (1,336 square feet, 0.031 acre) of permanent watercourse impact and 17,854 square feet (0.410 acre) of permanent floodway impact.
4. The construction of the 95-foot-long, 42-inch diameter RCP stream enclosure extension (WUS-18, WWF-MF) includes the loss of hydrology to a wetland (WET-16, PEM) and will result in 1,601 square feet (0.037 acre) of permanent wetland impact.
5. To construct and maintain a 51-foot-long, double 42-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-15, WWF-MF), reconstruct and maintain an existing headwall, perform grading for drainage improvements, including the placement of rock riprap aprons and rock barriers associated with the reconstruction of the Rockhill Drive Interchange resulting in 149 linear feet (2,923 square feet, 0.067 acre) of permanent watercourse impact, 13,229 square feet (0.304 acre) of permanent floodway impact, 256 linear feet (2,576 square feet, 0.059 acre) of temporary watercourse impact and 12,758 square feet (0.293 acre) of temporary floodway impact.
6. To construct and maintain a 24-inch outfall carrying an intermittent unnamed tributary to Neshaminy Creek (WUS-16, WWF-MF) originating at the pipe outfall from the existing roadway slope associated with the reconstruction of the Rockhill Drive Interchange resulting in 68 linear feet (532 square feet, 0.12 acre) of permanent watercourse impact, 3,288 square feet (0.075 acre) of permanent floodway impact, 10 linear feet (78 square feet, 0.002 acre) of temporary watercourse impact and 4,845 square feet (0.111 acre) of temporary floodway impact. This activity also includes the placement of rock riprap apron and rock barrier.
7. To place fill within a wetland (WET-17, PEM) associated with the reconstruction and road widening of the Rockhill Drive Interchange resulting in 1,504 square feet (0.035 acre) of permanent wetland impact.
8. To construct and maintain a 138-foot-long, 30-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary discharging directly to Neshaminy Creek (WUS-14, WWF-MF) associated with roadway widening of S.R. 0001, existing outfall improvements, a new 12-inch diameter outfall and the placement of riprap rock aprons located adjacent to the northbound approach of the bridge over Neshaminy Creek. This activity will result in 221 linear feet (2,639 square feet, 0.061 acre) of permanent watercourse impact, 249 linear feet (2,522 square feet, 0.058 acre) of temporary watercourse impact with 25,647 square feet (0.589 acre) of permanent floodway impact to Neshaminy Creek (WUS-1) 100-year floodplain and 11,153 square feet (0.256 acre) of temporary floodway impact to Neshaminy Creek (WUS-1) 100-year floodplain.
9. To remove an existing 322.5-foot-long, three 3-span, reinforced concrete arch bridge over the Neshaminy Creek (WUS-1, WWF-MF) and in its place, construct and maintain two (2) 3-span continuous composite prestressed concrete bulb-tee beam bridges as follows:
- 401-foot-long, 3-span S.R. 0001 Section RC2 Southbound Bridge located adjacent to existing bridge location.
- 403-foot-long, 3-span S.R. 0001 Section RC2 Northbound Bridge located at existing bridge location.
This activity will result in 200 linear feet (27,172 square feet, 0.624 acre) of permanent watercourse impact, 117,535 square feet (2.698 acre) of permanent floodway impact and 230 linear feet (43,341 square feet, 0.995 acre) of temporary watercourse impact. In addition, the placement of fill, construction of new bridges and a stormwater facility will result in 10,625 square feet (1.788 acres) of permanent FEMA designated floodway and 100-year floodplain impact. Temporary impact to floodway and watercourse includes the construction and maintenance of three (3) temporary access roads and temporary bridges within the watercourse and floodway/floodplain of the Neshaminy Creek (WUS-1, WWF-MF) for pier removal and construction.
10. To place fill within a perennial unnamed tributary to Neshaminy Creek (WUS-12, WWF-MF) associated with the reconstruction of the Penndel Interchange (both sides of existing S.R. 0001) and the construction of a stormwater facility resulting in 35 linear feet (323 square feet, 0.007 acre) of permanent watercourse impact and 53 linear feet (714 square feet, 0.016 acre) of temporary watercourse impact with 32,716 square feet (0.751 acre) of permanent floodway impact and 3,817 square feet (0.088 acre) of temporary floodway impact to Neshaminy Creek (WUS-1) 100-year floodplain with includes a portion of the floodway of the unnamed tributary.
11. To place fill for grading activities and construct a stormwater facility within two (2) intermittent unnamed tributaries of Neshaminy Creek (WUS-11, WUS-13, WWF-MF) and two (2) wetlands (WET-11A, WET-11B, PFO) associated with the reconstruction of the Penndel Interchange resulting in a total of 134 linear feet (664 square feet, 0.016 acre) of permanent watercourse impact, 25,643 square feet (0.588 acre) of permanent floodway impact and 7,656 square feet (0.176 acre) of permanent wetland impact.
12. To construct and maintain a 36-foot-long, 36-inch diameter culvert extension carrying a perennial unnamed tributary to the Neshaminy Creek (WUS-10, WWF-MF) due to the reconstruction of the Business Route 1 ramp resulting in 59 linear feet (652 square feet, 0.015 acre) of permanent watercourse impact, 5,395 square feet (0.124 acre) of permanent floodway impact, 18 linear feet (183 square feet, 0.004 acre) of temporary watercourse impact and 1,980 square feet (0.045 acre) of temporary floodway impact. This activity also includes the placement of rock riprap apron.
13. To place fill and construct a stormwater facility within two (2) wetlands (WET-18, WET-19, PEM) located at the Business Route 1 ramp resulting in 2,255 square feet (0.052 acre) of permanent wetland impact.
Overall, this project will result in a total of 1,224 linear feet (38,116 square feet, 0.875 acre) of permanent watercourse impact and 13,016 square feet (0.299 acre) of permanent wetland impact with off-site mitigation associated for both S.R. 0001 Section RC1 (DEP Permit No. E09-1012) and Section RC2 located at Bensalem High School. Mitigation efforts include the removal of a partially breached dam, the relocation/restoration of 1,482 linear feet of an unnamed tributary to Neshaminy Creek (WUS-M1, WWF-MF) and a minimum creation/restoration of 1.37 acre of floodplain wetlands. In addition, efforts include mitigation for 0.307 acre of existing wetlands impacted by proposed mitigation construction activities. This project is located between the Rockhill Drive Interchange and Penndel Interchange in Bensalem and Middletown Townships, Bucks County (USGS PA Langhorne Quadrangle—Latitude 40.136456 N, Longitude 74.962950 W).

To reissue Permit No. E46-1012 which authorized the relocation, construction, and maintenance of 956 LF along the unnamed tributary to Mingo Creek (WWF) and the placement of 0.22 acre of fill in the abandon channel to facilitate construction of the retail center (Home Depot). The project is located on the west side of PA Route 100 approximately 1,900 feet southwest of Ridge Pike, west of Township Line (Phoenixville, PA, Quadrangle Lat: 40.214694; Long: -75.50583) in Limerick Township, Montgomery County.

To construct and maintain 120 LF of a 6-inch plastic gas main in and along the assumed 100-year floodway of Crow Creek (WWF, MF) utilizing an open trench method.
The site is located near the intersection of Croton and Knox Roads in a local historic district listed on National Register Historic Places (Tredyffrin, PA USGS map, Lat: 40.064096; -75.397523) in Tredyffrin Township, Chester County.

This request, received May 1, 2019, is entitled Modification Request—Installation Method Change at PA Turnpike/0280 HDD, Upper Uwchlan Township, Chester County. This modification consists of a change in the route and installation method for the 16 and 20-inch diameter pipeline previously permitted as Horizontal Directional Drill (HDD) 280.
The permit modification request is to convert the installation method of both the 16 and 20-inch diameter pipelines from a HDD to an open cut installation and one conventional bore. The change in methodology is to minimize impacts to Waters of the Commonwealth and avoid potential future growth requirements of the PA Turnpike I-76.
The modification includes an additional 4.86 acres of LOD.

This request, received May 14, 2019, is entitled Modification Request for Installation Method Change at HDD S3-0400 Lisa Drive, West Whiteland Township, Chester County. This modification consists of a change in installation method for the 20-inch diameter pipeline previously permitted as Horizontal Directional Drill (HDD) 400.
The permit modification request consists of a change in installation method for 20-inch diameter pipeline from a Horizontal Directional Drill (HDD) to a Direct Pipe Bore and open trench installation. The direct pipe bore will go under the Exton Bypass (State Route 30), AMTRAK (American Track National Railroad Passenger Corporation), Norfolk Southern Railroad, and wetland WL-K21. The remaining 1,269 feet will be installed via open trench installation. The change in installation method will not result in any increase to the permanent impacts to wetland WL-K21 or other waters of the Commonwealth as set forth in the original Chapter 105 authorization.
The modification includes an additional 3.99 acres of LOD.
