LAND RECYCLING AND
ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department Has Taken Action on the Following Plans and Reports Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The City of Philadelphia, Air Management Services (AMS) intends to issue a Plan Approval for installation of air pollution sources at the following facility:
IP20-000032: Amtrak 30th Street Station (2955 Market Street, Philadelphia, PA 19104) for the installation of boilers and air handling units at a railroad station, in the City of Philadelphia, Philadelphia County. The following significant stationary air emission sources are part of the Plan Approval: two (2) boilers firing No. 2 oil rated 0.31 MMBtu/hr and 3.50 MMBtu/hr, three (3) boilers firing natural gas each rated less than or equal to 1 MMBtu/hr, and one (1) air handling unit firing natural gas rated 3.025 MMBtu/hr. Additionally, two (2) insignificant boilers firing No. 2 oil each rated less than 0.25 MMBtu/hr are also included in the Plan Approval for facility-wide emission calculation, and they are required to follow the applicable requirements in the Plan Approval. The potential emission from the installation are as follows: (1) 5.03 tons per year (tpy) of Nitrogen Oxides (NOx), (2) 2.65 tpy of Carbon Monoxide (CO), (3) 0.45 tpy of Particulate Matter (PM), (4) 0.175 tpy of Volatile Organic Compound (VOC), and (5) 0.043 tpy of Sulfur Oxides (SOx). The plan approval will contain operating, monitoring, recordkeeping, and reporting requirements to ensure operation within all applicable requirements.
The plan approval will be issued under 25 Pa. Code, Philadelphia Code Title 3 and Air Management Regulation XIII. Persons wishing to file protest, comments, or request a public hearing on the above plan approval must submit the protest, comments or request for a public hearing within 30 days from the date of this notice. Based upon the information received during the public comment period, AMS may modify the plan approval or schedule a public hearing. The hearing notice will be published in the Pennsylvania Bulletin and a local newspaper at least thirty days before the hearing.

(5 Steel Road East, Morrisville, PA 19067-3613) natural minor operating permit on March 16, 2020, the Department of Environmental Protection authorized an initial natural minor State-only operating permit for a facility that blends and mixes nitrogen stabilizers and guar slurry and is located in Everson Borough, Fayette County. The permit includes operating requirements, monitoring requirements, work practice standards, and recordkeeping requirements for the site.

25-00066: Accuride Erie LP (1015 E 12th St, Erie, PA 16503-1520). On March 23, 2020, the Department issued the renewal State Only Natural Minor Operating Permit for operation of the aluminum truck wheel forging facility located in the City of Erie, Erie County. The facility's primary emission sources include three forging lines and associated sources, various natural gas-fired process and comfort heating sources, various finishing operations, and the emergency generators and fire pump. The potential emissions of the primary pollutants from the facility are as follows: 44.61 TPY (tons per year) NOx, 82.69 TPY CO, 16.59 TPY VOC, 63.16 TPY filterable PM-10, 62.07 TPY filterable PM-2.5, and 6.13 TPY SOx; thus, the facility is a natural minor. The facility was previously a synthetic minor, but various changes at the facility since the 2014 renewal has reduced the facility's potential emissions below Title V thresholds. The emergency fire pump is subject to 40 CFR 60 Subpart IIII, Standards of Performance for Stationary Compression Ignition Internal Combustion Engines. Two of the emergency generators are subject to 40 CFR 63 Subpart ZZZZ, NESHAP for Stationary Reciprocating Internal Combustion Engines. The renewal permit contains a compliance schedule for Forge Lines 5 and 6. The renewal permit contains emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

15-00010: ArcelorMittal Plate, LLC (139 Modena Road, Coatesville, PA 19320-4036), on March 18, 2020 for an Administrative Amendment to revise the Title V Operating Permit for this facility located in the City of Coatesville, Chester County. The permit was revised to remove instantaneous limits that were added in the renewal permit issued on October 3, 2020 because instantaneous limits cannot be enforced on sources that do not operate on a steady-state basis. Monthly limits for nitrogen oxides and volatile organic compounds replaced the instantaneous limits for Source ID No. 104 to comply with the case-by-case requirements of RACT II. The emission limit for Source ID No. 250 was increased to reflect the full operation of the plant when performing Identification Marking. The language of the permit was revised for notification of additions and removal of insignificant sources natural gas using sources from the plant. Redundancies in permit conditions were removed.
46-00045: PECO Energy Company (300 Front St., Bldg. 3, West Conshohocken, PA 19428-12723) on March 19, 2020 for an Administrative Amendment to their Title V Operating Permit (TVOP) for a gas plant in West Conshohocken Borough, Montgomery County.
The revisions from the Administrative Amendment included the following changes:
• Incorporated conditions for the exempted source (UPS System Emergency Generator (Source ID: 105)) installed under RFD No. 7900.
• Restored the applicable conditions requirements from a previously issued TVOP for the Katolight Emergency Generator (Source ID: 104).
• Incorporated the requirements of 25 Pa. Code § 129.62(a) to replace the provisions of 25 Pa. Code § 129.82 for the Gasoline Storage Tank (2,000 Gallons) (Source ID: 103).
The amended Title V Operating Permit will contain applicable monitoring, recordkeeping, reporting and work practice standards to keep the facility operating within all applicable air quality requirements.
The facility is not subject to Compliance Assurance Monitoring (CAM) pursuant to 40 CFR Part 64. The Administrative Amendment of Title V Operating Permit for this facility is issued under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code § 127.450.
46-00172: Gemalto, Inc. (101 Park Drive, Montgomeryville, PA 18936) on March 19, 2020 is a Synthetic Minor facility located in Montgomery Township, Montgomery County. The operating permit was amended to incorporate the requirements of Plan Approval 46-0172F into the facility's State Only Operating Permit, 46-00172, and to eliminate several removed sources from Permit 46-00172. This Administrative Amendment is issued in accordance with the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code § 127.450.

For the purpose of constructing a residential housing development on 28.7 acres of a 40.3-acre parcel. A total of 596 linear feet of UNTs to Montour Run (TSF) will be permanently impacted. A total of 0.092 acre of PEM wetlands will be permanently impacted.
The project site is located at Garden Lane (Oakdale, PA USGS topographic quadrangle; N: 40°, 27`, 42"; W: 80°, 12`, 54"; Sub-basin 20G; USACE Pittsburgh District), in Findlay Township, Allegheny County.
Mitigation of stream impacts will be performed at the Wilhelm property and the Hollow Oak Land Trust property. A total of 1,060 linear feet of Meeks Run (TSF) will be enhanced with stream stabilization structures, bank layback & planting, and bank armor. Wetland impacts will be mitigated on site. Construction of 0.114 acre of PEM/PSS is proposed.
The mitigation site is located near Hassam Road (Oakdale, PA USGS topographic quadrangle; N: 40°, 29`, 28.2"; W: -80°, 10`, 26.4"; Sub-basin 20G; USACE Pittsburgh District), in Moon Township, Allegheny County.

The project permanently impacts 68 LF, and temporarily impacts 94 LF of the UNT to Monongahela River.
For the purpose of replacing the deteriorating structure.
The project site is located near the intersection of Ridge Road and Main Street, (California, PA USGS topographic quadrangle; N: 40°, 0`, 18.3361"; W: 79°, 56`, 5.7515"; Sub-basin 19C; USACE Pittsburgh District), in Centerville, Borough, Washington County.

The proposed pipeline project starts approximately 0.1 mile south of Liveasy Road, Cumberland Township, Greene County (Masontown, PA Quadrangle N: 39° 51` 41.67"; W: 79° 56` 31.97") and ends at the future Hill Top Energy Center Power Plant approximately 0.4 mile east of Thomas Road, Cumberland Township, Greene County (Carmichaels, PA Quadrangle N: 39° 53` 33.17"; W: 79° 55` 55.17").
The proposed project includes 518 linear feet of permanent impacts and 125 linear feet of temporary impacts to UNTs to Monongahela River (WWF), UNTs to Little Whiteley Creek (WWF), UNTs to Pegs Run (WWF) and a UNT to Glade Run (WWF), permanent impacts to 1.10 acre of floodway, 0.12 acre of permanent PEM wetland impacts, and 0.04 acre of temporary PEM wetland impacts. Mitigation will include restoring the disturbed area back to its original condition and elevation and stabilizing the disturbed area.

To remove the existing structure and to construct and maintain a 131.75-ft long single-cell precast concrete box culvert having a 12.0-ft wide by 10.0-ft high waterway opening on SR 0028, Section 554, Segment 0170, Offset 0000 over Clement Run (CWF) and to temporarily install and maintain a temporary roadway immediately upstream of the existing structure to maintain traffic during construction of the proposed structure. Adjustments to the proposed culvert length and alignment will result in the permanent loss of 39.0-ft of stream channel. Additionally, the project will result in the slight relocation of a 95-ft section of Clement Run downstream of the proposed structure, for which the applicant proposes stream mitigation and enhancements to offset the loss of stream length. The project will result in a total of 188-ft of permanent stream impacts and 450-ft of temporary stream impacts to Clement Run. No wetland impacts are proposed.

To conduct the following activities associated with the widening and realignment of approximately 1.6 mile of SR 0228-270 extending west from its intersection with S.R. 8:
1. Construct and maintain a 228-foot long, 18-foot wide by 8-foot high (7-foot effective w/ invert depression and baffles) single cell pre-cast concrete box stream enclosure in a tributary to Glade Run at Station 287+80 and to realign a total of 228 feet of the stream channel extending approximately 140 feet upstream and 88 feet downstream of the structure.
2. Construct and maintain an 88.7-foot wide steel plate girder bridge on integral abutments providing a normal span of 165.15 feet and minimum underclearance of 15.65 feet across Glade Run at station 294+40 and to realign approximately 130 feet of the channel of Glade Run at approximately station 291+30 LT associated with the construction of the approach fill to the bridge.
3. Construct and maintain a 207-foot long, 14-foot wide by 10-foot high (9-foot effective w/ invert depression and baffles) single cell pre-cast concrete box stream enclosure in a tributary to Glade Run at station 326+10 and to realign a total of 906 feet of the channel extending approximately 125 feet upstream and 781 feet downstream of the structure.
4. To construct and maintain a 89-foot long, 24-foot wide by 10-foot high (9-foot effective w/ invert depression and baffles) single cell pre-cast concrete box culvert in a tributary to Glade Run on Park Road and to realign a total of approximately 544 feet of the channel of a tributary to Glade Run extending 419 downstream and 125 feet upstream from the structure.
5. To place fill within the floodplain of tributary to Glade Run to maintain private driveway access from Park Road starting at station 104+20.
6. To remove the existing structure and to construct and maintain a 120-foot long, 36-inch diameter reinforced concrete pipe carrying tributary to Glade Run (Stream 13) at Station 344+90, with an outfall and rock apron discharging to tributary to Glade Run (UNT 7) and to place fill within the floodplain of UNT 7 as part of the proposed roadway fill slope.
7. To permanently fill a 0.23-acre pond at station 203+50 along a relocated section of Harbison Road to accommodate the new roadway alignment.
8. To remove the existing concrete arch from a tributary to Glade Run at station 154+10 on the existing S.R. 228 alignment.
9. To remove the existing concrete slab bridge across Glade Run at station 184+50 on the existing S.R. 228 alignment.
10. To permanently impact a total of 1.216 acre of wetlands.
11. To temporarily impact a total of 0.137 acre of wetlands.
The project will result in a total of 3,311-feet of permanent impacts to existing stream channel, which includes 613-feet of proposed structure length. The applicant proposes 1,813-feet of stream relocation and 2,602-feet of stream improvements within the corridor as stream mitigation. A total of 721-feet of temporary stream impacts are proposed during construction. Existing structures will be removed, and areas of existing roadway not required for the new alignment will be restored to vegetated conditions. The applicant proposes to create a total of 2.35-acres of wetland onsite to mitigate the permanent wetland impacts.

The project is located on Park Avenue (SR 1001) approximately 0.15 mile north of its intersection with Hogue Road. The project will permanently impact approximately 150 linear feet of the UNT to French Creek. No wetland impacts are proposed.

The following plans and reports were submitted under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).
Provisions of 25 Pa. Code Chapter 245 Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. The DEP has taken action on the following plans and reports under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).
Provisions of 25 Pa. Code Chapter 245 Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports.
A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.
The DEP may approve or disapprove plans and reports submitted. This notice provides the DEP's decision and, if relevant, the basis for disapproval.

PUBLIC NOTICE OF FINAL STATE WATER QUALITY CERTIFICATION FOR FERC
REGULATED PIPELINE PROJECT
Final State Water Quality Certification Required by Section 401 of the Clean Water Act for the Hill Top Pipeline.

WQ30052-025, Equitrans, L.P., 2200 Energy Drive, Canonsburg, PA 15317. Hill Top Pipeline (Project), in Cumberland Township, Greene County, in the ACOE Pittsburgh District. The proposed pipeline project starts approximately 0.1 mile south of Liveasy Road, Cumberland Township, Greene County (Masontown, PA Quadrangle N: 39° 51` 41.67"; W: -79° 56` 31.97") and ends at the future Hill Top Energy Center Power Plant approximately 0.4 mile east of Thomas Road, Cumberland Township, Greene County (Carmichaels, PA Quadrangle N: 39° 53` 33.17"; W: -79° 55` 55.17").
The Applicant will report the project to Federal Energy Regulatory Commission (FERC) in its annual blanket activities report as authorized under blanket construction certificate (FERC Docket No. CP96-532-000 dated October 20, 1998).
On March 12, 2019, Applicant requested a State water quality certification from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania through compliance with State water quality standards and associated State law requirements, which are consistent with the requirements of the Clean Water Act.
In addition, the Applicant submitted a General Permit Registration Package, seeking acknowledgement fromDEP, of the Applicant's use of General Permits No. 5 and 8 [GP053000219-006 and GP083000219-006], to construct and maintain several utility line stream crossings and temporary road crossings, respectively, in accordance with the Department's Chapter 105 rules and regulations.
The Project, as proposed, includes approximately 15,400 LF long, 12" pipeline for the purpose of transporting natural gas from the existing Equitrans, L.P. D497 transmission line to the future Hill Top Energy Center Power Plant. The Project, as proposed, will require approximately 43.2 acres of earth disturbance and includes 518 linear feet of permanent impacts and 125 linear feet of temporary impacts to UNTs to Monongahela River (WWF), UNTs to Little Whiteley Creek (WWF), UNTs to Pegs Run (WWF) and a UNT to Glade Run (WWF), permanent impacts to 1.10 acre of floodway, 0.12 acre of permanent PEM wetland impacts, and 0.04 acre of temporary PEM wetland impacts. Mitigation will include restoring the disturbed area back to its original condition and elevation and stabilizing the disturbed area.
PADEP published notice of its proposed State Water Quality Certification in the Pennsylvania Bulletin on July 13, 2019 (Pa.B., Vol. 49, No. 28) and received no comments from the public.
PADEP certifies that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP further certifies that the construction, operation and maintenance of the project complies with Pennsylvania water quality standards and that the construction, operation and maintenance of the project does not violate applicable Pennsylvania water quality standards provided that the construction, operation and maintenance of the Project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:
1. Discharge Permit—Applicant shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), and all applicable implementing regulations (25 Pa. Code Chapter 92a).
2. Erosion and Sediment Control Permit—Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102, and all other applicable implementing regulations.
3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601.), 25 Pa. Code Chapter 105, 25 Pa. Code Chapter 106, and all other applicable regulations.
4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Applicant.
5. Operation—Applicant shall properly operate and maintain at all times all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this State Water Quality Certification and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.
6. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or delegated County Conservation District to determine compliance with this SWQC, including all required permits, authorizations and approvals required by this State Water Quality Certification. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.
7. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to DEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.
8. Correspondence—All correspondence with and submittals to PADEP concerning this State Water Quality Certification shall be addressed to the Department of Environmental Protection, Dana Drake, P.E., Program Manager, Waterways and Wetlands Program, 400 Waterfront Drive, Pittsburgh, PA 15222.
9. Reservation of Rights—PADEP may modify, suspend or revoke this SWQC if (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that the Applicant has not complied with the terms and conditions of this SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.
10. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.
11. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of the SWQC shall not be affected thereby.
Any person aggrieved by this action may file a petition for review pursuant to Section 19(d) of the Federal Natural Gas Act (15 U.S.C.A. § 717r(d)), with the Office of the Clerk, United States Court of Appeals for the Third Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790 as provided by law. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law. Important legal rights are at stake, so you should show this document to a lawyer promptly.
