FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State .Water Quality Standards.

2. 3. To install and maintain linear anode adjacent to wetland 3 (PEM) resulting in 1,173 square feet (0.027 acre) of temporary wetland impact due to the placement of timber matting for construction. (USGS PA Downingtown; Wagontown Quadrangle—Latitude 40.40.100740, Longitude 75.750084 W).
4. To construct and maintain a temporary bridge structure over Water 1 (Unnamed tributary to Marsh Creek, HQ-TSF, MF) to facilitate the installation and maintenance of 7 linear feet of anode resulting in 7 linear feet (7 square feet) of permanent watercourse impact, 217 square feet of permanent floodway impact, 136 linear feet (688 square feet) of temporary watercourse impact and 10,149 square feet of temporary floodway impact. 5. To construct and maintain a temporary bridge structure over Water 2 (Unnamed tributary to Marsh Creek, HQ-TSF, MF) to facilitate the installation and maintenance of 7 linear feet of anode resulting in 7 linear feet (7 square feet) of permanent watercourse impact, 136 square feet of permanent floodway impact, 49 linear feet (91 square feet) of temporary watercourse impact and 5,905 square feet of temporary floodway impact. To replace an 8-foot by 7-foot box sewer and outfall. In its place, the Philadelphia Water Department will construct and maintain an 8-foot by 12-foot box sewer within the 100-year floodplain and outfall constructed on piles on the bank of the Delaware River (WWF-MF) resulting in 30 linear feet (45 square feet) of permanent watercourse impact, 40 linear feet (600 square feet) of temporary watercourse impact, 2,100 square feet of permanent floodway impact, and 600 square feet of temporary floodway impact. To perform the following water obstruction and encroachment activities within an unnamed tributary to Neshaminy Creek (WWF-MF) as well as the main branch of Neshaminy Creek (WWF-MF) associated with the S.R. 0001 Section RC2 Improvement Project:
1. To construct and maintain a 95-foot-long, 42-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-19, WWF-MF). This activity is associated with the reconstruction of the Rockhill Drive Interchange including the placement of rock riprap apron and rock barriers resulting 142 linear feet (1,412 square feet, 0.032 acre) of permanent watercourse impact and 7,284 square feet (0.167 acre) of permanent floodway impact. (USGS PA Langhorne Quadrangle—Latitude 40.137788 N, Longitude 74.959769 W).
2. To place fill within a perennial unnamed tributary to Neshaminy Creek (WUS-20, WWF-MF) in association with the reconstruction of the Rockhill Drive Interchange resulting in 84 linear feet (463 square feet, 0.011 acre) of permanent watercourse impact and 9,273 square feet (0.212 acre) of permanent floodway impact. This activity also includes the placement of rock barriers. Also included is the overall operations and maintenance of an existing 423 linear feet 42-inch stream enclosure, 94 linear feet 48-inch culvert, and 645 linear feet 54-inch stream enclosure carrying unnamed tributaries (WUS-19 and WUS-20) to this location. (USGS PA Langhorne Quadrangle—Latitude 40.137755 N, Longitude 74.959582 W).
3. To construct and maintain a 95-foot-long, 42-inch diameter stream enclosure extension carrying a perennial unnamed tributary to Neshaminy Creek (WUS-18, WWF-MF) associated with the reconstruction of the Rockhill Drive Interchange including the placement of rock riprap apron resulting in 132 linear feet (1,336 square feet, 0.031 acre) of permanent watercourse impact and 17,854 square feet (0.410 acre) of permanent floodway impact. (USGS PA Langhorne Quadrangle—Latitude 40.138444 N, Longitude 74.959501 W).
4. The construction of the 95-foot-long, 42-inch diameter RCP stream enclosure extension (WUS-18, WWF-MF) includes the loss of hydrology to a wetland (WET-16, PEM) and will result in 1,601 square feet (0.037 acre) of permanent wetland impact. (USGS PA Langhorne Quadrangle—Latitude 40.138768 N, Longitude 74.959859 W).
5. To construct and maintain a 61-foot-long, double 42-inch diameter RCP stream enclosure extension on an existing 187 linear foot, RCP stream enclosure carrying a perennial unnamed tributary to Neshaminy Creek (WUS-15, WWF-MF), reconstruct and maintain an existing headwall, perform grading for drainage improvements including the placement of rock riprap aprons and rock barriers associated with the reconstruction of the Rockhill Drive Interchange resulting in 149 linear feet (2,923 square feet, 0.067 acre) of permanent watercourse impact, 13,229 square feet (0.304 acre) of permanent floodway impact, 256 linear feet (2,576 square feet, 0.059 acre) of temporary watercourse impact, and 12,758 square feet (0.293 acre) of temporary floodway impact. 6. To construct and maintain a 24-inch, 30 linear foot culvert on an existing 37 linear foot culvert carrying an intermittent unnamed tributary to Neshaminy Creek (WUS-16, WWF-MF) originating at the pipe outfall from the existing roadway slope associated with the reconstruction of the Rockhill Drive Interchange resulting in 68 linear feet (532 square feet, 0.12 acre) of permanent watercourse impact, 3,288 square feet (0.075 acre) of permanent floodway impact, 10 linear feet (78 square feet, 0.002 acre) of temporary watercourse impact, and 4,845 square feet (0.111 acre) of temporary floodway impact. This activity also includes the placement of rock riprap apron and rock barrier. (USGS PA Langhorne Quadrangle—Latitude 40.140186 N, Longitude 74.960915 W).
7. To place fill within a wetland (WET-17, PEM) associated with the reconstruction and road widening of the Rockhill Drive Interchange resulting in 1,504 square feet (0.035 acre) of permanent wetland impact. (USGS PA Langhorne Quadrangle—Latitude 40.139162 N, Longitude 74.959977 W).
8. To construct and maintain a 137-foot-long, 30-inch diameter RCP stream enclosure extension carrying a perennial unnamed tributary discharging directly to Neshaminy Creek (WUS-14, WWF-MF) associated with roadway widening of S.R. 0001, existing outfall improvements, a new 12-inch diameter outfall, and the placement of riprap rock aprons located adjacent to the northbound approach of the bridge over Neshaminy Creek. This activity will result in 221 linear feet (2,639 square feet, 0.061 acre) of permanent watercourse impact, 184 linear feet (1,913 square feet, 0.044 acre) of temporary watercourse impact with 25,647 square feet (0.589 acre) of permanent floodway impact to a tributary of Neshaminy Creek (WUS-14) which includes the construction and maintenance of a 362 foot long retaining wall. Impacts also include 8,806 square feet (0.202 acre) of temporary impact to the floodway of WUS-14 and a portion of Neshaminy Creek (WUS-1) 100-year floodplain. (USGS PA Langhorne Quadrangle—Latitude 40.144788 N, Longitude 74.954429 W).
9. To remove an existing 322.5-foot-long, three 3-span, reinforced concrete arch bridge over the Neshaminy Creek (WUS-1, WWF-MF) and in its place, construct and maintain two (2) 3-span continuous composite prestressed concrete bulb-tee beam bridges as follows:
a) 401.5-foot-long, 3-span S.R. 0001 Section RC2 Southbound Bridge located adjacent to existing bridge location.
b) 403-foot-long, 3-span S.R. 0001 Section RC2 Northbound Bridge located at existing bridge location.
This activity will result in 200 linear feet (27,172 square feet, 0.624 acre) of permanent watercourse impact, 121,320 square feet (2.785 acres) of permanent floodway impact which includes the construction and maintenance of a 163-foot-long retaining wall and is considered an appurtenant structure of the bridge. There is 230 linear feet (53,468 square feet, 1.227 acre) of temporary watercourse impact. In addition, the placement of fill, construction of new bridges, and a stormwater facility will result in 107,750 square feet (2.474 acres) of permanent FEMA designated floodway and 100-year floodplain impact. Temporary impact to floodway and watercourse includes the construction and maintenance of three (3) temporary access roads and temporary bridges within the watercourse and floodway/floodplain of the Neshaminy Creek (WUS-1, WWF-MF) for pier removal and construction. 10. To place fill within a perennial unnamed tributary to Neshaminy Creek (WUS-12, WWF-MF) associated with the reconstruction of the Penndel Interchange (both sides of existing S.R. 0001) and the construction of a stormwater facility and extension of 11 linear feet, 30-inch culvert on an existing 265 linear foot, 36-inch RCP stream enclosure and additional 36 linear foot extension resulting in 83 linear feet (614 square feet, 0.014 acre) of permanent watercourse impact and 30 linear feet (358 square feet, 0.008 acre) of temporary watercourse impact with 6,412 square feet (0.147 acre) of permanent floodway impact and 1,378 square feet (0.032 acre) of temporary floodway impact. 11. To place fill for grading activities and construct a stormwater facility within two (2) intermittent unnamed tributaries of Neshaminy Creek (WUS-11, WUS-13, WWF-MF) and two (2) wetlands (WET-11A, WET-11B, PFO) associated with the reconstruction of the Penndel Interchange resulting in a total of 134 linear feet (664 square feet, 0.016 acre) of permanent watercourse impact, 25,643 square feet (0.588 acre) of permanent floodway impact, and 7,656 square feet (0.176 acre) of permanent wetland impact. (USGS PA Langhorne Quadrangle—Latitude 40.149784 N, Longitude 74.950388 W).
12. To construct and maintain a 36-foot-long, 48-inch diameter culvert extension carrying a perennial unnamed tributary to the Neshaminy Creek (WUS-10, WWF-MF) due to the reconstruction of the Business Route 1 ramp resulting in 59 linear feet (652 square feet, 0.015 acre) of permanent watercourse impact, 5,395 square feet (0.124 acre) of permanent floodway impact, 18 linear feet (183 square feet, 0.004 acre) of temporary watercourse impact, and 1,980 square feet (0.045 acre) of temporary floodway impact. This activity also includes the placement of rock riprap apron. (USGS PA Langhorne Quadrangle—Latitude 40.149429 N, Longitude 74.949357 W).
13. To place fill and construct a stormwater facility within two (2) wetlands (WET-18, WET-19, PEM) located at the Business Route 1 ramp resulting in 2,255 square feet (0.052 acre) of permanent wetland impact. (USGS PA Langhorne Quadrangle—Latitude 40.150754 N, Longitude 74.947826 W).
14. To place fill associated with the placement of a construction within a wetland (WET-20, PEM) located at the Business Route 1 ramp resulting in 3,745 square feet (0.086 acre) of permanent wetland impact. (USGS PA Langhorne Quadrangle—Latitude 40.151670 N, Longitude 74.946670 W).
Overall, this project will result in a total of 1,224 linear feet (38,407 square feet, 0.882 acre) of permanent watercourse impact and 16,671 square feet (0.385 acre) of permanent wetland impact with off-site mitigation associated for both S.R. 0001 Section RC1 (DEP Permit No. E09-1012) and Section RC2 located at Bensalem High School. Mitigation efforts include the removal of a partially breached dam, the relocation/restoration of 1,482 linear feet of an unnamed tributary to Neshaminy Creek (WUS-M1, WWF-MF) and a minimum creation/restoration of 1.37 acre of floodplain wetlands. In addition, efforts include mitigation for 0.307 acre of existing wetlands impacted by proposed mitigation construction activities. This project is located between the Rockhill Drive Interchange and Penndel Interchange in Bensalem and Middletown Townships, Bucks County. To remove two (2) existing 111-foot long, two span bridge structures over the former Contrail corridor and in its place, to construct and maintain roadway on fill with 64-foot cartway width and sidewalks resulting in the impact of a wetland area (PEM) with a total of 9,586 square feet (0.220 acre) of permanent direct impact and 7,747 square feet (0.178 acre) of temporary direct impact. Along with this activity, the construction and maintenance of three (3) 36-inch reinforced concrete pipes will provide hydrologic connection through the roadway fill. To remove the existing structure and to construct and maintain a roadway carrying SR 4016 over Reyburn Creek (CWF, MF) consisting of a 70.5-foot long, closed bottom, precast concrete box culvert depressed 12-inches below the existing streambed elevation having a 8-foot span and a 5-foot underclearance, fish baffles, precast concrete headwalls and rip rap aprons. Fill will be placed within the floodway of an existing tributary to Reyburn Creek (CWF, MF) due to an increase in the width of the roadway. The tributary will be realigned for approximately 147 linear feet in order to connect the watercourse to the upstream side of the new culvert. In addition, R-4 rip rap bank stabilization will be placed along the tributary to Reyburn Creek and immediately upstream and downstream of the Reyburn Creek culvert replacement.
Approximately 0.02 acre of PEM/PSS wetland will be permanently impacted due to the project. The project is located along S.R. 4016 Sect D01 Seg 0140, Off 1484 (Shickshinny Quadrangle, Latitude: 41° 13` 48.17" N; Longitude: 76° 09` 23.75" W) in Union Township, Luzerne County.

The Department of Environmental Protection (Department) approved the Westmoreland County Municipal Waste Management Plan Revision on April 8, 2020.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. WATER MANAGEMENT
Proposed Total Maximum Daily Load (TMDL) for the Pleasant Valley Run Watershed in Bedford County.

The Department of Environmental Protection will accept comments on the proposed TMDLs developed for the Pleasant Valley Run Watershed in Bedford County. The TMDLs were established in accordance with the requirements of Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included impaired stream segments in the watershed. The listings of these segments were due to aquatic life use impairments caused by excessive siltation and nutrients from agriculture and/or crop-related agriculture.
There currently are no State or Federal in-stream numerical water quality criteria for sediment or nutrients. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. The proposed TMDL document sets allowable loading of sediment and nutrients in the Pleasant Valley Run Watershed. The TMDLs included allocations for nonpoint sources, reserves for future point sources, as well as margin of safety factors. Nonpoint source load allocations were made for cropland, hay/pasture land, streambank and farm animal source sectors present in the watershed. Data used in establishing the TMDL were generated using a water quality analysis model (Model My Watershed) made available through the Stroud Water Research Center.
