FEDERAL WATER POLLUTION
CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

 Any person aggrieved by these actions may appeal, pursuant to Section 4 of the Environmental Hearing Board Act, 35 P.S. Section 7514, and the Administrative Agency Law, 2 Pa.C.S. Permits, Environmental Assessments and 401 Water Quality Certifications Issued:

Southeast Region: Waterways and Wetlands Program Manager, 2 East Main Street, Norristown, PA 19401.

Permit No. E46-1196, Limerick Partners I, LP, Meetinghouse Business Center, Suite 120, Plymouth Meeting, PA 19462, Limerick Township, Montgomery County, ACOE Philadelphia District.

 To place 0.22 acre of fill within and along 956 linear feet of an unnamed tributary to Mingo Creek (WWF-MF) to facilitate the construction of the Limerick Common—Home Depot Project parking lot and access. To mitigate for stream loss, the applicant is proposing relocate, construct, and maintain 956 linear feet of new stream channel which includes a step-pool section, riffle-pool section, and roughened bedrock bottom section before entering an existing roadway culvert under West Ridge Pike. These activities will result in 956 linear feet (8,537 square feet) of permanent watercourse impact which includes 50-foot regulated permanent floodway impact. This is a reissuance of permit No. E46-1012 that expired and was originally issued on May 30, 2008. Project scope and impacts remain the same and is located on the west side of PA Route 100 approximately 1,200 feet NW of the West Ridge Pike and North Township Line Intersection in Limerick Township, Montgomery County (USGS PA Phoenixville Quadrangle—Latitude 40.216628 N, Longitude 75.505581 W). Permit issued April 3, 2020.

Permit No. E09-1033, Pennsylvania Department of Transportation, Engineering District 6-0, 7000 Geerdes Boulevard, King of Prussia, PA 19406, Warrington Township, Bucks County, ACOE Philadelphia District.

 To perform the following water obstruction and encroachment activities within an unnamed tributary to Little Neshaminy (WWF-MF) as well as the main branch of Little Neshaminy (WWF-MF) associated with the S.R. 2038 County Line Road Resurfacing Project:

 1. To excavate an already existing drainage swale/unnamed tributary (WWF-MF) to enhance drainage to the Little Neshaminy Creek (WWF-MF) resulting in 296.4 linear feet (1,397.2 square feet) of permanent steam channel impact located at Sta 294+25.00. This activity also includes the placement of riprap associated with the construction of maintenance of an endwall and two (2) outfalls resulting in 265.6 square feet of permanent of water course impacts. In addition, associated work includes 1,826.3 square feet and 113.7 square feet of permanent impact within the floodway of the Little Neshaminy Creek (WWF-MF) and 5,204.6 square feet of floodplain impact.

 2. To place fill within the floodway and floodplain of Little Neshaminy Creek (WWF-MF) associated with roadway reconstruction resulting in 969.6 square feet of permanent floodway impact and 2,474.99 square feet of floodplain impact. This activity also includes the placement of fill within an unnamed tributary to Little Neshaminy Creek and will result in 9.4 linear feet (32.9 square feet) of permanent stream channel impact.

 3. To remove a 26.5-foot long masonry stone arch bridge, and in its place, construct and maintain a 67.2-foot long, 14-foot by 8-foot single cell precast box culvert carrying an unnamed tributary to Little Neshaminy Creek (WWF-MF) located at Sta 336+98.70 resulting in 53.6 linear feet (1,003.5 square feet) of permanent stream channel impact, 28.2 linear feet (343.7 square feet) of temporary stream channel impact, and 1,124.8 square feet of permanent floodway impact. Additional impact to the channel includes 65.5 linear feet (292.3 square feet) of permanent stream impact due to the placement of riprap protection. Floodway impacts include the construction and maintenance of two (2) outfalls (1.5-foot diameter) and the placement of fill and riprap protection. There is a total of 1,545 square feet of floodplain impact.

 4. To remove a 84-inch by 60-inch corrugated steel arch pipe culvert, and in its place, construct and maintain a 61.3-foot long, 103-inch by 71-inch arch pipe culvert carrying an unnamed tributary to Little Neshaminy Creek (WWF-MF) located at Sta 352+50.00 resulting in 61.3 linear feet (723 square feet) of permanent stream channel impact with 183.7 square feet of riprap rock apron, 44.3 linear feet (310.3 square feet) of temporary stream impact, and 3,217 square feet of permanent floodway/floodplain impact. Additional impacts include the placement fill and riprap protection with an unnamed tributary resulting in 24.2 linear feet (63.5 square feet) of permanent stream channel impact. Floodway/floodplain impacts include the construction and maintenance of a 1.5-foot diameter outfall and the placement of riprap associated with outfalls located outside of floodplain.

 5. To place fill within the floodway of Park Creek (WWF-MF) associated with roadway improvements resulting in 1,060.1 square feet of permanent floodway impact.

 This project will have some 100-year floodplain impacts and is located on a 3.03-mile section of County Line Road between Kulp Road East and Easton Road in Warrington Township, Bucks County (USGS PA Ambler Quadrangle—Latitude 40.225677 N, Longitude 75.162080 W). Permit issued April 7, 2020.

 Approval is granted to amend the existing permit to construct Phase II of the Robinson Fork Mitigation Bank. Phase II consists of restoration, enhancement and conservation activities within approximately 122.83 acres of the Robinson Fork watershed, immediately adjacent to Robinson Fork Mitigation Bank—Phase I. These activities would include activities affecting uplands, floodplains, stream channels and wetland areas of the Robinson Fork watershed; including the main stem of Robinson Fork, Beham Run tributary and numerous unnamed tributaries.

 The project generally consists of the following activities: Wetland resources—enhancement of 0.57-acre, re-establishment of 9.61 acres, and rehabilitation of 0.68 acre. An additional 0.02 acre of existing wetlands will be protected under the overall site protection instruments. Riverine and floodplain resources—Restoration of 13,323.86 linear feet of the stream and floodplain, rehabilitation of 1,759.43 linear feet of the stream channel and floodplain, enhancement of 15,447.73 linear feet of stream channel and floodplain and 5,454.24 linear feet of stream channel and floodplain protected under the overall site conservation easements. Upland resources—107.19 acres will be protected under the overall site conservation easements. Some of the areas will involve vegetation habitat management, invasive plant species control and vegetative plantings. The project upon meeting performance standards may provide compensatory mitigation credits through the applicant's existing permit MB9915-0001.

PUBLIC NOTICE OF FINAL STATE WATER QUALITY CERTIFICATION FOR FERC REGULATED PIPELINE PROJECT


State Water Quality Certification Issued by the Commonwealth of Pennsylvania, Department of Environmental Protection Pursuant to Section 401 of the Clean Water Act for the Bernville Tem 2020/Compressor Units Replacement Project.

WQ0683219-001, Enbridge/Texas Eastern Transmission, LP, 890 Winter Street, Suite 320, Waltham, MA 02451. Bernville TEM 2020/Compressor Units Replacement Project (Project), in North Heidelberg Township, Berks County, ACOE Philadelphia District. The proposed project is located at the existing Bernville Compressor Station site (Latitude: 40.4099°; Longitude: -76.1506°).

 On April 18, 2019, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP19-191). The FERC Environmental Assessment for the Project, which was available on September 30, 2019, may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP19-191).

 On September 19, 2019, Applicant requested a State Water Quality Certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.

 The Project, as proposed, includes the replacement of two existing centrifugal gas turbine units with two new, more efficient gas turbine units. Project activities include the reconstruction and conversion of existing buildings and the construction of additional facilities, including a generator building, and electrical control building, an electric service entrance building with transformer, and an auxiliary building. In addition, the project will result in the installation of new stormwater management facilities, widening of the existing access road, and installation of gas, electric, and water utilities. The Project, as proposed, will require approximately 17.6 acres of earth disturbance. No impacts to streams or wetlands are proposed.

 PADEP published notice of its proposed SWQC in the Pennsylvania Bulletin on October 26, 2019 (49 Pa.B. 6388) and received 16 comments from the public. PADEP has reviewed the comments received and revised the certification to address known polychlorinated biphenyl contamination on site.

 PADEP certifies that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP further certifies that the construction, operation and maintenance of the Project complies with Pennsylvania water quality standards and that the construction, operation and maintenance of the Project will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:

 1. Discharge of Hydrostatic Test Water and Treated Water from Excavation Activities—Applicant shall comply with National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline and the temporary discharge of treated water generated from excavation activities associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.

 2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with any necessary Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601.), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management), and all other applicable regulations.

 4. Soil Contamination Remediation Work Plan—Applicant shall comply with the PADEP-approved work plan for the remediation of the contamination area identified as a designated Operational Consideration Area (OCA) in the June 29, 1991 Consent Order and Adjudication (CO&A) between DEP and Texas Eastern and the October 11, 1989 Consent Decree between the U.S. Environmental Protection Agency (USEPA) and Texas Eastern. The OCA Remediation Work Plan shall be prepared in accordance with the CO&A and the Federal Consent Decree and all other applicable laws and regulations.

 5. Soil & Groundwater Management Plan—Applicant shall comply with the PADEP-approved Soil and Groundwater Management Plan specifying measures the Applicant will develop and implement to prevent the contamination of Waters of the Commonwealth due to the discharge, transport, release, or disposal, whether intentional or non-intentional, of regulated substances, hazardous substances, or contaminated media, including stormwater run-off, groundwater, or soils. The measures to be developed and implemented by the Applicant pursuant to the Plan shall contain, treat, address and/or dispose of contaminated media in a manner that satisfies water quality standards and other applicable laws and regulations, including water quality protection requirements. The Plan shall require the Applicant to conduct sampling and analyses to confirm the agency data and develop and implement actions to prevent the migration of contaminants, hazardous substances, or pollutants due to, but not limited to project activities such as, soil excavation and disposal, hydrovac excavation, decantation operations, trenching, groundwater dewatering, and the creation of preferential contaminant migration paths.

 6. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.

 7. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.

 8. Operation—Applicant shall properly operate and maintain at all times all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 9. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals which ensure the project shall maintain and protect State water quality standards as required by this SWQC. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.

 10. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.

 11. Correspondence—All correspondence with and submittals to PADEP concerning this SWQC shall be addressed to the Department of Environmental Protection, Regional Permit Coordination Office, Domenic Rocco, PE, Program Manager, 400 Market Street, Harrisburg, PA 17101, RA-EPREGIONALPERMIT@pa.gov.

 12. Reservation of Rights—PADEP may modify, suspend or revoke this SWQC if: (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that the Applicant has not complied with the terms and conditions of this SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.

 13. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.

 14. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of the SWQC shall not be affected thereby.

 Any person aggrieved by this action may file a petition for review pursuant to Section 19(d) of the Federal Natural Gas Act (15 U.S.C.A. § 717r(d)), with the Office of the Clerk, United States Court of Appeals for the Third Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790 as provided by law. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law. FM-100 Project (Project), in Cameron, Clearfield, Clinton, Elk, McKean, and Potter Counties, Baltimore and Pittsburgh Corps Districts. The proposed project involves modernization of a portion of the existing pipeline system, and abandonment of aging infrastructure. The modernization portion of the project starts in Sergeant Township, McKean County (Latitude: 41.70265°; Longitude: -78.500103°) and ends in Allegany Township, Potter County (Latitude: 41.886014°; Longitude: -77.950358°).  The applicant is proposing the installation and maintenance of an approximately 29.5-mile-long, 20-inch diameter pipeline (Line YM58), a 0.4 mile 12-inch diameter pipeline (extension of existing Line KL), and a 1.4-mile-long 24-inch diameter pipeline loop (YM 224) and appurtenant facilities in various municipalities within Clinton County, McKean County and Potter County for the purpose of transportation of natural gas. The applicant is also proposing to abandon in place approximately 44.9 miles of 12-inch diameter steel natural gas pipeline and appurtenant facilities in various municipalities within Cameron County, Clearfield County, Elk County and Potter County. The Project, as proposed, will require approximately 555.8 acres of earth disturbance, and the following impacts to streams, floodways, and wetlands:

 Cameron County: 1.32 acre of floodway impacts to Driftwood Branch Sinnemahoning Creek (TSF, MF) and Bennett Branch Sinnemahoning Creek (WWF, MF); 0.02 acre of temporary impacts to PSS wetlands.

 Clearfield County: 1.68 acre of floodway impacts to Bennett Branch Sinnemahoning Creek (CWF, MF), Tributaries to Bennett Branch Sinnemahoning Creek (CWF, MF), Laurel Run (HQ-CWF, MF); 0.22 acre of temporary impacts to PEM and PSS wetlands.

 Elk County: 5 feet of temporary impacts Medix Run (HQ-CWF, MF) and a tributary to Medix Run (HQ-CWF, MF); 0.05 acre of floodway impacts; 0.11 acre of temporary impacts to PEM wetlands.

 McKean County: total of 1,062 feet of impacts to Tributaries to Wernway Hollow (HQ-CWF, MF), Tributary to Browns Mill Hollow Run (HQ-CWF), Robbins Brook and tributaries thereof (HQ-CWF), Donley Fork (HQ-CWF), Potato Creek (TSF), tributaries to Potato Creek (CWF), Coalbed Hollow (HQ-CWF), Bemis Hollow (HQ-CWF) and tributaries thereof, Allegheny Portage Creek (CWF) and tributaries thereof, Allegheny River (CWF) and tributaries thereof, Tributary to Benson Hollow (CWF), Coleman Creek (CWF) and tributaries thereof, Tributary to Jordan Hollow (CWF), Tributaries to Red Mill Brook (CWF), tributaries to Irons Hollow (CWF), Tributaries to Robbins Brook (HQ-CWF), Tributaries to Walcott Brook (CWF), Tributary to Fishing Creek (CWF), Tributaries to Warner Brook (HQ-CWF); 21.113 acres of floodway impacts; 13.783 acres of temporary impacts to PEM, PSS and PFO wetlands; and 1.744 acre of permanent impacts to PEM, PSS and PFO wetlands.

 Potter County: total 282 feet of impacts to Jordan Hollow (CWF) and tributaries thereof, Ernst Hollow (CWF), Sartwell Creek (CWF) and tributaries thereof, Baker Hollow (CWF), Fishing Creek (CWF) and tributaries thereof, East Branch Fishing Creek (HQ-CWF) and tributary thereof, Whitney Creek (EV) and tributaries thereof, 4.113 acres of floodway impacts; 1.087 acre of temporary impacts to PEM, PSS and PFO wetlands; and 0.139 acre of permanent impacts to PEM, PSS, and PFO wetlands.

 PADEP, by this notice, is proposing to issue a SWQC to National Fuel Gas Supply Corp. for the FM-100 Project. PADEP is proposing to certify that construction, operation and maintenance of the FM-100 Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP is proposing to further certify that the construction, operation and FM-100 Project complies with Pennsylvania water quality standards and that the construction, operation and maintenance of the project will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:

 1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.

 2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management) and all other applicable regulations.

 4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.

 5. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.

 6. Operation—Applicant shall properly operate and maintain at all times all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals which ensure the project shall maintain and protect State water quality standards as required by this SWQC. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.

 8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.

 9. Correspondence—All correspondence with and submittals to PADEP concerning this SWQC shall be addressed to the Department of Environmental Protection, Regional Permit Coordination Office, Domenic Rocco, PE, Program Manager, 400 Market Street, Harrisburg, PA 17101, RA-EPREGIONALPERMIT@pa.gov.

 10. Reservation of Rights—PADEP may modify, suspend, or revoke this SWQC if: (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that the Applicant has not complied with the terms and conditions of the SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.

 11. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.

 12. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of this SWQC shall not be affected thereby.

WATER OBSTRUCTIONS AND ENCROACHMENTS

Natural Fuel Gas Supply Corporation, 1100 State Street, Erie, PA 16512, FM 100 Project. The applicant is proposing the installation and maintenance of an approximately 29.5-mile-long, 20-inch diameter pipeline (line YM58), a 0.4 mile 12-inch diameter pipeline (extension of existing Line KL), and a 1.4-mile-long 24-inch diameter pipeline loop (YM 224) and appurtenant facilities in various municipalities within Clinton, McKean and Potter Counties for the purpose of transportation of natural gas. The applicant is also proposing to abandon in place approximately 44.9 miles of 12-inch diameter steel natural gas pipeline and appurtenant facilities in various municipalities within Cameron County, Clearfield County, Elk County and Potter County.

 The project consists of 5 Chapter 105 Water Obstruction and Encroachment Permits and 1 Chapter 102 Erosion and Sediment Control Permit. Below are the Chapter 105 permit applications being reviewed by the Department.

E1283219-001. The Cameron County portion of the project is located in Gibson Township, Grove Township, Lumber Township & Driftwood Borough, U.S. Army Corps of Engineers, Baltimore District. The proposed project starts at the Elk County line (Latitude: 41° 19` 23.7"; Longitude 78° 14` 58.4") and extending to the Potter County line (Latitude: 41° 30` 55.5"; Longitude 78° 05` 44.0").

 The proposed project impacts in Cameron County include a total of 1.32 acre of floodway impacts to Driftwood Branch Sinnemahoning Creek (TSF, MF) and Bennett Branch Sinnemahoning Creek (WWF, MF); 0.015 acre of temporary impacts to PSS wetlands. To compensate for the proposed temporary direct project impacts to PSS wetlands in Cameron County, the applicant is proposing 0.026 acre of wetland mitigation at an off-site location.

E1783219-001. The Clearfield County portion of the project is located in Hutson Township and Lawrence Township, U.S. Army Corps of Engineers, Baltimore District. The proposed project starts along State Route 0255 (Latitude: 41° 13` 11.22"; Longitude -78° 33` 32.60") and extending to the Elk County line (Latitude: 41° 14` 25.3"; Longitude 78° 25` 53.5").

 The proposed project impacts in Clearfield County include a total of: 1.68 acre of floodway impacts to Bennett Branch Sinnemahoning Creek (CWF, MF), Tributaries to Bennett Branch Sinnemahoning Creek (CWF, MF), Laurel Run (HQ-CWF, MF); 0.22 acre of temporary impacts to PEM and PSS wetlands. To compensate for the proposed temporary direct project impacts to PSS wetlands in Clearfield County, the applicant is proposing 0.126 acre of wetland mitigation at an off-site location.

E2483219-001. The Elk County portion of the project is located in Benezette Township & Jay Township, U.S. Army Corps of Engineers, Baltimore District. The proposed project starts Clearfield County line (Latitude: 41° 14` 25.3"; Longitude 78° 25` 53.5") and extending Cameron County line (Latitude: 41° 19` 23.7"; Longitude 78° 14` 58.4").

 The proposed project impacts in Elk County include a total of 5 feet of temporary impacts Medix Run (HQ-CWF, MF) and a tributary to Medix Run (HQ-CWF, MF); 0.05 acre of floodway impacts; 0.11 acre of temporary impacts to PEM wetlands.

E4283219-001. The McKean County portion of the project is located in Liberty Township, Norwich Township & Sergeant Township, U.S. Army Corps of Engineers, Pittsburgh District. The proposed project starts along Kin Foks Lane (Latitude: 41° 42` 18.5"; Longitude 78° 29` 37.2") and extending Potter Township line (Latitude: 41° 44` 0.3"; Longitude 78° 12` 8.4").

 The proposed project impacts in McKean County include a total of 1,062 feet of impacts to Tributaries to Wernway Hollow (HQ-CWF, MF), Tributary to Browns Mill Hollow Run (HQ-CWF), Robbins Brook and tributaries thereof (HQ-CWF), Donley Fork (HQ-CWF), Potato Creek (TSF), tributaries to Potato Creek (CWF), Coalbed Hollow (HQ-CWF), Bemis Hollow (HQ-CWF) and tributaries thereof, Allegheny Portage Creek (CWF) and tributaries thereof, Allegheny River (CWF) and tributaries thereof, Tributary to Benson Hollow (CWF), Coleman Creek (CWF) and tributaries thereof, Tributary to Jordan Hollow (CWF), Tributaries to Red Mill Brook (CWF), tributaries to Irons Hollow (CWF), Tributaries to Robbins Brook (HQ-CWF), Tributaries to Walcott Brook (CWF), Tributary to Fishing Creek (CWF), Tributaries to Warner Brook (HQ-CWF); 21.113 acres of floodway impacts; 13.783 acres of temporary impacts to PEM, PSS and PFO; and 1.744 acre of permanent impacts to PEM, PSS and PFO wetlands. To compensate for the proposed temporary direct and permanent indirect project impacts to PFO and PSS wetlands in McKean County, the applicant is proposing 4.851 acres of wetland mitigation at an off-site location.

E5383219-001. The Potter County portion of the project is located in Pleasant Valley Township, Portage Township, Roulette Township & Wharton Township, U.S. Army Corps of Engineers, Pittsburgh District. The proposed Line YM58 project starts McKean County line (Latitude: 41° 44` 0.3"; Longitude 78° 12` 8.4") and near Carpenter Road (Latitude: 41° 51` 27.6"; Longitude 78° 01` 01.1"). The proposed project impacts in Potter County include a total 282 feet of impacts to Jordan Hollow (CWF) and tributaries thereof, Ernst Hollow (CWF), Sartwell Creek (CWF) and tributaries thereof, Baker Hollow (CWF), Fishing Creek (CWF) and tributaries thereof, East Branch Fishing Creek (HQ-CWF) and tributary thereof, Whitney Creek (EV) and tributaries thereof, 4.113 acres of floodway impacts; 1.087 acre of temporary impacts to PEM and PSS wetlands; and 0.139 acre of permanent impacts to PEM and PSS wetlands. To compensate for the proposed temporary direct and permanent indirect project impacts to PSS wetlands in Potter County, the applicant is proposing 0.586 acre of wetland mitigation at an off-site location.

EROSION AND SEDIMENT CONTROL

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

The Department of Environmental Protection (Department) provides notice of receipt of an application for a Chapter 102, Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities. The application is currently under technical review for FM 100 Project.

 This authorization is required for earth disturbance activities associated with oil and gas exploration, production, processing or treatment operations or transmission facilities when earth disturbance is five acres or greater. Review of this application is being coordinated among the Department and the associated county conservation districts.

PUBLIC COMMENTS FOR STATE WATER QUALITY CERTIFICATION, WATER OBSTRUCTIONS AND ENCROACHMENTS AND/OR EROSION AND SEDIMENT CONTROL

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department office during the 30-day public comment period.

 Following the 30-day comment period, the program manager from the appropriate Department office will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.
