FEDERAL WATER POLLUTION
CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30-days of the date of this notice, as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8:00 AM and 4:00 PM on each working day at the office noted above the application.

WATER OBSTRUCTIONS AND ENCROACHMENTS

Applications Received Under the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27) and Section 302 of the Flood Plain Management Act (32 P.S. § 679.302) and Requests for Certification Under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

 To construct and maintain an approximately 2,730-feet long, 25-feet wide multi-use recreational trail between Christian and 34th Streets (Grays Ferry Section) along the eastern side floodway/floodplain of the Schuylkill River (WWF/MF) associated with the Schuylkill River Park Extension. The project will include one cable-stayed structure and two concrete bulb-tee beam approach bridges supported on various piers and two towers.

 The site is located along the east bank of the Schuylkill River between Christian and 34th Streets (Philadelphia, PA, USGS Quadrangle Latitude: 39.939982; Longitude: 75.194120) in the City of Philadelphia, Philadelphia County.

 Southcentral Region: Waterways & Wetlands Program, 909 Elmerton Avenue, Harrisburg, PA 17110.

 E6703120-021. PA Department of Transportation Engineering District 8-0, 2140 Herr Street, Harrisburg, PA 17103-1699 in, Manchester Township, York County, U.S. Army Corps of Engineers Baltimore District.

 To construct and maintain a concrete toe wall and place and maintain rock slope protection, permanently impacting and partially relocating, 258 linear feet (1,548 square feet) and temporarily impacting 260 linear feet (1,560 square feet) of an Unnamed Tributary to Susquehanna River (WWF, MF) for the purpose of improving transportation safety and repairing a flood damaged section of S.R. 1037 in Hellam Township, York County (Latitude: 40.044078, 76.565067). The project will also result in 350 linear feet (14,000 square feet) of permanent floodway impact due to stream channel reshaping. No wetlands will be impacted by the proposed project.

 Northcentral Region: Waterways & Wetlands Program Manager, 208 West Third Street, Williamsport, PA 17701, 570-327-3636.

 EA4104220-021: PA Game Commission, Plunketts Creek Township, Lycoming County, US Army Corps of Engineers Baltimore District (Barbours Quadrangle; Latitude 41° 25` 0.3" N; 76° 48` 23.2" W). The PA Game Commission is proposing to restore the Plunketts Creek floodplain and streambank at the former pheasant propagation farm on State Games Lands # 134 by removing a 2,200-foot long/4.5-acres earthen berm along the watercourse. The project will require excavation and removal of approximately 22,860 cubic yards of material, re-grading the stream banks to a stable slope, and establishment of a 150-foot-wide riparian buffer. The excavated material will be wasted on PA Game Commission property outside of the FEMA floodplain and will require approval of an Individual NPDES Permit for the earth disturbance. As proposed, there are no wetland impacts and the only instream work is 165 linear feet of temporary impact to remove a gabion basket wall. Plunketts Creek has an existing use of exceptional value and is a naturally reproducing trout stream.

 E63052-740, Perryman Corporation, 213 Vandale Drive, Houston, PA 15342, Chartiers Township and North Strabane Township, Washington County, Pittsburgh ACOE District.

 The applicant proposes to:

 1. Construct, operate, and maintain a new 17-foot wide by 139-foot long single span bridge over Chartiers Creek (WWF).

 2. Construct, operate, and maintain approximately 68 feet of 24-inch culvert, to convey an Unnamed Tributary to Chartiers Creek (WWF) underneath an access road.

 For the purpose of providing an access drive to connect the Perryman Company south facility area with the Perryman Company north facility. Cumulatively, the project will permanently impact 17 LF of Chartiers Creek and permanently impact approximately 68 LF of the UNT to Chartiers Creek. The project site is located at 213 Vandale Drive, Houston, PA 15342 (Washington East, PA USGS topographic quadrangle; N: 40°, 14`, 3.0"; W: 80°, 12`, 41.8"; Sub-basin 20F; USACE Pittsburgh District), in Chartiers Township and North Strabane Township, Washington County.

 Eastern Region: Oil and Gas Management Program Manager, 208 West Third Street, Suite 101, Williamsport, PA 17701-6448.

 E4129220-024: ARD Operating, LLC, 33 West Third Street, Suite 300, Williamsport, PA 17701. Wallis Run to Salt Run LP in Cascade Township, Lycoming County, ACOE Baltimore District.

 To construct, operate and maintain approximately 1.73-mile (9,130 ft) of one (1) 12-inch diameter flex steel natural gas pipeline in Cascade Township, Lycoming County. The pipeline will be placed via open cut trenching within the existing ROW. The purpose of this project is to provide a conveyance of low-pressure natural gas between the Wallis Run Value Site and Salt Run Value site.

 The project will result in a total of 15 LF (149 SF) of permanent and 405 LF (3,721 SF) of temporary stream impacts, 1,071 SF (0.0246 acre) of permanent and 27,026 SF (0.6204 acre) of temporary floodway impacts and 3,128 SF (0.0718 acre) of permanent and 70,463 SF (1.6176 acre) of temporary wetland impacts all for the purpose of constructing a natural gas pipeline for Marcellus well development.

This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board.
