ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.31); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); the Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); the Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District Mining Office indicated above each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Depart- ment at the address of the District Mining Office indicated above each application within 30-days of this publication, or within 30-days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

 Written comments or objections related to a mining permit application should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 Requests for an informal conference, or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 (relating to public hearing-informal conferences) or § 86.34 (relating to informal conferences), must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 Where a National Pollutant Discharge Elimination System (NPDES) number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30-days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30-days of this public notice and contain the name, address, telephone number and the interest of the party filing the request and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

Coal NPDES Draft Permits

FEDERAL WATER POLLUTION
CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30-days of the date of this notice, as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8:00 AM and 4:00 PM on each working day at the office noted above the application.

WATER OBSTRUCTIONS AND ENCROACHMENTS


Applications Received Under the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27) and Section 302 of the Flood Plain Management Act (32 P.S. § 679.302) and Requests for Certification Under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

Permit No. E2301220-021, Columbia Gas Transmission, LLC, 1700 MacCorkle Avenue SE, Charleston, WV 25314, Chadds Ford Township, Delaware County, ACOE Philadelphia District.

 To restore, rehabilitate, and maintain an approximately 110-feet long meander bend of Harvey Run (WWF/MF) migrated into a 12-inch diameter natural gas pipeline associated with the safeguard of the exposed pipeline. The improvements will include bank stabilization, engineered riffle, and rock revetment to prevent future erosion.

 The site is located about 750-feet northwest of Creek and Rocky Hill Roads (Wilmington North, PA, USGS Quadrangle Latitude: 39.869536; Longitude: -75.590726) in Chadds Ford Township, Delaware County.

 The City of Chester is proposing to daylight a 275 linear foot, 66-inch by 84-inch elliptical CMP stream enclosure carrying a UNT to Delaware River (WWF-MF, Watercourse A) for the Veterans Memorial Park Stormwater Wetland Basin Project. In its place, the City of Chester will construct and maintain a 4-acre stormwater wetland basin by removing fill and grading within the existing park and constructing an outlet structure discharging to an existing stream enclosure within AMTRACK right-of-way. This activity will result in 275 linear feet (1,925 square feet, 0.044 acre) of permanent watercourse impact, 556 square feet (0.013 acre) of permanent wetland impact to a wetland area (PEM, Wetland B), and 1,964 square feet (0.045 acre) of temporary wetland impact to a wetland area (PEM, Wetland A).

 This project is located in Veterans Memorial Park on 7th Street in Chester City, Delaware County (USGS PA Marcus Hook Quadrangle—Latitude 39.836710 N, Longitude 75.389625 W).

Permit No. E5101220-022, Children's Hospital of Philadelphia (CHOP), 3501 Civic Center Boulevard, CTRB12405-4, Philadelphia, PA 19104, City of Philadelphia, Philadelphia County, ACOE Philadelphia District.

 CHOP is proposing to enhance an existing 4-foot by 4-foot box culvert outfall with the construction and maintenance of a 7-foot by 4-foot outfall discharging to the Schuylkill River (WWF-MF) in association with the sewer reroute and outfall upgrades for the future CHOP expansion project. This activity includes construction and maintenance for the culvert outfall and wingwalls resulting in 100 square feet (0.002 acre) of permanent floodway impact.

 This project is bound by the I-76 ramp to the north and east, the Schuylkill River to the South, and a PECO building to the west in Philadelphia (USGS PA Philadelphia Quadrangle—Latitude 39.948486 N, Longitude 75.196749 W).

Permit No. E0901120-026, Pennsylvania Department of Transportation, Engineering District 6-0, 7000 Geerdes Boulevard, King of Prussia, PA 19406, Tinicum Township, Bucks County, ACOE Philadelphia District.

 The Pennsylvania Department of Transportation (PennDOT District 6-0) is proposing to remove an existing three-span, 62.8-foot-long, concrete encased steel I-beam, concrete deck slab bridge with stone masonry abutment and piers. In its place, construct and maintain a two-span, prestressed concrete spread box beam bridge with equal spans measuring 40 feet each over Tinicum Creek (EV). These activities are associated with the Headquarters Road over Tinicum Creek Replacement Project and includes the construction and maintenance of the following water obstruction and encroachment activities:

 1. To remove an existing three-span bridge, construct and maintain a proposed two-span bridge, perform channel work and grading, placement of riprap, removal of multiple existing piers, and the construction of a new proposed pier resulting in 77.5 linear feet (3,302 square feet, 0.076 acre) of permanent watercourse impact and 1,569 square feet (0.036 acre) of permanent floodway impact. Floodway and floodplain activities also include roadway construction, abutment and wingwall construction on opposite sides of watercourse, existing abutment removal, channel work, and grading resulting in 2,654 square feet (0.061 acre) of additional permanent floodway impact and 100-year floodplain impact.

 2. To construct and maintain a diversion dike system and temporary causeway to facilitate the removal of the existing piers, removal of existing bridge, and construction of proposed bridge will result in a total of 74 linear feet (2,271 square feet, 0.052 acre) of temporary watercourse impact and 3,138 square feet (0.072 acre) of temporary floodway impact.

 The entire project area is located within the Ridge Valley Rural Historic District and Tinicum Creek is classified by the Nation Park Service (NPS) as a Federal scenic river within the Lower Delaware Wild and Scenic River. To construct a 12` x 4` arch culvert across Black Run (WWF) that will provide vehicular access to the Susquehanna Union Green land development project. The crossing will convey traffic between the proposed residential development south of Black Run and a combination of residential and commercial/retail development north of Black Run. The impacts of the proposed culvert include 347 square feet of permanent impacts to Black Run and 976 square feet of permanent impacts to the floodway of Black Run. The applicant also proposes to construct a timber pile supported pedestrian bridge across Black Run that will provide walking access between both north and south sides of the land development project. The pedestrian bridge will have 55 square feet of permanent impacts to Black Run and 216 square feet of permanent impacts on the floodway of Black Run. The project is located upstream of North Progress Avenue in Susquehanna Township, Dauphin County (USGS Quadrangle: Harrisburg East, PA: Latitude: 40° 19` 33"; Longitude: 76° 51` 19").
