THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board.

III. WQM Industrial Waste and Sewerage Actions under The Clean Streams Law.

Description of Proposed Action/Activity:

This amendment approves the modification of sewage facilities consisting of the following upgrades to the existing sewage treatment plant:

New Fine Screen: The applicant proposes the installation of a Vertical Auger Monster (Model ALV1801-285) with a JWC Motor Controller (Model PC2251SV) at the facility's headworks.

Modification to Existing Disinfection System: Proposed changes to the existing chlorine disinfection system are threefold: the sidewall depth of the existing tank will be increased by 12" to increase contact time, a new chlorine contact inlet baffle will be installed to promote mixing, and tablet feeder based dechlorination system will be constructed.

WQM Permit No. 3419402, Sewerage, SIC Code (4952, 8211) East Juniata High School, 32944 Route 35 N., McAlisterville, PA 17049-8109. This proposed facility is located in Fayette Township, Juniata County.

Description of Proposed Action/Activity:

This amendment approves the modification of sewage facilities consisting of:

The replacement of the existing UV disinfection system with a UV Pure Hallett 1,000W UV disinfection system rated for a maximum flow of 64 gpm. A globe valve will be installed on the discharge side of the existing UV pumps to throttle the effluent flow from the pumps such that the UV system will not be hydraulically overloaded.

WQM Permit No. 6718408, Sewerage, SIC Code (4952) Peach Bottom Inn Motel, 6085 Delta Road, Delta, PA 17314-9209. This proposed facility is located in Peach Bottom Township, York County.

Description of Proposed Action/Activity:

This permit approves the modification of sewage facilities consisting of:

1. Re-rating of the design annual average flow from 0.013 mgd to 0.0074 mgd and the organic design capacity from 31.9 lbs BOD₅/day to 35.2 lbs BOD₅/day. The application also establishes 0.0101 mgd as the STP's maximum monthly average flow, 0.0184 mgd as the STP's maximum daily flow, 0.0245 mgd as the STP's peak hourly flow, and 0.0310 mgd as the STP's peak instantaneous flow.

2. Modification to the existing influent distribution box.

3. Replacement of the existing blowers with two (2) Dresser Roots Model 45 URAI rotary blowers rated for 277 cfm at 2,950 RPM (each).

4. Introduction of DelPAC XG to facilitate phosphorus precipitation.

5. Installation of a clarifier effluent trough and flume.

6. Replacement of the existing disinfection system with two (2) new Hallett Model 30 UV disinfection units rated for 28 gpm of flow (each).

7. Replacement of the existing UV feed pumps with two (2) EBARA Fluid Handling Optima submersible pumps rated for 23.8 gpm at 15.74` TDH.

8. Installation of an effluent electromagnetic flow meter on the downstream side of the UV units.

Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

Plan Description: Cranberry Venango County General Authority submitted an Act 537 Official Sewage Facilities Plan (Plan) on behalf of Cranberry Township that proposed construction of a new sewage treatment plant tributary to Sage Run. Sewage from the Cranberry Township service area is currently being treated at the City of Oil City's (City) Wastewater Treatment Plant (WWTP), with the Plan proposing disconnection of all the existing Cranberry Township service area from the City's WWTP and connection to the new Cranberry Township sewage treatment plant. The Plan was disapproved because of the following reasons: The Plan failed to adequately address the estimated cost of constructing and operating the proposed project, therefore raising unresolved concerns about the Plan's ability to be implemented. The Plan failed to adequately address questions and concerns raised by public comments to the Plan and did not adequately address the financial impact to the City. The Plan did not show that the proposed project conforms to any comprehensive water quality management and pollution control program. The Plan failed to adequately address how Chapter 93 antidegradation requirements would be met on the receiving water, Sage Run, with the addition of the proposed effluent dominated discharge outfall. The Plan's implementation would affect the sewage facilities of Oil City, and Oil City had not revised their Official Plan to include disconnection of Cranberry Township's flows. In addition, the proposal did not promote intermunicipal cooperation in the implementation and administration of the Plan. Oil City has objected to this Plan as removal of Cranberry Township's customers would allegedly render Oil City's sewer system unsustainable.
