Federal Consistency under the Coastal Zone Management Act; Fairmont Waterworks Floating Classroom

[Saturday, July 18, 2020]This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (CZMA) (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection's (Department) Coastal Resources Management Program has received notice that the Philadelphia Water Department (Applicant) is proposing to develop the Fairmont Waterworks Floating Classroom (Project) along the Schuylkill River in the City of Philadelphia.
The Applicant is seeking authorization from the United States Army Corps of Engineers under section 404 of the Clean Water Act (33 U.S.C.A. § 1344) for all work within regulated waters. The proposed Project would include the installation of approximately 5,400 square feet of floating classroom with an additional 960 square feet of floating docks tied to the south end of the classroom. The floating classroom would be anchored with three mooring clusters, consisting of two 16-inch diameter battered steel pipe piles and one 28-inch diameter plumb steel pipe pile fixed to bedrock by rock socketing. Piles would be filled with concrete resulting in a discharge of 19 cubic yards of concrete within 22 square feet of waterway below the high tide line. Two floating access ramps would connect the floating classroom to an approximately 1,060 square foot platform adjacent to the Schuylkill River Trail on uplands. The platform on uplands would be supported on eight 6-inch diameter micro piles. Additional work would include the installation of light poles on the floating classroom and platform. Water depths in the areas that would be occupied by the floating classroom and associated floating docks is approximately 20 feet or greater.
The Project is subject to Department review for Federal consistency because it is a Federal license and permit activity and will have reasonably foreseeable effects on this Commonwealth's coastal resources or uses.
In accordance with section 307 of the CZMA (16 U.S.C.A. § 1456) and the National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), the Philadelphia Water Department has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program. The Department will consider all comments received on or before Monday, August 3, 2020, before issuing a final Federal consistency concurrence or objection.
