Federal Consistency under the Coastal Zone Management Act; Rehabilitation of the Martin Luther King, Jr. Drive Bridge

[Saturday, July 18, 2020]This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (CZMA) (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection's (Department) Coastal Resources Management Program has received notice that the Philadelphia Streets Department (Applicant) is proposing to rehabilitate the Martin Luther King, Jr. Drive Bridge over the Schuylkill River (Project) in the City of Philadelphia.
The Applicant is seeking authorization from the United States Army Corps of Engineers under section 404 of the Clean Water Act (33 U.S.C.A. § 1344) for work within regulated waters. Martin Luther King, Jr. Drive Bridge (City Bridge # 12.1), originally built in 1965, is a 690-foot four span structure which is comprised of one 608-foot three-span continuous steel box-beam girder floor beam section and an additional 82-foot 2-inch steel box-beam girder floor beam western approach span. The existing bridge is located on Martin Luther King, Jr. Drive, which is located within the Fairmount Park system and owned by the City of Philadelphia. The proposed scope of work includes: the removal of the deck along the entire length of the structure, including the western approach span; construction of a new composite deck which includes widening the bridge approximately 4 feet to accommodate a shared-use path (10`) on the upstream side; installation of a pedestrian railing between the shared-use path and westbound travel lane; installation of the Department of Transportation standard barriers with a tapered concrete outer facing to resemble the existing bridge fascia line; minor approach roadway reconstruction; complete replacement of the paint system; replacing and rehabilitation of other superstructure members; bearing rehabilitation; minor substructure rehabilitation; street lighting improvements; and other miscellaneous construction. For instream work, it is anticipated that a temporary barge would be used to access the bridge piers and will utilize float anchors. The work would include repairing the missing/cracked pointing in the stone masonry at Piers A, 1 and 2, and removing the accumulated timber debris from upstream nose of Pier 2.
The Project is subject to Department review for Federal consistency because it is a Federal license and permit activity and will have reasonably foreseeable effects on this Commonwealth's coastal resources or uses.
In accordance with section 307 of the CZMA (16 U.S.C.A. § 1456) and the National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), the Philadelphia Streets Department has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program. The Department will consider all comments received on or before Monday, August 3, 2020, before issuing a final Federal consistency concurrence or objection.
