Finding

 Under section 2002(b) of The Administrative Code of 1929 (71 P.S. § 512(b)) establishing the Department of Transportation (Department), the Director of the Bureau of Project Delivery, as delegated by the Secretary of Transportation, makes the following written finding:

 The I83 (SR 0083) Section 078 Eisenhower Interchange Reconstruction Alternative is the preferred alternative of the East Shore Section 2 project in Dauphin County. The project limits extend through Lower Paxton Township, Paxtang Borough and Swatara Township in Dauphin County. The project begins just south of the SR 3020 (Union Deposit Road) Interchange and extends westward to the area of the SR 3013 (29th Street) overpass. It includes portions of Interstate 283 (SR 0283) and United States Route 322 (SR 0322) through the Eisenhower Interchange.

 Improvements include widening the mainline SR 0083 corridor to a minimum of three mainline travel lanes (minimum of six through lanes total) plus auxiliary lanes in each direction with improved directional connections to SR 0283 and SR 0322. A portion of northbound SR 0083 will utilize a collector-distributor (CD) system to serve local roads and intersecting highways, including all movements from SR 0083 northbound to SR 0283 southbound, SR 0322 eastbound, Paxton Street (SR 3010) and Derry Street (SR 3012). CD systems separate the more complex traffic maneuvers merging on and off the interstate from the through traffic, improving safety and travel flow. In addition to the regional connections, the Eisenhower Interchange will include local access connections to SR 3012 by means of a Single Point Urban Interchange and the existing interchange that connects SR 0083 to SR 3010 will be reconfigured in the area of the Harrisburg Mall.

 The Environmental Assessment (EA) and EA Comment Responses have been evaluated by the Federal Highway Administration (FHWA) and were determined to discuss adequately and accurately the need, environmental issues, and impacts of the proposed project and mitigation measures that will be taken to minimize harm as stipulated in the EA. Based on the EA, the FHWA has issued a Finding of No Significant Impact for the project. Furthermore, the Bureau of Project Delivery has concluded that all State environmental evaluation requirements, as published in section 2002 of The Administrative Code of 1929, have been satisfied.

 Based upon studies and the Final Individual Section 4(f) Evaluation, there is no feasible and prudent alternative to the use of the Section 4(f)/Section 2002 resources for the proposed action, and the project is planned to minimize harm to the Section 4(f)/Section 2002 resources. The proposed project is anticipated to impact approximately 0.55 acre of the 1.25-acre Paxtang Park property, which qualifies as a Section 4(f)/2002 resource; approximately 1,000 feet of the 20-mile Capital Area Greenbelt will be realigned (note that the Greenbelt does not own the property in this area, it is owned by Dauphin County, the City of Harrisburg and the Department at this location); approximately 1.9 acres of permanent impacts will occur within the 971-acre National Register eligible Harrisburg City Parks 7 Parkway Plan; removal of the Norfolk Southern Railway Bridge over Eisenhower Boulevard, a contributing element of the National Register eligible Norfolk Southern Railway (formerly Philadelphia and Reading Railroad). On the basis of the documentation, it can be concluded that the harm to the resources have been minimized, all feasible and prudent alternatives have been explored to avoid impact upon the resources, and that the intent of section 2002, paragraph 15 of The Administrative Code of 1929 has been fulfilled as it relates to this project.

 Mitigation measures will be taken to minimize harm as stipulated in the EA. No significant adverse environmental effect is likely to result from the proposed action.
