STATE CONSERVATION COMMISSION
PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent (NOI) to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a (NOI) to Remediate with the Department. A NOI to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified person, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed Plan Approvals/Operating Permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.
A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. 49-00063B: Renewal Processing, Inc. (10705 State Route 44, Watsontown, PA 17777) for the modification of the facility's bakery waste rotary dryer to reestablish emission limitations for nitrogen oxides, carbon monoxide and particulate matter, as well as for the installation of a cartridge collector and a regenerative thermal oxidizer, at their facility to be located in Lewis Township, Northumberland County. The Department of Environmental Protection's (Department) review of the information submitted by Renewal Processing, Inc. indicates that the air contamination source to be modified and control devices to be installed will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Department proposes to issue a plan approval for the proposed modification and installation. The emissions from the proposed source included in this project will not exceed the following limits: 22.50 tons of nitrogen oxides per year, 12.00 tons of carbon monoxide per year, 3.63 tons of volatile organic compounds per year, 2.50 tons of sulfur oxides per year, 7.25 tons of particulate matter (including PM-10) per year and 0.40 ton of hazardous air pollutants per year. In addition to the emission limitation, the following is a brief description of the types of conditions the Department intends to place in the plan approval in order to ensure compliance with all applicable air quality regulatory requirements: The rotary dryer shall not be operated more than 5,000 hours per year and the regenerative thermal oxidizer shall be maintained at a minimum operating temperature of 1,600°F at all times bakery waste materials are being processed. The facility is a State Only facility. If the Department determines that the source is modified and control devices are installed, and all operated in compliance with the plan approval conditions and the specification of the application for Plan Approval 49-00063B, the requirements established in the plan approval will be incorporated into a State Only Operating Permit pursuant to 25 Pa. Code § 127.421. All pertinent documents used in the evaluation of the application are available for public review during normal business hours at the Department's Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA 17701. The City of Philadelphia, Air Management Services (AMS) intends to issue a Plan Approval for installation of air pollution sources at the following facility:
IP20-000442: Touraine Apartments (1520 Spruce Street, Philadelphia, PA 19102) for the installation of air pollution sources at an apartment, in the City of Philadelphia, Philadelphia County. The following significant stationary air emission sources are part of the Plan Approval: two (2) boilers firing natural gas and No. 2 oil during periods of natural gas curtailment each rated 4.00 MMBTU/hr, four (4) hot water heaters firing natural gas each rated 0.40 MMBTU/hr, one (1) emergency generator firing diesel fuel rated 168 HP, and one (1) fire pump firing diesel fuel rated 240 HP. Additionally, one (1) insignificant emergency generator rated 27 HP is also included in the Plan Approval for facility-wide emission calculation, and it is required to follow the applicable requirements in the Plan Approval. The potential emission from the installation are as follows: (1) 8.04 tons per year (tpy) of Nitrogen Oxides (NOX), (2) 4.25 tpy of Carbon Monoxide (CO), (3) 0.72 tpy of Particulate Matter (PM), (4) 0.49 tpy of Volatile Organic Compound (VOC), and (5) 0.28 tpy of Sulfur Oxides (SOX). The plan approval will contain operating, monitoring, and recordkeeping requirements to ensure operation within all applicable requirements.
The plan approval will be issued under 25 Pa. Code, Philadelphia Code Title 3 and Air Management Regulation XIII. 23-00089: Marcus Hook Energy, L.P. (Delaware Avenue and Green Street, Marcus Hook, PA 19061) for operation of three combined cycle combustion turbines with a combined output of 750 MW. The facility is located in the Borough of Marcus Hook, Delaware County. As a result of potential emissions of Nitrogen Oxides, Particulate Matter, Volatile Organic Compounds, Carbon Monoxide, and Sulfur Dioxide, it is a major stationary source (Title V facility) as defined in the Clean Air Act. There are no proposed changes to the potential emissions from the facility.
This renewal incorporates requirements of the provisions Pennsylvania's Reasonably Available Control Technology (RACT Phase II) rules and 40 CFR 60 Subpart KKKK—Standards of Performance for Stationary Combustion Turbines, as a result of upgrades made to the stationary combustion units. The renewal includes monitoring, recordkeeping and reporting requirements designed to keep the plant operating within all applicable air quality requirements.
The turbines are subject to Phase II (Title IV) Acid Rain requirements of 40 CFR Part 72. The facility shall hold sufficient SO2 allowances for each affected unit in accordance with 40 CFR 72.9(c)(1). The applicable requirements are incorporated into a Title IV permit (ORIS No. 55801) issued under separate cover concurrently with the Title V Operating Permit. All monitoring, recordkeeping, and reporting shall be in conformance with 25 Pa. Code § 127.531 and the Acid Rain Permit application.

The primary emissions from the facility are VOC. The facility's actual 2019 emissions were 8.7 tons of VOC including 1.72 tons of HAPs. The Operating Permit will include emission standards, testing, monitoring, recordkeeping, and reporting requirements designed to keep the facility operating within all applicable air quality requirements. The conditions include provisions for Sources derived from 25 Pa. Code § 123 for restrictions, monitoring, recordkeeping, and reporting. Among other items the conditions include the Federal regulatory provisions derived from: 40 CFR Part 60, NSPS: Subpart XXX—Standard of Performance for Municipal Solid Waste Landfills that Commenced Construction, Reconstruction, or Modification after July 17, 2014 and 40 CFR Part 63, Subpart AAAA—National Emission Standards for Hazardous Air Pollutants: Municipal Solid Waste Landfills.
06-05154: Birdsboro Power, LLC (1 Armorcast Road, Birdsboro, PA 19508) to issue a Title V Operating Permit for the natural gas-fired combined cycle electric generation facility located in Birdsboro Borough, Berks County. The potential emissions from the facility are estimated at 97.70 tpy of NOx, 69.62 tpy of CO, 56.78 tpy of PM, 17.50 tpy of SOx, 23.87 tpy of VOC, 9.86 tpy of HAPs, 10.70 tpy of H2SO4 and 5.75 tpy of CH2O. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations. Among other items, the conditions include provisions derived from 40 CFR Part 60, Subpart KKKK—Standards of Performance for Stationary Combustion Turbines, 40 CFR Part 60, Subpart TTTT—Standards of Performance for Greenhouse Gas Emissions for Electric Generating Units, 40 CFR Part 60, Subpart IIII—Standards of Performance for Stationary Compression Ignition Internal Combustion Engines, Federal Acid Rain Program and Cross-State Air Pollution Rule.

The primary sources consist of one (1) crematory incinerator. The control device consists of an afterburner. The source is considered a minor emission source of nitrogen oxide (NOx), sulfur oxides (SOx), carbon monoxide (CO), total suspended particulate (TSP) and VOC's. The proposed operating permit contains applicable requirements for emission limitations, work practice standards, testing, monitoring, recordkeeping, and reporting standards used to verify facility compliance with Federal and State air pollution regulations.
40-00101: Pennsy Supply Inc., Pittston West Quarry (2400 Thea Drive, Suite 3A, Harrisburg, PA 17110). The Department intends to issue a renewal State-Only (Synthetic Minor) Permit for the operation of a drum mix asphalt plant and stone manufacturing facility in Jenkins Township, Luzerne County. The sources consist of feed bins, screens, belts, conveyors, and a drum mix asphalt plant with wdlf. The control devices are baghouses and a cyclone. The sources are considered minor emission sources of nitrogen oxide (NOx), sulfur oxides (SOx), carbon monoxide (CO), total suspended particulate (TSP), and volatile organic compounds (VOC) emissions. The proposed operating permit contains applicable requirements for emission limitations, work practice standards, testing, monitoring, recordkeeping, and reporting standards used to verify facility compliance with Federal and State air pollution regulations.
40-00108: Pennsy Supply Inc., Pittston Quarry (2400 Thea Drive, Suite 3A, Harrisburg, PA 17110). The Department intends to issue a renewal State-Only (Natural Minor) Permit for the operation of crushed and broken stone mining and quarrying facility in Jenkins Township, Luzerne County. The facility has potential emissions of 4.08 TPY of CO; 17.05 TPY of NOx; 0.05 TPY of SOx; 8.19 TPY of PM/PM10; 2.62 TPY of VOCs; 1.32 TPY of combined hazardous air pollutants; 913 TPY GHGs. With the exception of one crusher and three screens, all other pieces of non-metallic mineral processing equipment at this plant are subject to 40 CFR 60, Subpart OOO—Standards of Performance for Nonmetallic Mineral Processing Plants. The facility's main sources include two (2) identical Kewanee manufactured natural gas/# 2 fuel fired boilers and two (2) natural gas fired tenter frame fabric dryers. The facility has potential emissions of 14.42 tons per year of nitrogen oxides, 13.65 tons per year of carbon monoxide, 0.10 ton per year of sulfur oxides, 8.23 tons per year of particulate matter, 36.69 tons per year of volatile organic compounds, and 3.04 tons per year of total hazardous air pollutants (HAPs) while burning #2 fuel oil at the facility. The potential emissions at the facility reduced insignificantly due to removal of three emergency generators and one ethylene sterilizer. The boilers are subject to 40 CFR Part 63, Subpart JJJJJJ—National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers Area Sources. The emission limits, throughput limitations and work practice standards along with testing, monitoring, recordkeeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. 17-00045: Pennsylvania Department of Corrections (1920 Technology Parkway, Mechanicsburg, PA 17050-8507) for a State Only (Synthetic Minor) Operating Permit for their Houtzdale Correctional Institution located in Woodward Township, Clearfield County. The facility's sources include two (2) bituminous coal/# 2 fuel oil-fired boilers, two (2) #2 fuel oil-fired boilers, two (2) diesel-fired generators and lime and ash silos, which have the potential to emit greater than the major thresholds of nitrogen oxides and sulfur oxides. The permittee has taken a throughput limitation on the maximum annual heat input for the two (2) bituminous coal/# 2 fuel oil fired boilers and the two (2) #2 fuel oil-fired boilers at the facility to obtain a ''Synthetic Minor'' status. In accordance with 25 Pa. Code §§ 127.424 and 127.425, the Department of Environmental Protection (DEP) has received an application and intends to issue an Air Quality Operating Permit for the previously mentioned facility. The subject facility has the following potential emissions: 17.80 TPY of carbon monoxide; 18.25 TPY of nitrogen oxides; 58.87 TPY of sulfur oxides; 24.66 TPY of particulate matter; 0.30 TPY of volatile organic compounds and 17,427 TPY of greenhouse gases. The Department has determined that the sources at the facility satisfy best available technology (BAT) requirements, pursuant to 25 Pa. Code §§ 127.1 and 127.12, the New Source Performance Standards (NSPS) pursuant to 40 CFR Part 60 Subpart Dc and the National Emission Standards for Hazardous Air Pollutants (NESHAP) pursuant to 40 CFR Part 63 Subpart JJJJJJ and 40 CFR Part 63 Subpart ZZZZ. 10-00021: In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection (DEP) has made a preliminary determination to approve an alternative Reasonably Available Control Technology (RACT II) plan and seeks an approval of an amendment to the State Implementation Plan (SIP) for INDSPEC Chemical Corporation, 133 Main Street, Petrolia, PA 16050, Petrolia Borough, Butler County. And in accordance with 25 Pa. Code § 127.521, the Department of Environmental Protection intends to modify the facility operating permit. The facility's representative to contact concerning this application is Ned Palmer, Site Manager. His phone number is 724-756-9849. The facility was a major source of NOx and VOC emissions. The facility's air emission sources previously included boilers, process heaters, kilns, dryers, reactors, tanks, emergency generators, control devices, and other ancillary equipment. On July 31, 2017 production ceased for all organic resin products at the facility, with all intermediate production and utility operations ending by September 22, 2017. Most of the sources were permanently shut down as of September 11, 2017. The facility is now considered a minor source of all air pollutants.
The modification includes the ERCs approved for the shutdown sources, the over control of Source 235, and removes two engines no longer in use (180 emergency generators and 180D air compressor). In addition, the facility requested removal of Source 169—Sodium Sulfate Product Loading at the Copeland; Source 238—Tank Number T-3069; Source 270—V-8 X-Factor; and, Source 280—V-9 X-Factor. These sources are no longer required, have been emptied, cleaned and rendered unusable.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997, 2008 and 2015 National Ambient Air Quality Standard (NAAQS) for ozone.
The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (10-00021) for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT II requirements in accordance with 25 Pa. Code § 129.97, as they apply to existing sources at this facility.

Requests for an informal conference, or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30-days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30-days of this public notice and contain the name, address, telephone number and the interest of the party filing the request and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

PA DOT propose to replace a Two Span Concrete T-Beam Bridge with a Single Span Pre-Stressed Concrete Bulb T-Beam Bridge on Integral Abutments over the Allegheny River. The existing bridge has a span of 56.77 Ft., a skew of 19 degrees, an underclearance of 4.75 Ft., and a low chord of 1,928.73 Ft. and a hydraulic opening of 191.8 Ft2. The proposed structure has a span of 70.5 Ft., a skew of 19 degrees, an underclearance of 4.95 Ft., and a low chord of 1,928.93 Ft. and a hydraulic opening of 241.6 Ft2. Both the existing and proposed structures will convey the 100-year storm. The proposed structure will utilize R-8 Rip Rap, choked with R-4 Rip Rap scour protection around the integral abutment slopes. The project has an adverse effect on a Historically Eligible structure. PA DOT has entered into a Letter of Agreement with the SHPO to mitigate the adverse effect. The project will utilize a detour to convey traffic during construction. The project will utilize a cofferdam system to convey the stream during construction. The project will temporarily impact 0.02 acre and permanently impact 0.01 acre of jurisdictional wetlands. Allegheny River is classified as a High Quality—Cold Water Fishery by 25 Pa. Code Chapter 93 Water Quality Standards and is listed as both a Class A Wild Trout stream and Stocked Trout Stream by the PA Fish and Boat Commission.
