THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended, and renewed NPDES and WQM permits, applications for permit waivers, and NOIs for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated county conservation district (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a, including links to Individual NPDES and WQM Permits, may be reviewed by generating the ''Final Actions Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Hamilton Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

The plan proposes to abandon the existing Lewis Township WWTP and regionalize with Milton Regional Sewer Authority (MRSA), and includes installation of a pump station and force main, which will travel along Susquehanna Trail, 8th Street Drive, and Vincent Avenue, before ultimately tying into an existing gravity collection and conveyance system owned and operated by MRSA and will serve: the existing Lewis Township wastewater treatment plant (WWTP) service area, which consists of seventy-two (72) residences and the Warrior Run School District campus; the Schell & Koch Road service area, which includes 19 residences; a portion of the Susquehanna Trail/Route 54 corridor containing 8 residences and commercial businesses; and twenty-five (25) to sixty-one (61) low-pressure grinder pump connections in Delaware Township. This proposal's projected cost is expected to be $2,175,000 and the primary funding source identified is up-front revenue, which includes a maximum of $770,000 from the Warrior Run School District, grant funding through the Commonwealth Financing Agency (CFA) Small Water & Sewer grant program and the H2O PA program, and funding through SEDA-COG. Additional financing may be obtained through PennVest in the form of a low interest loan. The submission is consistent with the planning requirements in Chapter 71 of DEP's regulations. No significant environmental or historical impacts were identified in the review of the plan.
HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF

PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT
MAHANOY CITY MGP SITE, MAHANOY CITY BOROUGH, SCHUYLKILL COUNTY Pursuant to Section 1113 of the Pennsylvania Hazardous Sites Cleanup Act, Act of October 18, 1988, P.L. 756, No. 108, 35 P.S. §§ 6020.101—6020.1305 (HSCA), notice is hereby provided that the Pennsylvania Department of Environmental Protection (DEP) has entered into a Consent Order and Agreement (CO&A) with Clyde C. Holman and Christine A. Holman (Settlors) concerning the remedial response action to be implemented at the former Mahanoy City MGP Site (Site).
The Site includes a 0.22-acre tract of land located at 0 West Railroad Street, Mahanoy City, PA 17948 (Property). It is surrounded by residential dwellings and commercial establishments and is open and accessible to the public. The Site includes all areas where hazardous substances or contaminants resulting from a release, or which threaten release, have come to be located. The DEP has determined that a response action is necessary, which will include an investigation of conditions at the Site, and the selection of a remedial response to be implemented at the Site.
The Settlors are each a ''responsible party'' as defined in Section 103 of HSCA, 35 P.S. § 6020.103. Under the terms of the CO&A, within 90 days of receipt of the DEP's accounting of its total Response costs (Cost Package), the Settlors shall allow the placement of a lien by the DEP, on the Property, in the amount set forth in the Cost Package, in settlement of its share of responsibility for the cleanup of the Site.
The specific terms of this settlement are set forth in the CO&A between the DEP and the Settlors. The DEP will receive and consider comments relating to the CO&A for sixty (60) days from the date of this Public Notice. The DEP has the right to withdraw its consent to the CO&A if the comments concerning the CO&A disclose facts or considerations which indicate that the CO&A is inappropriate, improper, or not in the public interest. After the public comment period, the DEP's settlement with Settlors shall be effective upon the date that the DEP notifies Settlors, in writing, that this Consent Order and Agreement is final and effective in its present form, and that the DEP has filed a response to significant written comments to the CO&A, or that no such comments were received.

These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The potential emissions are 1.7 tpy NOx and less than 1.0 tpy for all other criteria pollutants. The facility is subject to State Regulations. 20-00295: Baillie Lumber Company, Inc., Titusville Yard (45529 State Highway 27, Titusville, PA 16354-5727) on April 6, 2021, the Department issued the renewal State-Only Operating Permit of a kiln-drying lumber facility located in Oil Creek Township, Crawford County. Permitted air contamination sources at the facility include a wood-fired boiler, natural gas-fired boilers, a natural gas-fired water heater, wood-drying kilns, miscellaneous woodworking operations, stenciling operation, a metal parts washer, a boiler evaporation pond, and a lumber dip tank. For permitting purposes, the facility is Natural Minor. In this renewal, the wood-drying kilns are reclassified and incorporated as a permitted source. A fuel restriction is added to the natural gas-fired boilers to ensure exemption from 40 CFR 63 Subpart JJJJJJ. 25 Pa. Code § 129.51 is removed as a permit requirement for the lumber dip tank because no VOC limitations/requirements in 25 Pa. Code Chapter 129 apply to the source.
61-00206: RenovEx, Inc. (1028 Stevenson Rd, Grove City, PA 16127-7918) on April 5, 2021, the Department issued the renewal State-Only Operating Permit of a facility, which reprocesses used propane cylinders, located in Barkeyville Borough, Venango County. Permitted air contamination sources at the facility include a spray paint booth, a cylinder wash, shot blasting operations, and a curing oven. The spray paint booth is subject to a 25-TPY VOC restriction established through PA 61-206A. For permitting purposes, the facility is Natural Minor. In this renewal, 25 Pa. Code § 129.52d is incorporated into the permit and replaces § 129.52.
