Federal Consistency under the Coastal Zone Management Act; Wilkins Run Stream Restoration Project

 This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (CZMA) (16 U.S.C.A. § 1455(d)(14)), regarding public participation in consistency determinations. The Department of Environmental Protection's (Department) Coastal Resources Management Program has received notice that the Millcreek Township (applicant) is proposing the Wilkins Run Stream Restoration Project (Project) in Millcreek Township, Erie County.

 The applicant is proposing to restore approximately 1,300 linear feet of the existing Wilkins Run channel and 662 linear feet of an unnamed tributary that confluences with Wilkins Run on a parcel owned by the Lake Erie Region Conservancy. The Project area is bounded by North Wayside Drive, South Wayside Drive, West Lake Road, Hartley Lane and Wolf Run Drive in Millcreek Township. The site consists of a steep, forested stream valley with residences along the surrounding ridges. A stormwater facility is located upslope on a portion of the right descending bank (north side) between the stream and residences. Wilkins Run is beginning to erode the base of the slope at this facility and presents a structural threat. The Project is proposed to consist of the restoration of stream channels, banks and riparian buffers for Wilkins Run and the unnamed tributary in order to stabilize the eroding banks, reduce sediment transport and protect an existing stormwater management pond currently threatened by erosion associated with the streams. The proposed Project will include natural channel design intended to improve channel stability and ecological functioning along the existing channel where possible. The applicant proposes to construct wetlands and vernal pools in portions of the existing channel that are to be abandoned to provide habitat and capture upslope sediments. The applicant estimates that the sediment reduction associated with the Project will amount to approximately 1,067,456 pounds per year. Land uses following completion of the Project are proposed to remain the same as current land uses. The applicant is seeking to obtain a permit from the United States Army Corps of Engineers under section 404 of the Clean Water Act (33 U.S.C.A. § 1344).

 This Project is subject to Department review for Federal consistency because it is an activity requiring a Federal license or permit and will have reasonably foreseeable effects on this Commonwealth's coastal resources or uses.

 In accordance with section 307 of the CZMA (16 U.S.C.A. § 1456) and the National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), Millcreek Township has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program.
