THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended, and renewed NPDES and WQM permits, applications for permit waivers, and NOIs for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated county conservation district (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a, including links to Individual NPDES and WQM Permits, may be reviewed by generating the ''Final Actions Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Hamilton Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board.

PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT
Perkasie TCE HSCA Site, 7th and Spruce Streets, Perkasie, PA 18944, Perkasie Borough, Bucks County. The Department of Environmental Protection (''Department''), under the authority of the Pennsylvania Hazardous Sites Cleanup Act (''HSCA''), 35 P.S. § 6020.1113, has entered a Consent Order and Agreement (''CO&A'') with 601 Perkasie Owner, LLC (''601 Perkasie'') to resolve this party's liability for the Department's response costs incurred to abate the release of hazardous substances at the property located at 7th and Spruce Streets in Perkasie, PA (''the Site''), which is located within the larger Perkasie TCE HSCA Site. 601 Perkasie is a new company which was created by the present owner, 601 Spruce St Investment Partners, LLC for the purpose of financing the redevelopment of the Site. On or about June 21, 2021, 601 Perkasie purchased the Site from the present owner.
The larger Perkasie TCE HSCA Site is an area of commercial and residential properties which have been impacted by groundwater contamination from multiple sources including the Site. From 1946 until approximately 2008, the Site was used by another party which used hazardous substances including trichlorethylene (''TCE'') as a degreasing solvent for onsite operations. In 2013, the Department investigated the Site and found TCE and its breakdown products in groundwater on and in the vicinity of the Site.
The Department has determined that hazardous substances within the meaning of Section 103 of the Hazardous Sites Cleanup Act, 35 P.S. § 6020.103, were released and threatened to be released on the Site. Pursuant to Section 501(a) of HSCA, 35 P.S. § 6020.501(a), the Department has incurred response costs associated with its investigation and other response actions at the Site. As an owner of the Site where hazardous substances were released and threatened to be released, 601 Perkasie is a responsible party which, pursuant to Section 701 of the Hazardous Sites Cleanup Act, (''HSCA'') 35 P.S. § 6020.70, is potentially liable for the Department's response costs.
The Department and 601 Perkasie have signed a CO&A to resolve this company's proportionate liability in the amount of Ten Thousand Dollars ($10,000) for response costs incurred at the Site. In consideration for this payment, 601 Perkasie will receive contribution protection as well as a Covenant Not to Sue regarding hazardous substances released and threatened to be released at the Site.
This notice is provided under Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that, ''settlement shall become final upon the filing of the Department's response to significant written comments''. The CO&A is available for public review and comment. A public comment period on the CO&A will extend for 60 days from today's date. Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.
