PUBLIC WATER SUPPLY PERMITS

 Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.

 Persons wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30 days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. A comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held after consideration of comments received during the 30-day public comment period.

 Following the comment period, the Department will make a final determination regarding the proposed permit. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent (NOI) to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a (NOI) to Remediate with the Department. A NOI to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified person, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.

 Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate Department Regional Office.

 Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

15-0081D: Johnson Matthey Inc. (1401 King Rd., West Chester, PA 19380) for the modification of an existing plan approval emission limits and control efficiency requirements for hydrochloric acid (HCl) and nitric acid (HNO3) emissions from two (2) existing Vertical Wet Scrubbers (Nitric Scrubbers) (Source ID: C02) at their precious metals processing facility in West Whiteland Township, Chester County. This plan approval will supersede Plan Approval 15-0081B. As a result of potential emissions of NOx and VOC, the facility is a State-Only facility. The Plan Approval will contain recordkeeping requirements and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

OPERATING PERMITS

26-00535: Fayette Power Company, LLC (100 Energy Drive, Masontown, PA 15461), the Department intends to renew the Title V Operating Permit and Phase II Acid Rain Permit for the operation of a natural gas-fired power plant, known as the Fayette Energy Facility, located in German Township, Fayette County. The facility's air emission sources include: two (2) General Electric, Frame 7, natural gas-fired combined cycle combustion turbines (CCCT), rated at 1,920 MMBtu/hr maximum capacity, each, and controlled by oxidation catalysts and selective catalytic reduction (SCR). Each combined cycle gas turbine (CTG1, CTG2) is equipped with heat recovery steam generators (HRSG) which include a natural gas-fired duct burner and heat recovery steam rated at 589 MMBtu/hr each are part of each combined cycle train [total maximum heat input capacity of 2,509 MMBtu/hr, for each CGT], one (1) natural gas-fired auxiliary boiler, 30.6 MMBtu/hr; one (1) diesel-fired firewater pump engine, 265 hp; one (1) diesel-fired emergency generator engine, 489 hp and one (1) cooling tower. Turbine exhaust gases are treated with selective catalytic reduction (SCR) for NOx control, and an oxidation catalyst for VOC and CO control. The facility is limited to a maximum opacity from any processing equipment of 10 percent. The facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments due to its potential to emit (PTE) Nitrogen Oxide (NOx), Volatile Organic Compounds (VOC), Particulate Matter less than 10 microns (PM10), Particulate Matter less than 2.5 microns (PM2.5), Sulfur Oxides (SOx), and Carbon Monoxide (CO) emissions. This facility has the potential to emit the following type and quantity of pollutants (not including startup and shutdown emissions): 313 tons per year of PM10, 308 tons per year of PM2.5, 296.1 tons per year of NOx, 581 tons per year of CO, 90 tons per year of VOC, 128.9 tons per year of SOx, 9.6 tons per year of formaldehyde, 16.9 tons per year of HAPs, 166 tons per year of ammonia, and 2,590,616 tons of CO2e greenhouse gases. The permit includes emission limitations and operational, monitoring, testing, recordkeeping, work practices, and reporting requirements for the facility. This renewal action includes the incorporation of newly applicable regulations and the applicable changes authorized through Plan Approval 26-00535B for the Advanced Gas Path (AGP) project that involved select component replacement and changes to combustion control logic to increase the exhaust flow and increase efficiency. The facility is subject to the following regulatory provisions: 25 Pa. Code § 129.93, presumptive RACT requirements and 25 Pa. Code §§ 129.96—129.100 Additional Reasonably Available Control Technology (RACT) Requirements for Major Sources of NOx and VOC, Subpart KKKK—Standards of Performance for Stationary Combustion Turbines, Subpart ZZZZ—National Emissions Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines, 40 CFR 60, Subpart Dc—Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units, 40 CFR 64—Compliance Assurance Monitoring, 40 CFR 72 EPA Acid Rain Permit Program Application, 40 CFR Part 97 Cross-State Air Pollution Rule (CSAPR)-Related Subparts that include: Subpart AAAAA, Subpart CCCCC, and 97 Subpart GGGGG, and State requirements. The 40 CFR 60, Subpart GG—Standards of Performance for Standards of Performance for Stationary Gas Turbines, 40 CFR 60, Subpart Da—Standards of Performance for Electric Utility Steam Generating Units and the 40 CFR 97 Subparts AA, AAA, and AAAA CAIR provisions no longer apply and have been removed from the permit.

 All comments must be received prior to the close of business 30 days after the date of this publication. Each written comment must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Operating Permit (specify Operating Permit OP-26-00535) and concise statements regarding the relevancy of the information or objections to issuance of the Operating Permit.

46-00112: Palmer International, Inc. (2036 Lucon Road, Skippack, PA 19474) is a non-Title V, Synthetic Minor facility located in Skippack Township, Montgomery County. The Synthetic Minor Operating Permit No. 46-00112 is being renewed for another five (5) year term. The facility is a Synthetic Minor for nitrogen oxides (NOx) and volatile organic compounds (VOC). Facility-wide NOx and VOC emissions are each restricted to 24.9 tons per 12-month rolling period. The facility is a manufacturer of intermediate product materials, specifically resins and friction particles. The facility has not made any significant changes to the operation since the operating permit was last modified. The permit will continue to include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

15-00045: Sealed Air Corporation (22 Meredith Ct, Modena, PA 19358), for the renewal of the State Only Operating Permit (Synthetic Minor) in Modena Borough, Chester County. Sealed Air Corporation operates a paper mill, (which takes recycled cardboard and produces packing material for the packaging industry), a dual-fired boiler, an emergency diesel-fired generator, and an emergency diesel-fired fire pump. Sealed Air Corporation has elected to take a restriction on the use of No. 2 fuel oil on the boiler in order to restrict facility-wide nitrogen oxide (NOx) emissions to 24.9 tons per year or less, based on a 12-month rolling sum. Monitoring, recordkeeping, and reporting requirements have been added to the permit to address applicable limitations.

The facility is currently operating under State Only Operating Permit 49-00046. The significant emissions sources at the Mount Carmel Greenhouse are five (5) natural gas/# 2 fuel oil dual-fuel boilers. The facility has potential emissions of 34.8 tons per year of carbon monoxide, 53.0 tons per year of nitrogen oxides, 0.65 ton per year of sulfur oxides, 9.9 tons per year of particulate matter, 2.3 tons per year of volatile organic compounds, 0.8 ton per year of total Hazardous Air Pollutants, and 67,571 tons per year of carbon dioxide equivalents (greenhouse gases). The emission limits, throughput limitations and work practice standards along with testing, monitoring, recordkeeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. 63-01047: MarkWest Liberty Midstream & Resources, LLC/Wilhelm Launcher/Receiver Site (4600 J Barry Court, Suite 500, Canonsburg, PA 15317-5854). In accordance with 25 Pa. Code §§ 127.424, 127.425 and 127.521, the Department is providing notice of intent to issue a natural minor State Only Operating Permit for a pipeline maintenance stand-alone facility where pigs are launched or received from the pipelines, located in Donegal Township, Washington County.

 MarkWest operates six pig receivers and three pig launchers at this site. This facility has the potential to emit 3.0 tons of VOCs and 0.27 ton of HAPs. The proposed operating permit includes conditions relating to applicable emission restrictions, testing, monitoring, recordkeeping, reporting, and work practice standards requirements, as well as conditions required by the April 2018 Consent Decree filed between US EPA, the Department, and MarkWest.

The Department intends to issue the renewal State-Only Operating Permit of a steel fabrication facility, which manufactures waste, scrap, construction-demolition, and recycling equipment, located in Hempfield Township, Mercer County. Permitted air contamination sources are two paint booths and cleaning solvent usage. For permitting purposes, the facility is Natural Minor. In this renewal, 25 Pa. Code § 129.52d, which was promulgated on October 22, 2016, is added as a permit requirement for the paint booths and replaces 25 Pa. Code § 129.52. Section 129.52d of 25 Pa. Code, which has provisions for coating-related cleaning activities, also applies to cleaning solvent usage for precoating surface preparation and paint spray gun cleaning. Promulgated on August 11, 2018, 25 Pa. Code § 129.63a is added as a permit requirement for cleaning solvent usage for maintenance.

62-00163: IA Construction Corporation/Garland Mine (P.O. Box 568, Franklin, PA 16323-0568). The Department is providing notice that they intend to renew a State Only Natural Minor Operating Permit for operation of the aggregate plant located in Pittsfield Township, Warren County. The facility's primary emission source consists of the stationary and portable processing plants, roadways, a stationary engine for the portable radial stacker conveyor, and a nonroad engine that powers the portable plant. The potential emission of the primary pollutants is as follows: PM-10: 22.55 TPY, NOx: 14.82 TPY, CO: 4.1 TPY, and VOC: 0.86 TPY; thus, the facility is a natural minor. The facility is subject to Plan Approval 62-163B, which includes a facility throughput limit of 525,000 tons of material processed in any 12 consecutive month period. The stationary engine is subject to 40 CFR 63 Subpart ZZZZ, NESHAP for Stationary RICE. The aggregate plants are subject to 40 CFR 60 Subpart OOO, Standards of Performance for Nonmetallic Mineral Processing Plants. The renewal permit will contain emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

54-00096A: Blythe Township Landfill (1061 Burma Road, Saint Clair, PA 17970) for their facility located in Blythe Township, Schuylkill County.

 Notice is hereby given in accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), that the Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to Blythe Township Landfill (1061 Burma Road, P.O. Box 335, Saint Clair, PA 17970) for their facility located in Blythe Township, Schuylkill County. This Plan Approval No. 54-00096A will be converted into a natural Minor Permit through an administrative amendment at a later date.

 Plan Approval No. 54-00096A is for the installation and operation of a landfill gas (LFG) Treatment System at the Blythe Recycling and Demolition Site (BRADS). The facility is a construction and demolition (C&D) landfill which began accepting waste in 2019. BRADS identified the presence of landfill gas (LFG) and odors in a temporary leachate sump. In response, a passive solar flare was installed at the leachate. However, because the LFG methane content is currently insufficient to support combustion, the passive flare has not been effective in controlling odors. As requested by the Department, BRADS submitted an odor control plan and implementation schedule to reduce odors from the sump. BRADS has proposed to install and operate a solid scavenger media treatment system to control H2S odor emissions. The system will reduce H2S emissions from the facility to less than 0.03 TPY. The company shall be subject to and comply with 25 Pa. Code § 123.31 for malodorous emissions. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.31); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); the Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); the Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30-days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30-days of this public notice and contain the name, address, telephone number and the interest of the party filing the request and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant.  To perform the following listed water obstruction and encroachment activities associated with Waterfront Maintenance Repairs and Site Development at the (former) Delaware Generating Station. The proposed project involves maintenance repairs to the existing waterward structures, upgrade an existing outfall and stormwater system, and the redesign of existing impervious surfaces to include roadways, a parking lot, landscaping, and a public accessible waterfront walkway. The work will be conducted in three phases—outlined as follows:

Phase I:

 Renovation of the former station building into office space, apartments, and event space.

 Pier 61 North

 • Install a new, approximately 4,300 square-foot reinforced concrete slab on the timber low deck along with approximately 22 steel HP14 piles.

 • Install a new, approximately 7,300 square-foot reinforced concrete slab on the timber low deck over existing piles.

 • Install 27 new 14-inch steel auxiliary pipe piles along the seawall.

 • Conduct repairs to concrete seawall face.

 Upriver Marginal Wharf

 • Install a new, reinforced, approximately 3,560 square-foot concrete slab on the existing timber low deck.

 • Replace existing steel sheet pile wall along approximately 115 linear feet of the inshore portion of the marginal wharf.

 • Install six new 14-inch steel auxiliary pipe piles along the seawall.

 • Install approximately 29 new pile encasements for steel H-piles.

Phase II:

 Site improvements of approximately 322 parking spaces, driveway across Palmer Street, walkways, landscaping, stormwater management, and lighting.

 The applicant also proposes the following site improvements:

 • Construct an approximately 275 space parking lot and provide 47 spaces around the renovated station.

 • Construct a private extension of Palmer Street.

 • Construct nine bioretention basin stormwater management practices (SMP). The basins will treat runoff from the ground-level impervious areas. Each basin will include an outlet control structure engineered to meet PWD's stormwater management requirements.

 • Construct a stormwater collection system that will include catch basins, conveyance piping and associated structures, and will discharge to the SMPs.

 • Enhance the site with landscaping.

Phase III:

 Construct a 935 by 12 linear-foot Public Access River Trail through a 40-foot to 50-foot wide easement along the waterfront wharf seawall. The trail will connect to the existing Delaware River Waterfront Corporation (DRWC)—managed trail located south of the site in Penn Treaty Park and extend to the northern boundary of the site. The trail will be paved and marked with appropriate signage with shoulders and landscaped areas proposed on either side of the trail.

The project proposes .01 acre of direct permanent watercourse impact, and .05 acre of direct permanent floodway impact.

 The applicant proposes to:

 1. Construct, operate, and maintain a stream bank restoration project in and along 1,000 LF of UNT # 1 to Thompson Run (WWF). Within this reach the following activities/structures are proposed:

 a) Stream bank regrading along 900 LF and rock toe protection along 112 LF of the right descending bank;

 b) One rock cross vane, seven log vanes and one log rollover;

 c) Branch layering along 557 LF of stream bank; and

 2. Construct, operate, and maintain 27 LF of branch layering within UNT #2 to Thompson Run (WWF).

 For the purpose of providing nutrient and sediment load reduction toward Penn Hills Township's MS4 requirements of their NPDES permit and to provide stream bank protection to an existing sewerline. Cumulatively, the project will permanently impact 1,000 linear feet of a two UNTs to Thompson Run and permanently impact 1.65 acres of associated floodway.

 The project site is located west of Thompson Run Road (Braddock, PA USGS topographic quadrangle; N: 40°, 27`, 18.93"; W: -79°, 47`, 54.99"; Sub-basin 19A; USACE Pittsburgh District), in Penn Hills Township, Allegheny County.

 The applicant proposes to:

 1. Dredge and maintain an existing stormwater detention basin, which is located on an unnamed tributary (UNT) to South Branch Brady Run (TSF), to provide additional storage capacity. The size of the basin will increase from 0.67 acre with a storage volume of 124,361 cubic feet, to an area of 1.4 acres with a storage volume of 359,675 cubic feet. The basin is a non-jurisdictional dam.

 2. Remove an existing 4-foot by 4-foot concrete outfall structure, which discharges the UNT into the aforementioned basin, and construct and maintain a replacement 4-foot by 4-foot concrete outfall structure.

 3. Construct, operate, and maintain a 19-foot-long 36-inch RCP road crossing within the aforementioned UNT, with a 5-foot foot by 9-foot by 3.75-foot concrete headwall and endwall.

 4. Construct, operate, and maintain a 41-foot-long 72-inch reinforced concrete pipe (RCP) road crossing within a second UNT to South Branch Brady Run, with a 10-foot by 17.5-foot by 6.75-foot concrete headwall and endwall.

 For the purpose of providing sediment load reduction toward Brighton Township's MS4 requirements of their NPDES permit, and to provide permanent access to the basin for maintenance operations. Cumulatively, the project will permanently impact 283 linear feet of the UNTs, temporarily impact 411 feet of the UNTs, permanently impact 1.4 acres of the floodway of the UNTs, and temporarily impact 1.5 acres of the floodway of UNTs.

 The project site is located approximately 0.2 mile north of the intersection of Edgewood Drive and Little Beaver Drive (Midland, PA USGS topographic quadrangle; N: 40°, 42`, 40.52"; W: -80°, 24`, 19.55"; Sub-basin 20B; USACE Pittsburgh District), in Brighton Township, Beaver County.

 The applicant proposes to:

 1. Place and maintain fill in a 0.09-acre PEM wetland;

 2. Place and maintain fill in a second 0.03-acre PEM wetland;

 3. Place and maintain fill in a third 0.03-acre PEM wetland;

 4. Construct, operate, and maintain 164 linear feet of 42-inch RCP within an unnamed tributary (UNT) to Little Chartiers Creek (HQ-WWF), which has a drainage area less than 100 acres;

 5. Construct, operate, and maintain an 8-inch diameter PVC sewer line crossing, a 4-inch diameter PVC gas utility line crossing, an 8-inch diameter C900 PVC water line crossing, a 30-inch diameter SLCPP storm sewer line crossing, and multiple 4-inch electricity line crossings, all with a 50-foot Right-of-Way (RoW), across the aforementioned enclosed UNT;

 6. Place and maintain fill in 76 linear feet of a second UNT, which has a drainage area less than 100 acres;

 7. Place and maintain fill in 120 linear feet of a third UNT, which has a drainage area less than 100 acres.

 For the purpose of developing a 201-acres site into 251 single family lots with associated infrastructure. Cumulatively, the project will permanently impact 460 linear feet of streams, permanently impact 0.83 acre of floodway, and permanently impact 0.15 acre of wetlands. To mitigate for permanent impacts to streams, the applicant proposes to enhance 930 linear feet of the UNT, located downstream of the project, through riparian buffer plantings. To mitigate for permanent impacts to wetlands, the applicant proposes to purchase 0.15 wetland mitigation credits from the Robinson Fork Phase 1 Mitigation Bank within the Ohio River Sub-basin 20.

 The project site is located on the east side of Mansfield Road, approximately 500 feet south of its intersection with SR 19 (Washington East, PA USGS topographic quadrangle; N: 40°, 13`, 10.6"; W: -80°, 10`, 16.4"; Sub-basin 20F; USACE Pittsburgh District), in North Strabane Township, Washington County.

The project will result in a total of 1,801-linear feet of permanent stream impacts, 1,215-linear feet of temporary stream impacts, 0.085-ac of permanent wetland impacts (including 0.07-ac of impacts to EV wetlands) and 0.36-ac of temporary wetland impacts. The applicant proposes a combination of on-site stream mitigation and the purchase of off-site stream mitigation credits at an accredited stream mitigation bank, and permanent wetland impacts will be debited from the applicant's Clarion County Wetland Bank Site.

The applicant proposes the relocation and restoration of 1,608-ft of perennial stream channel, 1,316-ft of intermittent stream channel, and 474-ft of ephemeral stream channel. The project will also result in permanent wetland impacts of 0.99-ac and temporary wetland impacts of 0.77-ac. Chesapeake Appalachia, LLC, Civil Action No. 4:21—00538-MWB CALLC entered into with the U.S. Environmental Protection Agency and PADEP on May 20, 2021. The project is to construct, operate and maintain 0.037 acre of temporary wetland impact and 0.064 acre of permanent impact to on-site wetlands. All impacts are associated with the May Bra Pad construction in 2009. Finally, 0.054 acre of on-site wetland are being restored.

 There are no stream and floodway impacts associated with this after-the-fact authorization. The project will result in a total of 2,788 SF (0.0640 acre) of permanent and 3,955 SF (0.0907 acre) of temporary wetland impacts.

STORAGE TANKS

SITE-SPECIFIC INSTALLATION PERMITS

 The following Storage Tank Site-Specific Installation Permit application has been received by the Department of Environmental Protection (Department) and is currently under review. Persons wishing to comment on the proposed permit are invited to submit a statement to the Bureau of Environmental Cleanup and Brownfields, Division of Storage Tanks, P.O. Box 8762, Harrisburg, PA 17105-8762, within 30 days from the date of this publication. Comments may also be submitted via email to tanks@pa.gov. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of the comment and the relevant facts upon which it based.


The following applications have been received for Storage Tank Site-Specific Installation Permits under the authority of the Storage Tank Spill Prevention Act (35 P.S. 6021.304, 6021.504, 6021.1101 and 6021.1102) and under 25 Pa. Code Chapter 245, Subchapter C.
