Regulations for Child Care Providers; Corrective  Amendment to 55 Pa. Code § 3290.4

 The Department of Human Services has discovered a discrepancy between the agency text of 55 Pa. Code § 3290.4 (relating to definitions) and the text published in the final-form rulemaking at 50 Pa.B. 7133 (December 19, 2020). The definition of ''random sample'' was to be deleted and was inadvertently left in the text of § 3290.4.

 Therefore, under 45 Pa.C.S. § 901 (relating to official text of published documents), the Legislative Reference Bureau is publishing this corrective amendment which is effective as of December 19, 2020, the date the defective official text was announced in the Pennsylvania Bulletin.

 The correct version of § 3290.4 appears in Annex A, with ellipses referring to the existing text of the regulation.

§ 3290.4. Definitions.

Parent—The biological or adoptive mother or father, legal guardian or foster mother or father of the child.

Potentially hazardous food—A food that consists in whole or in part of milk or milk products, eggs, meat, poultry, fish, shellfish or other ingredients capable of supporting rapid and progressive growth of infectious or toxigenic microorganisms.

Regional office of child care—Departmental offices responsible for certified child care facilities located in counties assigned to the regional office. A certificate of compliance is issued by a regional office to the legal entity responsible for the operation of a family child care home.
