Findings

 Under section 2002 of The Administrative Code of 1929 (71 P.S. § 512) establishing the Department of Transportation (Department), the Director of the Bureau of Design and Delivery, as delegated by the Secretary of Transportation, makes the following written findings:

 The Department is planning the projects listed as follows. Environmental and Section 4(f) Documentation have been developed for the following identified projects to evaluate the potential environmental impacts caused by these projects. The Section 4(f) documents also serve as the Section 2002 Evaluation. The approved documents are available in the CE/EA Expert System at http://www.dotdom2.state.pa.us/ceea/ceeamain.nsf. The environmental, economic, social and other effects of the proposed projects have been considered. Based upon studies, there is no feasible and prudent alternative to the use of the Section 2002 resources for the proposed identified projects, and all reasonable steps have been taken to minimize the effects.

• SR 0026, Section 147—Marion Township, Centre County.

Project Description: The project involves an overlay, road widening, vertical curve improvements, drainage improvements and guide rail updates along SR 0026.

Environmental Documents: CE BRPA Evaluation approved on November 2, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on July 20, 2021.

Proposed Use of Section 4(f)/2002 Resource: Approximately 0.012-acre of right-of-way (ROW) will be required from the 2,967-acre State Game Land # 323, which qualifies as a Section 4(f)/2002 resource.

• SR 2011, Section A07—Millheim Borough, Centre County.

Project Description: The project is the replacement of the existing structure that carries Penn Street (SR 2011) over Mill Race.

Environmental Documents: ED BRPA Reevaluation approved on October 25, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved March 25, 2020.

Proposed Use of Section 4(f)/2002 Resources: The Millheim Historic District is listed on the National Register of Historic Places (NRHP). The Penns Valley and Brush Valley Rural Historic District was determined to be eligible for listing on the NRHP. Approximately 0.008-acre of ROW will be required from both historic districts.

• SR 3014, Section 153—State College Borough, College, Harris and Patton Townships, Centre County.

Project Description: The project is the reconstruction of drainage and pavement along Atherton Street (SR 3014). Additionally, pedestrian and streetscape improvements will be included.

Environmental Documents: CE BRPA Reevaluation approved on November 23, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on November 23, 2021.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.012-acre of ROW will be required from the 96-acre Farmers' High School Historic District, which is listed on the NRHP.

• SR 0287, Section 141—Pine Township, Lycoming County.

Project Description: The project is the replacement of the structure that carries SR 287 over Lick Run.

Environmental Documents: CE 1b Evaluation approved on November 2, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on October 28, 2021.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.361-acre of ROW and a permanent channel easement of 0.147-acre will be required from the 27,499-acre State Game Land # 75, which qualifies as a Section 4(f)/2002 resource.

• SR 0081, Section 511—New Milford Township, New Millford Borough, Great Bend Township and Great Bend Borough, Susquehanna County.

Project Description: The project is the reconstruction of 9 miles of Interstate 81 including replacement of multiple structures.

Environmental Documents: CE 2 Reevaluation approved on November 1, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on September 23, 2021.

Proposed Use of Section 4(f)/2002 Resources: Approximately 1.8306-acres of ROW and 0.7120-acre of slope easement will be required from the 7,772-acre State Game Land # 35, which qualifies as a Section 4(f)/2002 resource.

• SR 0248, Section 05S—Bath Borough, Northampton County.

Project Description: The project involves the realignment and improvement of the West Main Street and West Northampton Street intersection in Bath Borough and the replacement of the bridge carrying West Northampton Street (SR 0248) over Monocacy Creek.

Environmental Documents: CE 2 Evaluation approved on October 4, 2021, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on May 30, 2021, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on May 21, 2021, a Nationwide/Programmatic Section 4(f) Evaluation for Projects that Necessitate the Use of Historic Bridges approved on May 30, 2021 and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on May 20, 2021.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.017-acre of ROW and 0.006-acre of drainage easement will be required from the 0.7-acre Monocacy Creek Park. Approximately 0.038-acre of ROW will be required from the 0.23-acre Old Forge Tot Lot. The Monocacy Creek Park and the Old Forge Tot Lot both qualify as Section 4(f)/2002 resources. Approximately 0.204-acre of ROW and 0.009-acre of drainage easement will be required from the 122.5-acre Bath Historic District, which was determined to be eligible for listing on the NRHP. The existing West Northampton Street Bridge is considered a contributing element to the Bath Historic District. Approximately 0.016-acre of ROW will be required from the Daniel Steckel House, which is listed on the NRHP.

• SR 7210, Section MBR—Lower Saucon Township, Northampton County.

Project Description: The project is the removal of the structure carrying Meadows Road over Saucon Street (T376) over Saucon Creek.

Environmental Documents: CE 2 Evaluation approved on November 9, 2021, and a Nationwide/Programmatic Section 4(f) Evaluation for Projects that Necessitate the Use of Historic Bridges approved on November 2, 2021.

Proposed Use of Section 4(f)/2002 Resources: The existing structure, Northampton County Bridge No. 15/Meadows Road Bridge, is listed on the NRHP.

• SR 1012, Section BRC—Tinicum Township, Bucks County.

Project Description: The project is the replacement of the existing structure that carries Headquarters Road over Tinicum Creek.

Environmental Documents: CE 2 Reevaluation approved on October 4, 2021, and a Final Section 4(f) Evaluation approved August 21, 2018.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.015-acre of ROW and approximately 0.005-acre of slope easement will be required from the Ridge Valley Rural Historic District. The existing bridge is also considered a contributing resource to the Ridge Valley Rural Historic District.

• SR 2049, Section BLW—Middletown Township, Bucks County.

Project Description: The project consists of improvements to two signalized intersections, Langhorne-Yardley Road (SR 2049) and Woodbourne Road (SR 2033).

Environmental Documents: CE 2 Evaluation approved on October 27, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on March 30, 2020.

Proposed Use of Section 4(f)/2002 Resource: Approximately 2.88-acres of ROW and 0.03-acre of drainage easement will be required from the 1,185-acre Core Creek Park, which qualifies as a Section 4(f)/2002 resource.

• SR 7023, Section 237—Folcroft Borough and Darby Township, Delaware County.

Project Description: The project is the replacement of the existing Delaware County Bridge # 237 that carries Tribbett Avenue over Hermesprota Creek.

Environmental Documents: CE 1b Reevaluation approved on October 5, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on August 15, 2013.

Proposed Use of Section 4(f)/2002 Resource: Approximately 0.7-acre of ROW and 0.076-acre of slope easement will be required from the 5.43-acre Arnold L. Covert, Sr. Park, which qualifies as a Section 4(f)/2002 resource.

• SR 7046, Section 275—Cheltenham Township, Montgomery County.

Project Description: The project is the replacement of the Waverly Road Bridge over Tacony Creek.

Environmental Documents: CE 1b Evaluation approved on October 21, 2021, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on September 16, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on September 16, 2021.

Proposed Use of Section 4(f)/2002 Resource: Approximately 0.027-acre of ROW will be required from the 8.278-acre Harry S. Renninger Recreation Area, which qualifies as a Section 4(f)/2002 resource. Approximately 0.009-acre will be required from the Glenside War Memorial Hall, which is listed on the NRHP.

• SR 0949, Section 554—Eldred Township, Heath Township and Washington Township, Jefferson County.

Project Description: The project is the replacement of the existing bridge that carries SR 0949, Waverly Road Bridge, over Pine Run.

Environmental Documents: CE 1b Reevaluation approved on December 2, 2021, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on July 24, 2019.

Proposed Use of Section 4(f)/2002 Resource: Approximately 0.42-acre of ROW will be required from the 16,229-acre Clear Creek State Forest, which qualifies as a Section 4(f)/2002 resource.
