STATE CONSERVATION COMMISSION
PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling (717) 787-8821.
Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent (NOI) to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a (NOI) to Remediate with the Department. A NOI to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified person, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. 63-01056A: Bloom Engineering Company, Inc., 100 Vista Drive, Charleroi, PA 15022. Notice is hereby given in accordance with 25 Pa. Code §§ 127.44—127.46 that the Department of Environmental Protection (Department) intends to issue Air Quality Plan Approval 63-01056A to allow the construction of equipment to be used in the manufacture and study of natural gas and oil burners for industrial furnaces located in Fallowfield Township, Washington County.
The facility consists of four (4) natural gas-fired curing ovens, each rated less than 2.0 MMBtu/hr; two (2) refractory mixing stations; one (1) paint booth, controlled by dry fiberglass filters; welding of fabricated pieces, controlled by a dust collector; one (1) 33.5 hp natural gas-fired emergency generator; testing laboratory, comprised of twenty (20) testing furnaces and one (1) 1.5 MMBtu/hr natural gas-fired boiler; and three (3) parts washers. Potential emissions from the project are 20.4 tons of nitrogen oxides (NOx), 8.6 tons of carbon monoxide (CO), 3.0 tons of particulate matter less than 10 microns in diameter (PM10), 0.7 ton of sulfur oxides (SOx), 1.7 tons of volatile organic compounds (VOC), less than 1.0 ton of combined hazardous air pollutants (HAP), less than 0.5 ton of single HAP, and 22,500 tons of greenhouse gases (GHGs) as carbon dioxide equivalents (CO2e), per year. The Department has determined that the proposed facility satisfies Best Available Technology (''BAT'') requirements. The authorization is subject to State regulations including 25 Pa. Code §§ 123.1, 123.2 and 123.31; and Federal National Emission Standards for Hazardous Air Pollutants (NESHAP) from 40 CFR Part 63 Subpart ZZZZ—National Emissions Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines (RICE) and 40 CFR Part 63 Subpart XXXXXX—National Emissions Standards for Hazardous Air Pollutants Area Source Standards for Nine Metal Fabrication and Finishing Source Categories. The Plan Approval has been conditioned to ensure compliance with all applicable rules. This includes emissions restrictions, operational restrictions, work practice, monitoring, recordkeeping, and reporting conditions. Once compliance with the Plan Approval is demonstrated, the applicant will subsequently apply for a State Only Operating Permit in accordance with 25 Pa. Code Subchapter F.

AMS Plan Approval No. IP21-000107: Sun Chemical Corporation, 3301 W Hunting Park Ave., Philadelphia, PA 19132 , for the shutdown, removal, and replacement of three (3) electric mixers that are part of Emission Group 01—Blending and Dispersion Operations in Manufacturing Group 140 (MFG 140): Mixer 1 (M-01), Mixer 6 (M-06) and Mixer 7 (M-07), at their facility in the City of Philadelphia, Philadelphia County. The process change has a potential emission's increase of 21.89 tons per year of volatile organic carbons and 0.10 ton per year of particulate matter. Emissions increases are due to production changes as a result of the replacement. The plan approval will contain operating, monitoring, and recordkeeping requirements to ensure operation within all applicable requirements.

To renew a Title V Operating Permit for the Lyon Station Smelter facility located in Richmond Township, Berks County. The actual emissions from the facility in the 2020 year were estimated at 19.8 tons CO, 50.4 tons NOx, 5.8 tons PM-10/PM2.5, 40.8 tons SOx and 3.0 tons VOC. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations. Among other items, the conditions include provisions derived from 40 CFR 63 Subpart L, 40 CFR 63 Subpart X, 40 CFR 63 Subpart ZZZZ and CAM.

TV-63-00074: Langeloth Metallurgical Company, LLC, P.O. Box 608, 10 Langeloth Plant Dr., Langeloth, PA 15054-0608. In accordance with 25 Pa. Code §§ 127.424, 127.425 and 127.521, the Department is providing notice that it intends to issue a renewal Title V Operating Permit (TVOP) to authorize the operation of the Langeloth Metallurgical Plant located in the Smith Township, Washington County.
Equipment at this facility includes two (2) natural gas-fired roasters rated at 8.6 Mcf/hr, two (2) natural gas-fired roasters rated at 12.5 Mcf/hr, two (2) natural gas-fired roasters rated at 16.3 Mcf/hr, a sulfuric acid plant rated at 10.0 tons/hr of sulfuric acid which functions as a sulfur dioxide control device for the roasters when operating on high sulfur content feedstocks, an aluminothermic process rated at 15.0 tons/hr of ferromolybdenum alloys, a pure molybdenum trioxide production process rated at 0.50 ton/hr of molybdenum, and four (4) natural gas-fired emergency generators rated at 454 Bhp each. Particulate matter emissions from the roasters are controlled by multi-cyclones and an electrostatic precipitator. Particulate matter emissions from the aluminothermic process are controlled by two (2) baghouses. Particulate matter emissions from the pure molybdenum trioxide process are controlled by two (2) baghouses.
Potential emissions for the facility including emission restrictions have been calculated as follows: 31.58 tons per year of carbon monoxide (CO), 34.79 tons per year of nitrogen oxides (NOx), 86.85 tons per year of particulate matter less than 10-microns (PM10), 219.50 tons per year of sulfur oxides (SO2), 2.81 tons per year of volatile organic compounds (VOC), 0.03 ton per year of acetaldehyde, 0.02 ton per year of acrolein, 0.20 ton per year of formaldehyde, 0.59 ton per year of hexane, 0.87 ton per year total Hazardous Air Pollutants (HAP), and 39,934 tons per year of greenhouse gases (GHGs). The emission restrictions and testing, monitoring, recordkeeping, reporting and work practice conditions of the TVOP have been derived from the applicable requirements of 40 CFR Parts 60, 61, 63, and 70, and 25 Pa. Code Article III, Chapters 121—145.

Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the District Mining Office indicated above each application within 30-days of this publication, or within 30-days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences). Such comments or objections should contain the name, address and phone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.
In addition, requests for an informal conference, or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 (relating to public hearing-informal conferences) or § 86.34 (relating to informal conferences), must also contain a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
Where a National Pollutant Discharge Elimination System (NPDES) number is listed, the mining activity permit application is associated with an application for an NPDES permit. A separate notice will be provided for the draft NPDES permit.

The crossing will carry S.R. 2008 (Main Street) over Nanticoke Creek.
2) To remove an existing stream crossing and to construct a stream crossing of Nanticoke Creek (CWF, MF) consisting of a 90-ft long, 10-ft wide, 5-ft high concrete box culvert having concrete wingwalls, an invert depressed 1.0-ft, and R-6 riprap choked with natural streambed material. The crossing will carry S.R. 2010 (Hanover Street) over Nanticoke Creek.
3) To remove an existing stream enclosure and to construct a stream enclosure of Nanticoke Creek (CWF, MF) consisting of a 436-ft long, 48-in diameter corrugated metal pipe, concrete wingwalls, and R-6 riprap choked with natural streambed material. The enclosure will carry a local gravel trail over Nanticoke Creek.
4) To modify an existing stream enclosure of Nanticoke Creek (CWF, MF) with work consisting of an 11-ft, 18-in diameter corrugated metal pipe extension and riprap apron.
5) To modify an existing dual stream enclosure of Nanticoke Creek (CWF, MF) with work consisting of two (2) 11-ft, 36-in diameter corrugated metal pipe extension and riprap apron.

Wetland Fill
2. To impact a de minimus area of PEM wetland equal to 0.02 acre due to construction of the proposed roadway slope embankment and the creation of a stormwater basin.
Floodway Fill
3. To impact approximately 0.27 acre of floodway of Little Cedar Creek (HQ-CWF, MF) for the placement of fill and stream restoration related grading.
Stream Enclosure Maintenance
4. To perform maintenance on an existing stream enclosure that carries SR 309 across Little Cedar Creek that includes replacing a portion of the downstream side of the structure. The proposed enclosure will be 134-ft wide with a normal clear span of 17-ft and a 5-ft minimum underclearance.
Stream Restoration
5. To impact 360-LF of Little Cedar Creek (HQ-CWF, MF) for multiple activities upstream and downstream of the culvert carrying SR 309 over Little Cedar Creek. Concrete channel lining will be removed from the channel downstream of the culvert. A preformed scour hole consisting of approximately 30-LF of R-8 riprap and 75-LF R-5 riprap will be constructed at the culvert outlet. The streambed at the downstream end of the scour hole will also be raised 6" to provide more baseflow through the culvert. Approximately 30-LF of R-8 riprap choked with streambed material followed by approximately 70-LF of R-5 riprap choked with streambed material will also be installed immediately downstream of the preformed scour hole. Upstream of the culvert, approximately 150-LF of R-5 riprap choked with streambed material will be placed for streambed stability.
The proposed project is located along SR 309 and extends from the US-22 interchange ramps and continues south to the I-78 interchange ramps. The applicant proposes to construct and maintain 1) a 64.5-foot long 25.0-foot wide by 4.75-foot high box culvert with fish baffles and associated endwalls in a UNT to Fishing Creek (TSF, MF), permanently impacting 0.01 acre of wetland and temporarily impacting 0.01 acre of wetland, 2) a 4.0-inch PVC gas line conduit, a 6.0-inch PVC sanitary sewer line, a 3.0-inich ductile iron water line, and an 8.0-inch ductile water line crossing of a UNT to Fishing Creek (TSF, MF) all co-located under the proposed box culvert, 3) an 18.0-inch stormwater outfall into the floodway of a UNT to Fishing Creek (TSF, MF), permanently impacting 0.01 acre of floodway, and 4) the relocation of 865 linear feet of a UNT to Fishing Creek (TSF, MF) by way of enclosure of 714-linear feet in a 42.0-inch culvert, and the reconstruction of 611 linear feet of open channel. The purpose of the project is to construct a 243,000 square foot warehouse/office building with associated facilities at 575 Old York Road in Fairview Township, York County (Latitude: 40.1744; Longitude: -76.8322). The applicant proposes the 611 linear feet of stream mitigation through in-place enhancements as well as the removal of an existing bridge structure over a UNT to Fishing Creek (TSF, MF) and 0.11 acre of wetland compensation through on-site wetland creation.

Additional permanent impacts that will result from this amendment will consist of 1,000 SF of watercourse impacts for the installation of the revised intake structure. Compensatory mitigation is not proposed due to the nature of the project.

This project is an after-the-fact permit that is associated with the Chesapeake Audit and will result in 14,767 square feet (0.339 acre) of permanent PEM wetland impacts, all for the purpose of building a water impoundment for Marcellus well development in Litchfield, Township, Bradford County. To construct, operate and maintain a 320` by 350` well pad impacting 33,023 square feet of a palustrine emergent (PEM) wetland. (Blossburg, PA Quadrangle, Latitude: 41° 44` 36"; Longitude: -77° 00` 01"). Impacts are a result of the original well pad owner building a well pad in wetlands in 2010. The construction of the well pad resulted in 29,974 square feet (0.688 acre) of permanent wetland impacts and 3,049 square feet (0.070 acre) of temporary wetland impacts in Sullivan Township, Tioga County. The permittee will provide 29,974 square feet (0.688 acre) of off-site compensatory mitigation at the Butters Mitigation Site (Blossburg, PA Quadrangle 41° 44` 55" N, 77° 03` 16" W).

The construction of the well pad resulted in 13,508 square feet (0.31 acre) of permanent wetland impacts and 15,065 square feet (0.35 acre) of temporary wetland impacts in Sullivan Township, Tioga County. The permittee will provide 0.31 acre of off-site compensatory mitigation at the Butters Mitigation Site (Blossburg, PA Quadrangle 41° 44` 55" N, 77° 03` 16" W).

This project seeks after-the-fact authorization in accordance with the Consent Decree Chesapeake Appalachia, LLC entered into with the U.S. Environmental Protection Agency and the PA Department of Environmental Protection on May 20, 2021. As previously referenced, Water Obstruction and Encroachment (WOEP) Application E0829222-015 Chesapeake Appalachia, LLC (Chesapeake) has applied for an Individual—Joint Permit to construct, operate and maintain 0.649 acre of permanent and 0.111 acre of temporary impacts to on-site wetlands. All impacts are associated with the Rexford Bra Pad construction in 2010.
There are no stream and floodway impacts associated with this after-the-fact authorization. The project will result in a total of 28,270 SF (0.649 acre) of permanent and 4,835 SF (0.111 acre) of temporary wetland impacts.

Applicant proposes to remove the Hanover Lower Dam to eliminate a threat to public safety and to restore approximately 550 feet of stream channel to a point where it will join a stream channel which will be constructed as a separate project. The stream is conveyed through two stone and concrete tunnels under the old Lehigh Valley railroad grade, portions of which have collapsed. The stream channel construction will consist of a two-stage channel with a low-flow thalweg channel, transitioning into a step pool configuration following steep grade.
