Public Notification to Solicit Comments on Lackawanna Energy Center, LLC
Title V Operating Permit Permit No. TV-35-00069 Notice is hereby given under 25 Pa. Code §§ 127.424 and 127.521, that the Department of Environmental Protection (Department) is soliciting comments on the proposed initial Title V Operating Permit 35-00069 for Lackawanna Energy Center, LLC (the Permittee), 1000 Sunnyside Road, Jessup, PA 18434-6400 to incorporate Plan Approval 35-00069B and applicable emission limits, monitoring, testing, recordkeeping and reporting requirements into the proposed initial Title V Operating Permit.
The facility is a natural gas-fired combined-cycle power plant producing a nominal 1,500 MWs of electricity in Jessup Borough, Lackawanna County.
It consists of three (3) identical 1 x 1 power blocks. Each combined-cycle process block includes one (1) combustion gas turbine with one (1) heat recovery steam generator, one (1) steam turbine, and one (1) air-cooled condenser. Additionally, one (1) 2,000 kW diesel-fired emergency generator, one (1) 315 HP diesel-fired emergency fire water pump, one (1) 184.8 MMBtu/hr natural gas-fired boiler, one (1) 12 MMBtu/hr natural gas-fired fuel gas heater, three (3) lubricating oil storage tanks, and one (1) aqueous ammonia storage tank. The potential to emit in tons per year (tpy) for the facility is 304.4 tpy of NOx, 269.6 tpy of CO, 68.7 tpy of VOC, 73.1 tpy of PM, 147.5 tpy of PM10/PM2.5, 39.9 tpy of SO2, 31.0 tpy of H2SO4, 0.031 tpy of Pb, 9.4 tpy of HCHO, 4,938,598 tpy of CO2e, and 22.8 tpy total HAPs.

The project also includes upgrades at the Compressor Station 515 in Luzerne County (Latitude: 41° 10` 24.09"; Longitude: -75° 40` 18.20"), Delaware River Regulator in Northampton County (Latitude: 40° 45` 43.7976"; Longitude: -75° 11` 47.184", no resource impacts), existing valve setting on Transco's Mainline ''A'' in Bucks County (Mainline A Regulator) (Latitude: 40° 16` 5.0268"; Longitude: - 74° 51` 25.65", no resource impacts); Compressor Station 200 in Chester County (Latitude: 40° 2` 59.89"; Longitude: -75° 35` 9.06", no resource impacts), Compressor Station 195 in York County (Latitude: 39° 44` 42"; Longitude: -76° 21` 33, no resource impacts and no earth disturbance), Delaware County (Latitude: 39° 48` 47.7144" Longitude: 75° 25` 48.216", no resource impacts and no earth disturbance), and various additional ancillary facilities and pipe yards.
On March 26, 2021, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP21-94-000. FERC provided a Draft Environmental Impact Statement for the Project on March 2, 2022, which may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP21-94-000).
On March 31, 2021, Applicant requested a state water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (DEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.
The Project, as proposed, includes approximately 22.3 mile long 30-inch pipeline and 13.8 mile long 42-inch pipeline to transport natural gas from a Marcellus Shale production area in northeastern Pennsylvania to multiple delivery points along Transco's Leidy Line in PA, Transco's mainline at the Station 210 Zone 6 Pooling Point in Mercer County, New Jersey and multiple delivery points in Transco's Zone 6 in NJ, PA, and MD. The Project, as proposed, will require approximately 672 acres of earth disturbance, and impacts 2,623 linear feet of temporary impacts and 3,029 linear feet of permanent impacts to tributaries to McMichael Creek (HQ-CWF, MF), tributary to Pohopoco Creek (HQ-CWF, MF), Sugar Hollow Creek (HQ-CWF, MF), tributary to Poplar Creek (EV, MF), tributary to Mud Run (HQ-CWF, MF), tributaries to Tunkhannock Creek (HQ-CWF, MF), tributaries to Shades Creek (HQ-CWF, MF), Shades Creek (HQ-CWF, MF), Little Shades Creek (HQ-CWF, MF), tributary to Meadow Run (HQ-CWF, MF), Meadow Run (HQ-CWF, MF), tributaries to Bear Creek (HQ-CWF, MF), Bear Creek (HQ-CWF, MF), tributaries to Little Bear Creek (HQ-CWF, MF), tributaries to Mill Creek (HQ-CWF, MF), Mill Creek (HQ-CWF, MF), tributary to Gardner Creek (CWF, MF), Gardner Creek (CWF, MF), tributaries to Susquehanna River (WWF, MF), Susquehanna River (WWF, MF), Abrahams Creek (CWF, MF), tributaries to Abrahams Creek (CWF, MF), tributaries to Toby Creek (CWF, MF), tributaries to Trout Brook (CWF, MF), Trout Brook (CWF, MF); 14.01 acre(s) of temporary floodway impacts; 7.21 acre(s) of permanent floodway impacts; 6.46 acre(s) of temporary PFO, PSS, and PEM wetland impacts; and 9.69 acre(s) of PFO, PSS, and PEM permanent impacts.
DEP published notice of its receipt of Applicant's SWQC application and of its proposed SWQC in the Pennsylvania Bulletin on September 18, 2021 (51 Pa.B. 6108) for a 30-day public comment period. On October 30, 2021, DEP extended the public comment period to December 6, 2021 (51 Pa.B. 6842). DEP received 996 comments from the public. Both Pennsylvania Bulletin notices contained an incorrect application number, WQ0083221-001. The proper application number is WQ0083221-002.
On March 30, 2022, after evaluation and consideration of the comments, DEP issued a conditional State Water Quality Certification (SWQC) to Transcontinental Gas Pipe Line Company, LLC (Transco) for the Regional Energy Access Expansion Project. This SWQC is conditioned on Transco obtaining all necessary state permits, approvals and authorizations for the Project, including those required under 25 Pa. Code Chapter 92a (relating to National Pollutant Discharge Elimination System Permitting, Monitoring and Compliance), 25 Pa. Code Chapter 102 (relating to Erosion and Sediment Control) and 25 Pa. Code Chapter 105 (relating to Dam Safety and Waterway Management), and complying with all conditions set forth in the SWQC.
Pennsylvania possesses a water quality standards program that is integrated into the Pennsylvania water permitting programs to ensure protection of waters of the Commonwealth in accordance with Pennsylvania law and the Federal Clean Water Act. The water quality certification ensures that Transco will comply with water quality standards through the established permitting processes. Transco must obtain the applicable permits before it can begin construction. Applicable permits include permits issued under 25 Pa. Code Chapters 92a, 102 and 105.
All written comments received by DEP during the public comment period, from September 18, 2021 to December 6, 2021, have been reviewed and considered. DEP will continue to evaluate and consider these comments during the review of the Chapter 92a, Chapter 102, and Chapter 105 permit applications. Additionally, DEP will schedule a formal public hearing prior to taking action on the Chapter 102 and Chapter 105 permit applications to provide opportunity for verbal testimony and additional written comment.
DEP certifies that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The DEP further certifies that the construction, operation and maintenance of the Project complies with Pennsylvania water quality standards and that the construction, operation and maintenance of the Project will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following DEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:
1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.
2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.
3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management), and all other applicable regulations.
4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.
5. Water Quality Monitoring—DEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.
6. Operation—At all times, Applicant shall properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.
7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of DEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals issued to ensure the project shall maintain and protect state water quality standards as required by this SWQC. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.
8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate DEP Office of such intent. Notice to DEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to DEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.
9. Correspondence—All correspondence with and submittals to DEP concerning this SWQC shall be addressed to the Department of Environmental Protection, Regional Permit Coordination Office, Domenic Rocco, PE, Director, 400 Market Street, Harrisburg, PA 17101, RA-EPREGIONALPERMIT@pa.gov.
10. Reservation of Rights—DEP may modify, suspend or revoke this SWQC if (i) DEP becomes aware of new facts about the Project that warrant such action; or (ii) DEP determines that the Applicant has not complied with the terms and conditions of this SWQC. DEP may require additional measures to achieve compliance with any applicable law or regulation.
11. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.
12. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of the SWQC shall not be affected thereby.
Any person aggrieved by this action may challenge it in an appropriate legal forum. The state and Federal courts are currently split on whether the proper forum to challenge a Department permit, authorization or approval for a facility or activity subject to the Federal Natural Gas Act, 15 U.S.C.A. § 717 et seq., is the United States Court of Appeals for the Third Circuit or the Pennsylvania Environmental Hearing Board. The Project, as proposed, includes the construction of approximately 0.5 mile of new 16-inch (H-327) and 12-inch (H-328) diameter natural gas pipeline, a new deep anode groundbed rectifier for cathodic protection, and associated ancillary facilities. In addition, the project is proposing the use of new and existing access roads, staging/parking areas, and contractor yards. EROSION AND SEDIMENT CONTROL The following parties have applied for Erosion and Sediment Control Permits for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.
Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. The Project, as proposed, includes the construction of approximately 0.5 mile of new 16-inch (H-327) and 12-inch (H-328) diameter natural gas pipeline, a new deep anode groundbed rectifier for cathodic protection, and associated ancillary facilities. In addition, the project is proposing the use of new and existing access roads, staging/parking areas, and contractor yards. The Project, as proposed, will require approximately 14.2 acres of earth disturbance.
This authorization is required for earth disturbance activities associated with oil and gas exploration, production, processing or treatment operations or transmission facilities when earth disturbance is 5 acres or greater. Review of this application is being coordinated among the Department and the associated county conservation districts.

PUBLIC COMMENTS FOR WATER OBSTRUCTIONS AND ENCROACHMENTS, STATE WATER QUALITY CERTIFICATION AND EROSION AND SEDIMENT CONTROL A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department office during the 30-day public comment period.
Following the 30-day comment period, the program manager from the appropriate Department office will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.
