California Air Resources Board Executive Officer's Certification of an Enhanced Conventional Nozzle by a Second Manufacturer

 The Department of Environmental Protection (Department) announces that effective Saturday, May 14, 2022, it finds that a second manufacturer received certification from the Executive Officer of the California Air Resources Board (CARB) for an enhanced conventional gasoline nozzle. Under 25 Pa. Code § 129.61a(k)(2)(i) (relating to vapor leak monitoring procedures and other requirements for small gasoline storage tank emission control) as established in the regulatory amendments to 25 Pa. Code Chapter 129 published at 52 Pa.B. 1875 (March 26, 2022), the Department is required to establish a date for when enhanced conventional gasoline nozzles must be installed at gasoline dispensing facilities subject to § 129.61a. Section 129.61a(k)(2)(i) provides that, ''[t]he owner or operator shall replace each conventional nozzle with an enhanced conventional nozzle within 2 years after the Department publishes notice in the Pennsylvania Bulletin of the CARB Executive Officer having issued an Executive Order of Certification to a second manufacturer for an enhanced conventional nozzle.'' On October 9, 2019, the Executive Officer of the CARB issued an Executive Order to a second manufacturer for an enhanced conventional gasoline nozzle. Consistent with § 129.61a(k)(2)(i), the owners and operators of gasoline dispensing facilities subject to § 129.61a will be required to install enhanced conventional gasoline nozzles before May 14, 2024, the date that is no later than 2 years after this publication.
