Rescission of Technical Guidance

[Saturday, May 14, 2022]The Department of Environmental Protection (Department) announces the rescission of the Technical Guidance Documents (TGD) listed as follows. TGDs are available on the Department's web site at www.depgreenport.state. pa.us/elibrary/ (select ''Technical Guidance Draft Documents'' or ''Technical Guidance Final Documents'' to view a menu of various Department bureaus where TGDs are listed).
Changes to TGDs
Following is the current list of recent changes. Persons who have questions or comments about a particular document should contact the person whose name and phone number are listed with each document.
Final TGD: Rescission
DEP ID: 251-2200-502. Title: Policy and Procedure for the Administration of the Household Hazardous Waste Collection Programs. Description: This document establishes policies and procedures for the administration of the requirements of section 1512 of the Municipal Waste Planning, Recycling and Waste Reduction Act of 1988 (Act 101) (53 P.S. § 4000.1512), pertaining to the development and conduct of household hazardous waste collection programs authorized by section 1512 of Act 101, and the regulations promulgated pursuant thereto at 25 Pa. Code Chapter 272, Subchapter F (relating to household hazardous waste collection, transportation and management). Section 1512 of Act 101 and 25 Pa. Code Chapter 272, Subchapter F, were made obsolete when the Small Business and Household Pollution Prevention Program Act of 1996 (35 P.S. §§ 6029.201—6029.209) (Act 190) was enacted and section 1512 of Act 101 was subsequently repealed (repealed December 19, 1996, P.L. 1478, No. 190). Therefore, this guidance is no longer needed.

Final TGD: Rescission
DEP ID: 251-2200-515. Title: Minimum Standards for the Establishment of Recycling and Household Hazardous Waste Programs Required by Act 101 of 1988. Description: This guidance was developed to set minimum standards for the establishment of recycling and household hazardous waste programs required by Act 101 for resource recovery facilities and made obsolete when Act 190 in 1996 was enacted, which repealed applicable sections of Act 101 (repealed December 19, 1996, P.L. 1478, No. 190). Therefore, this guidance is no longer needed.

Interim Final TGD: Rescission
DEP ID: 254-2412-002. Title: Act 90 Waste Transportation Safety Program Placarded Authorizations. Description: This guidance established procedures for owners of demonstrator vehicles, vehicles under rental/short-term leases or utilized for temporary storage and intermodal transportation vehicles to obtain an authorization from the Department to haul municipal or residual waste. Public comments were not received on this interim final guidance and the Department has no record of ever needing to issue placard authorizations to demonstrator vehicles. Since the Department has an established procedure for issuing stickers to all waste transportation vehicles, including leased and demonstrator vehicles, this guidance is no longer necessary.

DEP ID: 255-5800-001. Title: Guidance for Commonwealth-Funded Water Supply Response Actions. Description: This guidance was designed to assist Department personnel in implementing Commonwealth-funded water supply response actions as authorized by the Hazardous Sites Cleanup Act (35 P.S. §§ 6020.101—6020.1305) and the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104). This guidance is an outdated version of the Department's Document No. 262-5800-001 of the same name, which is maintained by the Bureau of Environmental Cleanup and Brownfields and was updated in 2013 and 2015. This outdated version of the guidance is no longer necessary.
