In accordance with 25 Pa. Code §§ 127.441, and 127.425, the Department of Environmental Protection (DEP) is providing notice that on July 19, 2022, DEP issued a renewed facility-wide, natural minor, State Only Operating Permit to Bute Coal Recovery, LLC, for the continued operation of a coal preparation plant, known as Bute Coal Preparation Plant, located in Dunbar Township & North Union Township, Fayette County.

 The facility processes waste coal. All coal processed is from old waste coal piles. The facility location is in a wooded area, about 800` from the nearest residence. The plant entry road is about 3,000 feet long. If the plant is operated continuously, maximum throughput into the facility is physically limited to 250 tons per hour or 2,190,000 tons per year (tpy) of waste coal (reject). The preparation plant contains equipment for dry screening, wet screening, and heavy media gravimetric separation. It has piles for raw and processed material, conveyors, and truck loading equipment. Sources at the Bute Coal Preparation Plant are subject to 40 CFR Part 60, Subparts A and Y, and 25 Pa. Code Chapters 121—145. The permit includes emission limitations and operational, monitoring, reporting, and recordkeeping requirements for the plant. No equipment or emission changes were approved by this action.

63-00940: MarkWest Liberty Midstream & Resources, LLC, 4600 J. Barry Ct., Ste. 500, Canonsburg, PA 15317-5854. On July 26, 2022, the Department of Environmental Protection issued an initial natural minor State-Only Operating Permit for the continued operation of the MarkWest Shaw natural gas compressor station located in Chartiers Township, Washington County. This facility is subject to the applicable requirements of 25 Pa. Code, Chapters 121—145 and the applicable requirements of 40 CFR Part 60 Subpart JJJJ and 40 CFR Part 63 Subparts ZZZZ and HH. As previously referenced, Water Obstruction and Encroachment (WOEP) Application E0829222-015 Chesapeake Appalachia, LLC (Chesapeake) has applied for an Individual—Joint Permit to construct, operate and maintain 0.649 acre of permanent and 0.111 acre of temporary impacts to on-site wetlands. All impacts are associated with the Rexford Bra Pad construction in 2010.

The DEP has taken action on the following plans and reports under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).

 Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports.

 A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

 The DEP may approve or disapprove plans and reports submitted. This notice provides the DEP's decision and, if relevant, the basis for disapproval.

 Notice is hereby given to the Pennsylvania Department of Environmental Protection (DEP) District Mining Operations, has received a major modification application from Consol Pennsylvania Coal Company LLC for Bailey Mine & Prep Plant, Permit No. 30841316, to amend the existing permit. The application is to expand the existing Coal Mining Activities Permit (CMAP) underground mining acreage and the subsidence control plan area by 684.5 acres for development only. The proposed mine expansion is located within Aleppo Township, Greene County. The existing mine is located within Richhill Township, Greene County.

 California District Mining offices has received a request for an informal public conference (IPC) concerning this major modification application. While the majority of COVID-19 restrictions have been lifted, many still feel unsafe gathering in person and in large groups indoors. In an effort to make this proceeding available to as many interested stakeholders as possible, this IPC is being held virtually on Wednesday, August 24, 2022 and will commence at 6 p.m. and end at 8 p.m.

 Individuals who wish to participate and ask questions during the IPC must contact Community Relations Coordinator Lauren Fraley at lfraley@pa.gov or 412.442.4203 a minimum of 24 hours in advance of the event to reserve a time to present testimony.  Surface Waters Receiving New Stormwater Discharges: UNT to Delaware River (CWF, MF) & UNT to Delaware River via EV Wetlands (EV). The discharges will be conveyed from the development site to the surface waters of the Commonwealth as follows: to the UNT to Delaware River via existing public storm sewer with the existing Portland Industrial Park and to the UNT to Delaware River via EV Wetlands through the newly proposed level spreaders and the newly protected downstream voluntary riparian forest buffer as an approved non-discharge alternative.

 Proposed Effluent Limitations: The draft permit requires implementation of an Erosion and Sediment Control (E&S) Plan and a Post-Construction Stormwater Management (PCSM) Plan and compliance with Federal technology-based effluent standards at 40 CFR Part 450.

 Rate or Frequency of Discharge: Stormwater discharges during and following earth disturbance activities are precipitation-induced and will vary depending on factors such as the area of impervious surfaces, the size and placement of best management practices (BMPs) and the intensity of precipitation.

 Project Description: The applicant seeks renewal of an existing NPDES Permit (issued 2016). The application was submitted more than 180 days prior to the permit expiration date and the permit has been administratively extended. The current renewal proposes the construction of a 420,000-square foot industrial building with associated employee parking, loading docks and tractor trailer parking areas with driveway access to Demi Road. Three detention basins discharge via level spreader to a voluntary riparian forest buffer to mitigate stormwater peak rate, volume and water quality increases (non-discharge alternative). The site is currently proposed to be served with public water and on-lot sewage disposal.
