The watershed restoration project is approved to reconnect the stream channel with the floodplain by removing legacy sediment impairment and restoring the floodplain to near historical elevations. This will eliminate a significant source of sediment in the Little Conestoga Creek from the existing unstable banks. The project will provide additional ecological, flood mitigation, recreational and open space opportunities. The restoration, rehabilitation, and enhancement activities on aquatic resources across approximately 45 acres of the Little Conestoga Creek sub-watershed of Conestoga River (Compensation Service Area 07 East). All or a portion of the existing eight wetlands totaling 3.06 acres and ten watercourse reaches totaling 9,258 linear feet of watercourse and the adjoining floodplains may be affected by the overall project. The project is a coordinated multi-phase and multi-year effort that involves project sites along the Little Conestoga Creek in relatively close proximity involving numerous landowners to address degraded environments, recreation trails and interacts with various public infrastructure (i.e. sewer and water lines, bridges, culverts, etc.). The project will also involve work related to the public infrastructure through this or other permits (i.e., GP-11). The project identifies and proposes to address current and historic resource degradation to wetlands, watercourses, and their floodplain environments on a watershed scale. The applicant identified areas within the Little Conestoga sub-watershed that have similar existing conditions that based upon a review of the data presented in the application and supplemental information provided, demonstrate degraded aquatic resource/watershed conditions that stem primarily from both legacy and modern era direct and indirect anthropogenic alterations that persist to the present. The applicant demonstrated five basic degraded conditions or system discontinuities that result in reduced watershed functions. The applicant proposes six phases of the overall project which include: 1) Conestoga House, 2) Barrcrest, 3) F&M, 4) Mennonite Home, 5) Woodcrest Villa, and 6) Schriener Station, to lessen or reverse the degradation or discontinuity through implementation of restoration, rehabilitation and enhancement construction techniques to address the predominant causes of degradation. Project phases 5 and 6 may include a partnership with DEP's in lieu fee program, Pennsylvania Integrated Ecological Services, Capacity Enhancement and Support Program. Functional gains from those phases may be utilized to satisfy third party compensation under such a partnership. The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. The Perkasie Regional Authority proposes to install a 4,000 ft water line extension, along Bethlehem Pike and along Tabor Road to connect approximately 50 existing homes affected by PFOS/PFOA contamination. The Department's review of the project and the information received in the Environmental Report for the project has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby approves the Environmental Assessment.

The Pennsylvania Department of Environmental Protection (DEP) has determined the Phase I Exclusionary Siting Criteria Application submitted by MAX Environmental Technologies, Inc. for proposed Hazardous Waste Landfill No. 7 to be administratively complete. The proposed commercial hazardous waste landfill is to be located at the MAX Yukon Facility, 233 MAX Lane, Yukon, PA 15698. The purpose of a Phase I application is solely to determine whether the proposed site complies with Pennsylvania's exclusionary siting criteria for hazardous waste disposal facilities. DEP is now conducting a technical review of the application to determine whether the proposed site complies with the Phase I Exclusionary Siting Criteria at 25 Pa. Code §§ 269a.21—269a.29. If the site does not meet the applicable criteria, a hazardous waste disposal facility may not be sited at that location. If the site does meet the applicable siting criteria, the applicant must submit a detailed permit application for facility design and operation before a permit decision could be reached.
As a part of the Phase I Exclusionary Siting Criteria Application review process, DEP has scheduled a combined public information meeting and hearing for Thursday, December 1, 2022. The combined meeting and hearing will be held from 6:00 p.m. to 9:00 p.m. at the Yukon Volunteer Fire Department, 124 Highway St, Yukon, PA 15698. During the meeting portion of the event, DEP will describe the application review process, siting criteria, and the opportunities for public participation in the process. The meeting will include time for public questions on the permitting process and the Phase I application. General information about the application and the permit review process will be available prior to the meeting on the designated DEP Community Information webpage for ''MAX Yukon Haz. Waste Landfill No. 7'' found at www.dep.pa.gov/southwest.
After the meeting portion, a public hearing will be held at the same location as the public information meeting. The hearing is intended to allow for public testimony on the Phase I Exclusionary Siting Criteria Application. DEP will record testimony and receive written comments at the hearing. Testimony will be limited to 3 minutes for DEP to receive as many comments as possible. Time may not be relinquished or shared, and organizations are asked to designate one speaker on its behalf. All comments, whether provided orally at a hearing or in writing, carry equal weight and consideration before DEP. Individuals who wish to observe or present testimony at the hearing are asked to register in advance by sending an e-mail to RA-EPHWMAXYUKONLF7@pa.gov or by telephone at 412-442-4203. Registration for the hearing will be taken through 4:00 p.m. the day before the hearing.
