On July 7, 2022, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP22-486). On August 19, 2022, the FERC issued a Notice of Intent to Prepare an Environmental Impact Statement, which may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP22-486).
On August 5, 2022, Applicant requested a state water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.
The Project, as proposed, includes an approximately 2-mile long, 36-inch pipeline, 2 compressor station modifications, and associated ancillary facilities to transport natural gas from Appalachia supply basin in Southwest Pennsylvania to existing local distribution company (LDC) customers in New Jersey. The Project, as proposed, will require approximately 97 acres of earth disturbance, and impacts to 262 linear feet of Deep Run (WWF, MF), tributaries to Deep Run (WWF, MF), and tributaries to Great Trough Creek (TSF, MF), 1.86 acres of floodway, 0.48 acre of temporary PEM wetland impacts, and 0.22 acre of PEM permanent impacts.
PADEP, by this notice, is proposing to issue a SWQC to Texas Eastern Transmission, LP for the Appalachia to Market II & Armagh & Entriken HP Replacement Project. PADEP is proposing to certify that construction, operation and maintenance of the Appalachia to Market II & Armagh & Entriken HP Replacement Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP is proposing to further certify that the construction, operation and maintenance of the Appalachia to Market II & Armagh & Entriken HP Replacement Project complies with Pennsylvania water quality standards and will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:
1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.
2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.
3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management), and all other applicable regulations.
4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.
5. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.
6. Operation—At all times, Applicant shall properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.
7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals issued to ensure the project shall maintain and protect state water quality standards as required by this SWQC. Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.
8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.

Project components involving water obstructions and encroachments include modifications to the Entriken Compressor Station in Huntingdon County and the installation and maintenance of an approximately 2-mile long, 36-inch diameter pipeline and appurtenant facilities in Bethel and Jackson Township within Lebanon County for improving the system reliability and providing additional natural gas to customers in NJ. The project consists of one Chapter 105 Water Obstruction and Encroachment Permit, one Chapter 105 Waiver, and one Chapter 102 Erosion and Sediment Control Permit. The following are the Chapter 105 permit applications being reviewed by the Department.
E3883222-003. The Lebanon County portion of the project is located in Bethel and Jackson Townships, U.S. Army Corps of Engineers, Baltimore District. The proposed project starts at the existing receiver removal site off Halfway Drive (Latitude: 40.393475°; Longitude: -76.366350°) and ends at the proposed receiver site off East Rosebud Road (Latitude: 40.405699°; Longitude: -76.332384°).
The proposed project impacts in Lebanon County include a total of 26 feet of temporary impacts and 21 feet of permanent impacts to Deep Run (WWF, MF) and tributaries to Deep Run (WWF, MF); 0.13 acre of temporary floodway impacts, 0.09 acre of permanent floodway impacts; 0.48 acre of temporary impacts to PEM; and 0.22 acre of permanent impacts to PEM wetlands. To compensate for the proposed permanent project impacts in Lebanon County, Applicant is proposing to purchase credits from the Pennsylvania's Integrated Ecological Services, Capacity Enhancement and Support Program (PIESCES), which will include a total of 1.68 credits for wetland impacts, 0.05 credit for stream impacts, and 0.2 credit for assumed 50-foot floodway impacts.
WL3183222-001. The Huntingdon County portion of the project requests the Chapter 105 Waiver 105.12(a)(2) and is located in Todd Township, U.S. Army Corps of Engineers, Baltimore District. The proposed project is located at the Entriken Compressor Station, off SR 3031 (Latitude: 40.310087°; Longitude: -78.139601°).
The proposed project impacts in Huntingdon County include a total of 215 linear feet of temporary impacts to UNT to Great Trough Creek (TSF, MF); 0.89 acre of temporary floodway impacts and 0.75 acre of permanent floodway impacts. There are no permanent stream impacts proposed.
EROSION AND SEDIMENT CONTROL The following parties have applied for Erosion and Sediment Control Permits for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.
Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

The existing mine is located within Donegal Township in Washington County.
California District Mining office has received requests for an informal public conference (IPC) concerning these major modification applications. The following notice(s) is placed through the Department of Environmental Protection as required by 25 Pa. Code § 290.102.
Proposal(s) to use coal ash as structural fill received under the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).
Scrubgrass Generating Company L.P., Scrubgrass Township, Venango County. Scrubgrass Generating Company L.P. (Scrubgrass), proposes to place coal ash on site as structural fill to provide a support area for the installation of a solar panels. The proposed final grade will produce a relatively flat area. Signage and fencing will be added to restrict public access for security, safety, and environmental concerns. The Department's Regional Office has determined the proposal is consistent with the requirements of 25 Pa. Code § 290.102.
