State Board of Medicine—
Orthotic Fitter Temporary Permits and Training
Regulation No. 16A-4947 (# 3286)

 On December 22, 2020, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Medicine (Board). This rulemaking amends 49 Pa. Code Sections 18.841—18.843. The proposed regulation was published in the January 9, 2021 Pennsylvania Bulletin with a public comment period ending on February 8, 2021. The final-form regulation was submitted to the Commission on October 5, 2022.

 This regulation increases the time period during which an individual may practice as an orthotic fitter trainee under a temporary practice permit; identifies circumstances under which an individual may apply for a second temporary practice permit; requires that an orthotic fitter trainee complete 1,000 hours of orthotic fitting care experience which includes the full scope of orthotic fitting practice; and allows for Board approval of other entry-level education programs specific to orthotic fitting.

 We have determined this regulation is consistent with the statutory authority of the Board (63 P.S. §§ 422.8 and 422.13e(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

 On January 4, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board (Board). This rulemaking amends 25 Pa. Code Chapters 121 and 129 by adding §§ 129.63b and 129.71a and amending §§ 121.1 and 129.52. The proposed regulation was published in the January 29, 2022 Pennsylvania Bulletin with a public comment period ending on April 4, 2022. The final-form regulation was submitted to the Commission on October 13, 2022.

 This rulemaking establishes presumptive volatile organic compound emission reasonably available control technology (RACT) requirements and RACT emission limitations for the following control techniques guidelines source categories: shipbuilding and ship repair surface coatings; large petroleum dry cleaning facilities and synthetic organic chemical manufacturing industry air oxidation, distillation and reactor processes.

 We have determined this regulation is consistent with the statutory authority of the Board (35 P.S. §§ 4005(a)(1) and (a)(8)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Environmental Quality Board—
Safe Drinking Water PFAS MCL Rule
Regulation No. 7-569 (# 3334)

 On February 15, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board (Board). This rulemaking amends 25 Pa. Code, Chapter 109. The proposed regulation was published in the February 26, 2022 Pennsylvania Bulletin with a public comment period ending on April 27, 2022. The final-form regulation was submitted to the Commission on October 13, 2022.

 This regulation amends Chapter 109 (relating to safe drinking water) to set maximum contaminant level goals and maximum contaminant levels in drinking water for two chemicals—perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS)—which are part of a larger group of perfluoroalkyl and polyfluoroalkyl substances, known as PFAS. The proposed regulation also includes monitoring requirements for public water systems to demonstrate compliance with the PFOA and PFOS standards.

 We have determined this regulation is consistent with the statutory authority of the Board (35 P.S. § 721.4 and 71 P.S. § 510-20) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

 On October 13, 2022, the Independent Regulatory Review Commission (Commission) received this regulation from the Environmental Quality Board (Board). This rulemaking amends 25 Pa. Code Chapter 129 by adding Sections 129.131—129.140. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 This final-omitted rulemaking adopts reasonably available control technology (RACT) requirements and RACT emission limitations for conventional oil and natural gas sources of volatile organic compound emissions.

 We have determined this regulation is consistent with the statutory authority of the Board (35 P.S. §§ 4005(a)(1) and (8)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
