THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department of Environmental Protection (DEP) has taken the following actions on previously received applications for new, amended, and renewed National Pollutant Discharge Elimination System (NPDES) and Water Quality Management (WQM) permits, applications for permit waivers, and Notice of Intent (NOIs) for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated County Conservation District (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).
The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The State and Federal courts are currently split on whether the proper forum to challenge a Department permit, authorization or approval for a facility or activity subject to the Federal Natural Gas Act, 15 U.S.C.A. § 717 et seq., is the United States Court of Appeals for the Third Circuit or the Pennsylvania Environmental Hearing Board. Cove Village Community Act 537 Planning, 2-54943037-3. The existing sanitary sewer collection system serving Cove Village Community is owned and operated by Aqua Pennsylvania Wastewater, Inc. The existing sanitary system is reaching the end-of-useful-life and consequently requires an upgrade and rehabilitation. The proposed project includes the removal of one pump station and upgrades to the remaining four pump stations. The pump station to be removed is an intermediate pump station which does not receive any additional flow from any source other than the pump station located upstream of it. The upgrades to the remaining four pump stations in the system include new wet wells, pumps, valve vaults, process piping/fittings, valves, and flow metering. The section of the force main and gravity sewer system, between the pump stations upstream and downstream of the pump station to be removed, will be replaced with a continuous force main. This force main will be about 1,800 linear feet in length and follow a route similar to the existing force main and gravity sewer system. This plan revision is approved. Implementation of this Plan will require a Water Quality Management (Part II) Permit for the construction and operation of the proposed sewage facilities. The Plan consists of separate alternatives for the Borough and the Township. The Borough will renovate two pump stations, reduce inflow and infiltration throughout the existing sanitary sewer system, and renovate, upgrade, and expand the existing wastewater treatment plant from 1.50 MGD to 2.00 MGD on an annual average flow basis. The Township will be allocated an additional 320 equivalent dwelling units (EDUs) of wastewater flow in the Borough's treatment plant to use for existing and future development in the Township. The Township will also implement an on-lot sewage management program. The Township will also negotiate with Catasaqua Borough to develop an intermunicipal agreement for the conveyance and treatment of wastewater flow from future developments. The current user rates are not expected to change as the projects in the Borough will be financed through a bond and the projects in the Township will be financed through the purchase of the EDU allocation by developers and remitted to the Borough. The plan revision is approved. Implementation of this plan will require an NPDES (Part I) permit for the proposed increase in the Borough's treated effluent discharge and Water Quality Management (Part II) permit for the construction and operation of the proposed sewage facilities. Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

101699. Waste Management of Fairless, LLC, 1000 New Ford Mill Road, Morrisville, PA 19067, Falls Township, Bucks County. This major permit modification approves the use of Reclaimed Asphalt Pavement (RAP) material as an acceptable component within the Mechanically Stabilized Earth (MSE) berms and other perimeter berms.
