PUBLIC WATER SUPPLY PERMITS Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.
Persons wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30 days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. A comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent (NOI) to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a (NOI) to Remediate with the Department. A NOI to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified person, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.
A person wishing to request a hearing may do so during the 30-day comment period. 63-00538: Dynamet, Inc., 195 Museum Road, Washington, PA 15301. Notice is hereby given in accordance with 25 Pa. Code §§ 127.44—127.46 that the Pennsylvania Department of Environmental Protection (Department) intends to issue a modification to Air Quality Plan Approval PA-63-00538 to increase the chromium emission limit at the titanium finishing facility located in Chartiers and South Strabane Townships, Washington County.
Dynamet has requested to increase the chromium limit from 0.00008 lb/hr to 6.34E-04 lb/hr based on initial stack testing results. The modified plan approval has been conditioned to ensure compliance with all applicable requirements specified in 25 Pa. Code, and includes emissions limitations and work practice, monitoring, recordkeeping, and reporting requirements.
At the request of the Department, Dynamet conducted an inhalation risk assessment to evaluate potential cancer and noncancer inhalation risks associated with potential air emissions from the process. Chronic risks for chromium were summed and compared against the Department's benchmark excess lifetime cancer risk and health index (HI) values. Acute risks for chromium were compared against the Department's benchmark hazard quotient (HQ) value.

24-012L: GrafTech USA, LLC, 800 Theresia Street, St Marys, PA 15857, for the proposed reactivation of Source 186 (Carbottom Furnaces—16 rated at 10 MMBtu/hr each fired with natural gas). The facility is located in St Marys City, Elk County. This is a Title V facility. The public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. This plan approval will, in accordance with 25 Pa. Code § 127.450 or § 127.505, be incorporated into the facility operating permit at a later date.
Plan approval No. 24-012L is for the proposed reactivation of Source 186 (Carbottom Furnaces—16 rated at 10 MMBtu/hr each fired with natural gas). This Plan Approval will contain emission restriction, testing, recordkeeping, work practice standard and additional requirement conditions, which will satisfy the requirements of 25 Pa. Code § 127.12b (pertaining to plan approval terms and conditions) and will demonstrate Best Available Technology (BAT) for the source including, but are not limited to, the following:
• The permittee shall not exceed 1.49 lbs of VOC per ton of carbon baked in the furnace or 89.6 tpy based on a consecutive 12-month period from Source 186, Source 1001, Source 1002, Source 1003, Source 1004, Source 1005, & Source 1006.
• The permittee shall not allow emissions of carbon monoxide in excess of 0.40 lb/hr or 0.43 tpy based on a consecutive 12-month period from Source 186, Source 1001, Source 1002, Source 1003, Source 1004, Source 1005, & Source 1006.
• The permittee shall not allow emissions of particulate matter in excess of 8.70 lbs/hr or 16.8 tpy based on a consecutive 12-month period from Source 186, Source 1001, Source 1002, Source 1003, Source 1004, Source 1005, & Source 1006.
• The following SO2 emission limits shall not be exceeded during all periods of operation of the (16) carbottom kilns (Source 186, Source 1001, Source 1002, Source 1003, Source 1004, Source 1005, & Source 1006):
• One-hour average: 18.7 lbs/hr or 71 ppm(v) on a dry basis
• Full Cycle average: 6.3 lbs/hour or 30 ppm(v) on a dry basis
• Annual SO2 Emissions: 16 tons per year based on a consecutive 12-month period
• Compliance with SO2 emission limits defined previously, shall be demonstrated through the installation of a Department approved SO2 continuous emission monitor (CEM). One-hour and full cycle average concentrations shall be used in conjunction with the CEMs to determine compliance. Full cycle emission limit compliance shall be based on a 30-day average of data, rolled daily. Lb/hour and annual emission limit compliance shall be determined through CEM data and airflow measured. CEM parameters for data collection and resolution shall be as defined the most current revision of the Department's Continuous Source Monitoring Manual. Recordkeeping and reporting of CEM data shall be done in accordance with the most current revision of the Department's Continuous Source Monitoring Manual. Compliance calculations for lbs/hr and annual emission limits shall be included in the recordkeeping and reporting requirements.
• Within 60 days after achieving the normal production rate at which the affected source will be operated, but not later than 180 days after initial start-up of the source/control device, a stack test shall be performed in accordance with the provisions of Chapter 139 of the Rules and Regulations of the Department of Environmental Protection. The stack test shall be performed while the aforementioned source is operating at the maximum or normal rated capacity as stated on the application. The stack test shall determine the overall VOC control efficiency (using EPA Method 25A as appropriate) at the outlet of the RTO (C186A or C186B). In the event that any deadlines set forth in this condition cannot be met, the permittee may request an extension which shall include a justification for the extension, in writing prior to the deadline. The Department may grant an extension for reasonable cause.
• The permittee shall maintain a continuous recording of the thermal oxidizer's inlet and outlet gas temperature and retain these records for at least five years.
• A SO2 continuous emission monitor (CEM), and flow monitor to continuously monitor airflow of the effluent gas, shall be installed in the effluent stack of the source. The CEMs shall be installed in accordance with 25 Pa. Code Chapter 139, and the latest version of the Continuous Source Monitoring Manual, published by the Department. Department approval of Phase I of the SO2 CEM requirement, as defined in the source monitoring manual, shall be implemented within six (6) months of the issue date of this Plan Approval, or a Department approved revised date based upon the expected completion of construction of the source. Phase II shall be completed within 180 days of Phase I approval. Phase III shall be submitted to the Department within 60 days of completion of Phase II.
• The permittee shall use the following approved process parameters or indicators to obtain data and monitor the emission control equipment performance:
• The inside temperature of Thermal Oxidizer.
• The permittee shall use the following approved means or devices to measure the applicable indicators.
• Temperature indicator system.
• The permittee shall use the following approved frequencies for conducting monitoring of indicators.
• Inside temperature of thermal oxidizer measured daily.
• The permittee shall use the approved period over which discrete data points for approved indicators will be collected and averaged for the purpose of determining excursion.
• The operating temperature of the thermal oxidizer shall be recorded and maintained at or above 1,500°F on a rolling 3-hour average basis. The average temperature for each 1-hour period will be recorded from all available readings. The 1-hour values will then be averaged over each rolling 3-hour period to provide a basis to assess compliance. Any deviation from this 3-hour rolling average operating temperature is considered an excursion.
• The permittee shall record the inside temperature of thermal oxidizer continuously on a strip chart.
• The permittee shall record all inspections, repair and maintenance performed on the monitoring equipment.
• The permittee shall record all excursions and corrective actions taken in response to an excursion and the time elapsed until corrective actions have been taken.
• The permittee shall maintain records of all monitoring downtime incidents (other than downtime associated with zero and span or other daily calibration checks, if applicable). The permittee shall also record the dates, times and durations, possible causes and corrective actions taken for the incidents.
• The permittee shall keep all records for a period of five (5) years and make the records available to the Department upon request.
• The permittee shall maintain a record of all preventive maintenance inspections of the control device. These records shall, at a minimum, contain the dates of the inspections, any problems or defects, the actions taken to correct the problem or defects, any routine maintenance performed and the pressure drop across the control device.
• The permittee shall calculate from material balance the amount of carbon monoxide generated from this source in terms of pounds per hour.
• The permittee shall maintain a record of pounds of VOC emitted per tons of carbon baked in the furnace.
• The permittee shall calculate the twelve-month rolling total of actual VOC emissions from the source. The total calculated shall be maintained in a log and updated monthly.
• The permittee shall report all excursions and corrective actions taken, the dates, times, durations and possible causes, every six (6) months.
• The permittee shall report all monitoring downtime incidents (other than downtime associated with zero and span or other daily calibration checks, if applicable), their dates, times and durations, possible causes and corrective actions taken, every six (6) months.
• The permittee shall utilize approved QA/QC practices that are adequate to ensure continuing validity of data and proper performance of the device.
• The permittee shall, for an approved device(s), install detectors or sensors at a location approved by the Department for obtaining data that are representative of the monitored indicator.
• The permittee shall develop verification procedures to confirm the operational status of new or modified monitoring equipment prior to commencement of the monitoring process.
• The permittee shall maintain all monitoring equipment and stock parts necessary for routine repairs onsite.
• The permittee shall ensure that at least 90% of the monitoring data has been properly and accurately collected.
• The permittee shall submit an implementation plan and schedule if the approved monitoring requires the installation, testing or other necessary activities. The schedule for completing installation and beginning operation on monitoring may not exceed 180 days after the issuance date of the permit.
• The permittee shall adhere to approved ranges for the selected indicators so that operation within the range shall provide reasonable assurance of compliance. A departure from the specified indicator range over a specified averaging period shall be defined as an excursion:
• The operating temperature of the thermal oxidizer shall be recorded and maintained at or above 1,500°F on a rolling 3-hour average basis. The average temperature for each 1-hour period will be recorded from all available readings. The 1-hour values will then be averaged over each rolling 3-hour period to provide a basis to assess compliance. Any deviation from this 3-hour rolling average operating temperature is considered an excursion.
• For QA/QC purposes, the permittee shall calibrate and check the accuracy of monitoring equipment taking into account the manufacturer's specifications at approved time intervals.
• The accuracy of temperature indicator shall be checked and calibrated annually.
• The permittee shall perform a weekly preventive maintenance inspection of control device.
• The permittee shall monitor and keep a record of the exhaust temperature of the thermal oxidizer.
• The permittee shall operate the control device at all times that this source in operation.
• The permittee shall maintain and operate this source and the control devices in accordance with the manufacturer's specifications and good air pollution control practice.
• The permittee shall install, operate, and maintain the low NOx burners (for car bottom kilns 491—496) in accordance with the manufacturer's specifications and good air pollution control practices.
• The permittee shall develop and implement a quality improvement plan (QIP) as expeditiously as practicable if any of the following occurs:
• Six excursions occur in a six-month reporting period.
• The Department determines after review of all reported information that the permittee has not responded acceptably to an excursion.
• In general, the QIP plan should be developed within 60 days and the permittee shall provide a copy of QIP to the Department. Furthermore, the permittee shall notify the Department if the period for completing the improvements contained in the QIP exceeds 180 days from the date on which the need to implement the QIP was determined.
• The permittee shall record actions taken to implement a QIP during a reporting period and all related actions including, but not limited to inspections, repairs and maintenance performed on the monitoring equipment.
• In accordance with 40 CFR 64.8, the QIP shall include procedures for evaluating the control performance problems. Based on the results of the evaluation procedures, the permittee shall modify the QIP, and provide a copy to the Department, to include procedures for conducting more frequent or improved monitoring in connection with one or more of the following:
• Improved preventive maintenance practices.
• Process operation changes.
• Appropriate improvements to control methods.
• Other steps appropriate to correct performances.
• Following implementation of a QIP, the Department will require reasonable revisions to the QIP if the plan has failed to either:
• Address the cause of the control device performance problem.
• Provide adequate procedures for correcting control device performance problems in as expeditiously as practicable in accordance with good air pollution control practices for minimizing emissions.
• Implementation of a QIP, shall not excuse the owner or operator of a source from compliance with any existing emission limitation or standard or any existing monitoring, testing, reporting or recordkeeping requirement that may apply under any Federal, State, or local laws or any other applicable requirements under the Clean Air Act.
In accordance with 25 Pa. Code § 127.44(f)(1), all the pertinent documents regarding this application (applications, review memos, and draft approvals) are also available for review from 8:00 a.m. to 4:00 p.m. at the Meadville Regional DEP office (Air Quality). The Department of Environmental Protection's (Department) review of the information submitted by Bridon-Bekaert Corporation indicates that an additional wire drawing process to be constructed will comply with all regulatory requirements pertaining to air contamination source and the emission of air contaminants including 25 Pa. Code § 123.41 for visible emissions and the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Proposed fabric collector will collect 99% of particulate emissions generated from the steel wire drawing process operations before discharging into atmosphere. The use of baghouse capable of removing 99% of emissions meets Department's BAT criteria for this type of process. The company will operate the sources and maintain the system in accordance with the good engineering practices to assure proper operation of the system. The facility is a State Only facility. If the Department determines that the process is constructed and operated in compliance with the plan approval conditions and the specification of the application for Plan Approval 40-00090A, the requirements established in the plan approval will be incorporated into State Only Operating Permit 40-00090 pursuant to the administrative amendment provisions of 25 Pa. The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District Mining Office indicated above each application. Requests for 401 Water Quality Certifications are included in individual application only if noted.
Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the District Mining Office indicated above each application within 30-days of this publication, or within 30-days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences). Such comments or objections should contain the name, address and phone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.
In addition, requests for an informal conference, or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 (relating to public hearing-informal conferences) or § 86.34 (relating to informal conferences), must also contain a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
Where a National Pollutant Discharge Elimination System (NPDES) number is listed, the mining activity permit application is associated with an application for an NPDES permit. A separate notice will be provided for the draft NPDES permit.

MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The limits for noncoal mining activities as provided in 25 Pa. Code § 77.522 are pH 6 to 9 and other parameters the Department may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
Additional criteria
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan, and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters of this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Submittal of comments
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit notice within 30-days of this notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and phone number of the writer and a concise statement to inform the Department of the basis of a comment and the relevant facts upon which it is based.
Requests or petitions for a public hearing on any NPDES permit applications will be accepted as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30-days of this public notice and contain the name, address, phone number and the interest of the party filing the request and state the reasons why a hearing is warranted. The Department may hold a public hearing if the public interest is significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will consider comments from the public hearing in the final determination on the NPDES permit application.
Noncoal NPDES Draft Permits

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30-days of the date of this notice, as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. PA DOT Engineering District 3-0 proposes to place approximately 630 L.F. of Grouted R-8 Rip Rap, at a 1:1 side slope to stabilize the SR 4033 Roadway Slope and the Left Bank of the adjacent stream. The project will restore the roadway and stream to pre-flood conditions, which were damaged during a storm event on July 12, 2021. The project will include six single log deflectors to stabilize the stream bank and aid in aquatic habitat. The project will remove gravel deposition near the upstream and downstream ends of the project to restore the channel to a normal width and depth. The project will include a temporary diversion dike system to convey the stream, during construction. The project does not propose any jurisdictional wetland impacts.
