Bureau of Standardbred Horse Racing Administrative Guidance Policy SHRC 2023-1

 The State Horse Racing Commission (Commission), in accordance with 3 Pa.C.S. § 9312(6) (relating to additional powers of commission) of the Race Horse Industry Reform Act and 7 Pa. Code § 403.15(a) (relating to Furosemide (Lasix—standardbred)), recognizes that Furosemide Lasix (Lasix) is helpful in the management of Exercise Induced Pulmonary Hemorrhage in the standardbred horse. In overseeing the race-day use of Lasix, the Commission has placed strict regulatory controls on the dose, route and time the medication is administered. These measures are designed to provide a complete regulation of Lasix and to prevent the misuse of the drug, including, where appropriate, the reasonable restriction on the use of Lasix.

 The Commission also regulates the procedures for the removal of the horse from the use of Lasix and the corresponding restricted Bleeder's List. Section 403.15(h) provides that after 45 days of being placed on the Bleeder List, an owner or trainer may seek to stop the use of Lasix and remove the horse from the Bleeder's List after a qualifying race to confirm no evidence of bleeding and the lack of Lasix in the horse's system. The Commission believes that it is in the best interests of the horse to stop the use of Lasix and remove the horse from the Bleeder List as expeditiously as possible.

 As used in subsection (h), the Commission interprets the term ''qualifying race'' to mean the ''next start'' in which the horse is entered to participate. The horse will be post-race tested to determine any evidence of bleeding or the use of Lasix.

 For purposes of consistency and uniformity, the Commission provides notice it intends to follow the previously listed interpretation and guidance under other Mid-Atlantic racing jurisdictions. This guidance document will be effective April 1, 2023.

 This administrative guidance policy was approved by the Commission on February 28, 2023, and has been published on the Commission's web site at http://www.agriculture.pa.gov/Animals/RacingCommission/commission/Pages/Publications.aspx.
