The facility seeks approval of installation of a portable odor neutralizer system to address the potential intermittent transient odors from the removal of approximately 40,000 cubic yards of waste from Cells 4 South and 5 South and replacement of this waste in the active landfill area. This is required to allow construction of Cell 9 as part of the southern expansion at the landfill. VOCs emitted from the odor neutralizer system are expected to be less than 0.09 TPY which is less than the de minimis VOC increase allowed by Condition # 019 found in Section B of the Title V Permit as well as 25 Pa. Code Section 127.449(b)(5). The VOCs are based on 125 gallons per month of product used over 6 months and a VOC content of 0.115 lb/gallon. The Department has reviewed the proposal and agrees with the increase. The odor neutralizer system shall be installed and operated in accordance with the proposal, the manufacturer's recommendations, and with good air pollution control practices. The facility shall keep a record of the quantity of odor neutralizing material used each month and an estimate of the VOCs emitted from the neutralizing system for each month.

 The Department of Environmental Protection has issued a Chapter 105 water obstruction and encroachment permit to Aaron and Nicole Yohn to install and maintain a permanent bank-to-bank bridge over Pepper Run for permanent private access to their property on the west side of the stream. This project was initially authorized and installed under a GP-8 in September 2022. At that time, approximately 2,300 sq. ft. of earth disturbance occurred along the stream and within the floodway. An additional 10,000 sq. ft. of earth disturbance occurred to construct the access roadway into the crossing site and on the far side of the stream. No new disturbance will occur as part of this permit action. The bridge is a single span 30-foot-long x 12-foot-wide steel beam with a timber deck on precast foundations. There are no anticipated adverse impacts to waters of the U.S. or aquatic resources from this crossing project. No wetlands will be impacted. The drainage area at the crossing site is 1.93 square miles. Pepper Run is listed in the Pa. Code chapter 93 designation as a High Quality, Cold Water Fishery (HQ-CWF) with Migratory Fish (MF).  The Department of Environmental Protection (DEP) under the authority of the Hazardous Sites Cleanup Act (HSCA), Act of October 18, 1988, P.L. 756, No. 108, 35 P.S. §§ 6020.101—6020.1305, has entered into a Consent Order and Agreement (CO&A) with American Tinning & Galvanizing Company (American Tinning) concerning a cleanup of a wheelabrator dust pile at the Vallimont Site (Site).

 The Site is located on a 29.22-acre property located at 9266 Kuhl Road, Erie, PA 16510. The wheelabrator dust pile is an approximately 40 feet x 40 feet, exposed pile of reddish-brown colored solid material in the western area of the Site (Operable Unit 1). The wheelabrator dust, which was disposed in Operable Unit 1, was generated at American Tinning's facility in Erie, PA.

 Since the 1980s, sampling events of various media have been completed by the U.S. Environmental Protection Agency and DEP. The wheelabrator dust disposed in Operable Unit 1 includes elements, chemical compounds or materials, including cadmium, chromium, vanadium, iron, arsenic, and lead, which are ''hazardous substances'' as defined in Section 103 of the HSCA, 35 P.S. § 6020.103. The presence of these hazardous substances in the Site waste and soil constitute a ''release'' and ''threatened release'' of hazardous substances at the Site pursuant to Section 103 of the HSCA, 35 P.S. § 6020.103.

 American Tinning, as a generator of wheelabrator dust, is a ''responsible person'' as defined in Sections 103 and 701 of HSCA, 35 P.S. §§ 6020.103 and 6020.701. DEP has determined that it is practicable and in the public interest to enter into a CO&A with American Tinning, pursuant to Section 505(g) of HSCA, 35 P.S. § 6020.505(g). The terms of the CO&A require American Tinning, at Operable Unit 1, to perform a ''response,'' as defined in Section 103 of the HSCA, 35 P.S. § 6020.103, to resolve its liability and to minimize or eliminate the release in order to protect the present or future public health, safety or welfare, or the environment. In exchange, DEP has agreed to provide American Tinning with protections against certain future liabilities, which are more fully described in the CO&A.

 This notice is provided under Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that, ''settlement shall become final upon the filing of DEP's response to significant written comments.'' DEP has reserved the right to withdraw its consent to the CO&A if comments concerning the CO&A disclose facts or considerations which indicate that the CO&A is inappropriate, improper, or not in the public interest. A person adversely affected by the settlement may file an appeal with the Pennsylvania Environmental Hearing Board. A public comment period on the CO&A will extend for 60 days from the date of this notice. Persons may submit written comments regarding this CO&A, within 60 days from today's date, by submitting them to Colin Kosinski in the Environmental Cleanup and Brownfields Program by email at ckosinski@pa.gov or at 230 Chestnut Street Meadville PA 16335.
